Authority to issue Certificates of Security and Order by the Department of Administrative Management of Social Order, Ministry of Public Security
Based on the provisions of Clause 1, Article 24 of Decree 96/2016/ND-CP (amended by Clause 5, Article 1 of Decree 56/2023/ND-CP) as follows:
Authority to issue Certificates of Eligibility for Security and Order, Professional Protection Certificates, and Review Training Programs for Security Service Employees
1. The Department of Administrative Management of Social Order, Ministry of Public Security, is responsible for:
a) Issuing Certificates of Eligibility for Security and Order and managing business establishments, including:
Small-caliber military firearm businesses; industrial explosive materials and precursor explosive chemical businesses (excluding the transportation business of industrial explosive materials and precursor explosive chemicals); blasting service businesses; accommodation service businesses rated 5 stars and above; support tool businesses; paintball gun businesses (excluding service provision using paintball guns); casino businesses; electronic game businesses for foreigners; security service businesses with foreign investment and security service businesses with the function of training security service employees; business establishments under the Ministry of Public Security.
b) Leading examinations and issuing Professional Protection Certificates for security service employees trained at businesses with the function of training security service employees; vocational training centers of People's Public Security schools; training and professional fostering centers of units under the Ministry of Public Security with the function of training security service employees;
c) Reviewing curricula and training programs for security service employees for facilities training security service employees as stipulated in Clause 1, Article 12 of this Decree.
As per the above regulations, the authority to issue Certificates of Security and Order by the Department of Administrative Management of Social Order, Ministry of Public Security, covers the following business establishments:
- Small-caliber military firearm businesses;- Industrial explosive materials and precursor explosive chemical businesses (excluding the transportation business of industrial explosive materials and precursor explosive chemicals);- Blasting service businesses; accommodation service businesses rated 5 stars and above;- Support tool businesses; paintball gun businesses (excluding service provision using paintball guns);- Casino businesses;- Electronic game businesses for foreigners;- Security service businesses with foreign investment and security service businesses with the function of training security service employees;- Business establishments under the Ministry of Public Security.
Authority to issue Certificates of Security and Order by the Department of Administrative Management of Social Order, Ministry of Public Security
Which Certificates of Security and Order can be issued by the Administrative Management of Social Order Division, Provincial Police?
Based on the provisions of Clause 2, Article 24 of Decree 96/2016/ND-CP (amended by Clause 6, Article 1 of Decree 56/2023/ND-CP).
Except for business establishments under the jurisdiction of the Department of Administrative Management of Social Order, the Administrative Management of Social Order Division, Provincial Police, is authorized to issue Certificates of Security and Order for the following business establishments:
- Fireworks business;- Transportation business of industrial explosive materials;- Transportation business of precursor explosive chemicals; seal production;- Businesses utilizing industrial explosive materials;- Production, purchase, and sale of military uniforms, insignia, badges, ranks, and numbers of the People's Army and People's Public Security;- Betting service businesses; printing service businesses;- Accommodation service businesses with more than 20 rooms;- Equipment causing interference and jamming of mobile communication signals businesses;- Cosmetic surgery service businesses;- Nightclub service businesses; security service businesses;- Machines and equipment (including components, spare parts, production equipment) business: Traffic speed control devices for motor vehicles on roads;- Mobile phone surveillance equipment GSM and other mobile phone surveillance devices;- Alcohol concentration testing devices.
Principles of Operation and Management of Business Industries With Security and Order Conditions
Based on the provisions of Article 5 of Decree 96/2016/ND-CP, the operation and management of business industries with security and order conditions are performed according to the following principles:
- All Vietnamese organizations and individuals, as well as foreign organizations and individuals, engaged in business industries with security and order conditions, if meeting the conditions stipulated in this Decree and complying with other relevant legal regulations, are entitled to conduct business and be issued Certificates of Eligibility for Security and Order.
- Transparency and openness in management; creating favorable conditions and ensuring a stable security and order environment for organizations and individuals to conduct effective business activities.
