Who does the commune military command in Vietnam include?
Pursuant to Clause 1, Article 20 of the Law on Militia and Self-defense Forces 2019, the compositions of military commands of communes include:
- Commanders that are members of People’s Committees of provinces and reservists; during national defense emergencies and at war, shall be conscripted for active duty as specified in Law on People’s Army of Vietnam and shall continue to hold the title of commanders of military commands of communes;
- Political commissars shall be assigned to secretaries of Party Executive Committees of communes;
- Deputy political commissars shall be assigned to secretaries of the Ho Chi Minh Communist Youth Union;
- Deputy commanders are part-time activists in communes.
What are the functions and duties of commune military commands in Vietnam?
Pursuant to Clause 3, Article 20 of the Law on Militia and Self-defense Forces, the functions and duties of commune military commands in Vietnam are as follows:
- Act as advisors for Party Executive Committees and commune-level governments to facilitate lead, direction, management, and guidance on the implementation of national defense and military tasks as per the law;
- Take charge and cooperate with ministries and departments in developing and organizing the implementation of national defense plans and other plants related to national defense and military tasks of communes;
- Cooperate with Vietnamese Fatherland Front Committees, ministries, and departments of communes in publicizing policies and viewpoints of the Communist Party, policies and regulations, and laws of government, educating on national defense and security; participating in developing totally strengthened facilities; adopting rear service, incentives for people with meritorious services to the revolution policies;
- Organize military training, political and law education, sports competitions, and drills for the militia; direct militia to conduct tasks as specified in this Law, other relevant law provisions, and decisions of competent authorities;
- Register, manage, preserve, and use military weapons, military explosives, combat gears, equipment, devices, and technical instruments of militia under management in accordance with regulations and law and decisions of competent authorities;
- Act as advisors to enable People’s Committees of communes to examine and take actions against violations, handle complaints and accusations, conduct preliminary reports and final reports, and adopt competitions and commendations regarding local national defense as per the law.
What are the regulations on allowances for commanding titles in commune military commands in Vietnam?
Pursuant to Article 7 of Decree 72/2020/ND-CP stipulating as follows:
Allowances for commanding titles of militia and self-defense forces
1. Allowances for commanding titles of militia and self-defense forces shall be paid monthly with the following levels:
a) Commanders and politicians of commune military commands; Commanders, Politicians, Military Commands of agencies and organizations: 357,600 VND;
b) Deputy commanders, deputy politicians of commune military commands; deputy commanders, deputy politicians of the military commands of agencies and organizations; Commanders in chief of battalions, political commissars of squads; Naval commanders in chief, political commissars of naval squadrons; Commanders in chief of flotillas, political commissars of flotillas; Commanders in chief of companies, political commissars of companies: 327,800 VND;
c) Commanders in chief of battalions, deputy political commissars; Deputy naval commanders, deputy political commissars; commanders in chief of companies, deputy political commissars; commanders in chief of flotillas, deputy political commissars: 312,900 VND;
d) Commanders in chief of companies, political commissars of companies; Commanders in chief of flotillas, political commissars of flotillas, commanders in chief of flotillas: 298,000 VND;
dd) Hamlet leaders: 178,800 VND and an additional 29,800 VND when concurrently serving as a platoon leader, or 35,760 VND when concurrently serving as a commander of on-site militia. In case the hamlet only organizes militias on the spot, it is entitled to an additional 29,800 VND;
e) Commanders in chief of companies, Deputy political commissars; commanders in chief of flotillas, deputy political commissars: VND 223,500;
g) Commanders in chief of platoons; Permanent militia platoon leader: 178,800 VND;
h) Squads, captains of ships, commanders in chief of fireteams: VND 149,000.
2. The period of entitlement to allowances for commanding titles of militia and self-defense forces is from the date of the decision on appointment and implementation until the date of the decision to resign from that position; In case of holding office for 15 days or more in a month, they are entitled to a full-month allowance, holding office for less than 15 days in a month is entitled to 50% of that month's allowance.
Accordingly, allowances for commanding titles of commune military commands are:
- Commanders and politicians of commune military commands: VND 357,600;
- Deputy commanders, deputy politicians of commune military commands: VND 327,800
Note: This allowance is paid monthly
At the same time, the period of entitlement to the allowance is calculated from the date of the decision to appoint and implement it until the date of the decision to resign from that position.
In case of holding office for 15 days or more in a month, they are entitled to a full-month allowance, holding office for less than 15 days in a month is entitled to 50% of that month's allowance.
