Pursuant to Article 35 of Circular 1/2023/TT-BGTVT regulating as follows:

Appraisal of Invitation to Bid Dossier

The dossier and contents of the appraisal of the invitation to bid dossier shall be carried out as for the appraisal of the invitation to bid dossier for selecting investors according to the regulations at Clause 2, Article 75 of Decree No. 25/2020/ND-CP dated February 28, 2020.

Referring to Clause 2 of Article 75 of Decree 25/2020/ND-CP, the appraisal of the invitation to bid dossier is regulated as follows:

The dossier for submission and approval includes:

- The approval request for the invitation to bid dossier and the dossier requirement of the inviting party;- Draft of the invitation to bid dossier and the dossier requirement;- Copies of documents: Decision approving the plan for selecting the investor;- Other related documents.

Appraisal of Invitation to Bid Dossier

The dossier and contents of the appraisal of the invitation to bid dossier shall be carried out as for the appraisal of the invitation to bid dossier for selecting investors according to the regulations at Clause 2, Article 75 of Decree No. 25/2020/ND-CP dated February 28, 2020.

Referring to Clause 2 of Article 75 of Decree 25/2020/ND-CP

The appraisal contents include:

- Checking the documents used as the basis for preparing the invitation to bid dossier and the dossier requirement;- Checking the consistency of the invitation to bid dossier, the dossier requirement with the scale, objectives, scope of work, and project implementation time; compliance with legal regulations on bidding and other related laws;- Reviewing different opinions (if any) among organizations and individuals involved in preparing the invitation to bid dossier and the dossier requirement;- Other related contents.

The appraisal report includes:

- A summary of the project's content, legal basis for preparing the invitation to bid dossier, the dossier requirement;- Comments and opinions from the appraisal unit on the legal basis, compliance with the legal regulations on bidding and other related laws; agreeing or disagreeing opinions on the content of the draft invitation to bid dossier, the dossier requirement;- Proposals and recommendations from the appraisal unit regarding the approval of the invitation to bid dossier, the dossier requirement; measures for handling cases where the invitation to bid dossier, the dossier requirement does not comply with the regulations of the law on bidding and other related laws; measures for resolving cases where there is insufficient basis for approving the invitation to bid dossier, the dossier requirement;- Other opinions (if any).

Note: Before signing the appraisal report, the appraisal unit should organize meetings among the parties to resolve any remaining issues if necessary.

Which agency is responsible for approving the invitation to bid dossier for specialized road traffic services?

Pursuant to the regulations at Article 37 of Circular 1/2023/TT-BGTVT:

Responsibilities of the Road Management Agency

1. Organize management and prepare project dossiers according to regulations.

2. Perform tasks as authorized in Clauses 1, 3 of this Article; Clause 1 of Article 10; Clause 5 of Article 11; Clause 2 of Article 12; Article 14; Clause 2 of Article 17; Clause 2 of Article 18, Clause 5 of Article 29 of this Circular and perform the tasks of the authorized agency in signing contracts, managing operations, and exploitation with the winning investor during the contract period.

3. Approve the invitation to bid dossier, the list of investors meeting technical requirements, and the ranking list of investors.

4. Organize the selection of a qualified unit to act as the inviting party or perform some tasks of the inviting party.

5. Coordinate with the competent People's Committee in determining preliminary costs for compensation, support, resettlement (m2) for projects without site clearance as per the land law or work with the management agency that has paid the costs to determine the value (m2) for projects with complete site clearance as per Article 16 of this Circular;

6. Develop a plan to determine the minimum bid price for state budget contributions (m3) in the project’s invitation to bid dossier as per Article 17 of this Circular.

7. Coordinate with the local land management agency to present to the competent People's Committee to complete procedures for land recovery, land allocation, land lease, and other necessary procedures as per land law.

According to the above regulations, the Road Management Agency is responsible for approving the invitation to bid dossier for specialized road traffic services.

Circular 1/2023/TT-BGTVT is effective from May 1, 2023.
