What is the funding for completing the dissertation financed for the Doctor of Laws in Vietnam?

Under the provisions at Clause 2 Article 4 Circular 30/2022/TT-BTC regarding funding for onshore full-time PhD training programs:

Funding for onshore full-time programs (doctoral degree courses)

2. Funding for research and study shall include:

a) Complete dissertation; attend seminars and conferences in Vietnam, as follows:

- Medicine and Pharmacy, Physical Education, Sports and Arts: 20 million VND/learner/year;

- Sciences, engineering, technology, agriculture forestry and fisheries: 18 million VND/learner/year;

- Social sciences, economy, law; hotel, tourism and other industries: 13 million VND/learner/year;

The period of support: no more than 4 years.

b) Publish international scientific journals; attend international conferences and seminars; participate in short-term internships in foreign countries:

- The state budget shall cover 100% of the fees for declaration of the results of researches in international journals of science and technology that are prestigious on the list of database of the scientific journals of Web of Science according to the level of the notification of international journals of science and technology as a main author or corresponding author;

- The learners with the results of learning that meet the conditions under Circular No. 25/2021/TT-BGDDT shall be invited to attend international conferences, seminars or allowed to participate on short-term internships abroad. The state budget shall cover travel and subsistence allowances (no more than 01 time in the entire period of training) according to the regulations of Circular No. 102/2012/TT-BTC dated June 21, 2012 of the Ministry of Finance on the regime of working-trip allowances for state officials and employees who travel abroad on short working missions funded by the state budget. In case, the learners are supported funding for participation in international seminars, conferences or short-term internships by other organizations, the state budget will not support these expenses.

The higher education institutions that appoint lecturers to study shall be responsible for creation of standards, criteria and regulations on support for learners who meet the conditions to receive support according to the above contents and publicly notification before implementation according to regulations of Circular No. 25/2021/TT-BGDDT of the Ministry of Education and Training and this Circular.

In addition to support from the state budget, the higher education institutions that appoint lecturers to study shall mobilize other legal contributions to support funding for learning and research according to internal expenditure regulations of units.

Thus, PhD learners majoring in Law at domestic higher education institutions are supported with study and research expenses including:

- Funding for completing dissertation; attending seminars and conferences in Vietnam for the Law major: 13 million VND/learner/year.

- In case learners publish international scientific journals; attend international conferences and seminars; and participate in short-term internships in foreign countries, they will be supported with the following expenses:

+ The state budget shall cover 100% of the fees for declaration of the results of researches in international journals of science and technology that are prestigious on the list of database of the scientific journals of Web of Science according to the level of the notification of international journals of science and technology as a main author or corresponding author;

+ The learners shall be invited to attend international conferences, seminars or allowed to participate on short-term internships abroad and will have travel and subsistence expenses covered by the state budget.

Note: In case, the learners are supported funding for participation in international seminars, conferences or short-term internships by other organizations, the state budget will not support these expenses.

What is the funding for learners sent to offshore full-time training programs in Vietnam?

Under Article 3 Circular 30/2022/TT-BTC, learners sent to offshore full-time master's and PhD training programs in Vietnam will be covered the following expenses:

- Tuition fees and expenses regarding tuition fees: Make payment according to the contract signed between the Ministry of Education and Training of Vietnam and the overseas training institution or according to notification of the overseas training institution in admission notice (US dollar or the currency of the host country). The maximum fee shall be $25.000/learner/school year or equivalent to the currency of the host country. The amount in excess of $25.000/learner/year shall be paid by the learner or the higher education institution that appoints the lecturers to study courses according to internal expenditure regulations of unit.

In special cases, if it is necessary to attract and develop the source of lecturers from excellent graduates and young scientists who meet the conditions as prescribed in the Government’s Decree No. 140/2017/ND-CP dated December 5, 2017 on the policy on attraction and development of sources of officials from excellent graduates and young scientists, the Minister of Education and Training shall consider, make decisions on a case-by-case basis and make payment according to the tuition fees prescribed by the training institution and within the scope of assigned estimates.

- Passport and visa fees: Make payment according to regulations of the State of Vietnam on passport fees and actual invoices for visa fees of the countries where the learners are sent to.

- Subsistence allowances:

+ Subsistence allowances for learners shall comply with regulations in the Appendix of this Circular. Subsistence allowances shall be granted according to the actual period of study (from the date of admission to the date of completion of the course without exceeding the time stated in the decision on appointment to training courses of the Minister of Education and Training of Vietnam);

+ The payment of subsistence allowances shall be made every three months or every six months in order to ensure that it does not influence the learners' study and research.

- Compulsory health insurance:

+ Compulsory health insurance: Make payment according to regulations of the host country (admission notice of the overseas training institution). It shall be paid in US dollar or the currency of the host country and at most $1.000/learner/school year;

+ The amount of excess of $1.000/learner/school year shall be paid by the learner.

- Round trip flight ticket (Economy class):

+ Provide round trip flight tickets for the learners (from Vietnam to the place of study and vice versa) in the entire period of training, unless the flight ticket is paid by the other/foreign party;

+ Make payment according to applicable regulations on regimes and norms of state budget expenditure.

- Travel allowances that reimburse airport charges and fees for rental of vehicles from the airport to accommodation and vice versa shall be granted once with fixed funding of $100/person for the entire period of training.

- Other expenses incurred in the process of training:

+ Expenses for transfer and receipt of money through banks regarding overseas training courses (if any): according to the regulations of the banks in the host country and in Vietnam, if there is any expense incurred for transfer or receipt of money through the banks, the state budget shall cover this expense according to the actual expense incurred;

+ Expenses for support for handling of risks and force majeure events that happen to learners who are sent to training courses: In case of death, the state budget shall cover the full fees for transportation of corpses or ashes of learners from foreign countries to Vietnam or cover the part of freight that is not covered by insurance;

+ In case the actual time of training is longer than the time stated in the decision on appointment for lecturers to attend training courses of the Minister of Education and Training (force majeure causes including: war, natural disaster, epidemic) and the learners still ensure their results of learning and are certified by the overseas training institution, the learners shall only be entitled to funding for regimes and policies in the prolonged time when there is an additional decision of the Minister of Education and Training with the total time that does not exceed the time prescribed for completion of the training program in Clause 4 Article 4 Circular 25/2021/TT-BGDDT.

Shall the studying cost of a Master of Laws sent to training programs be covered by the State budget?

According to the provisions of Article 1 Circular 30/2022/TT-BTC, the regulated entities are lecturers, managers at higher education institutions who meet the recruitment criteria in Circular 25/2021/TT-BGDDT.

In Article 5 Circular 25/2021/TT-BGDDT, the provisions are as follows:

Qualified candidates and recruitment standards

1. Full-time tenured and tenure-eligible faculty members may register for recruitment of candidates for grants, stipends or support packages provided by the Project if they meet the following requirements:

a) They are Vietnamese citizens, under 40 years old in the year of registration for recruitment; have political credentials and are of good moral character; are in good health to study; are not facing disciplinary action in the form of warning or more severe sanction; are not subject to border entry or exit bans imposed under legislation when registering for recruitment of candidates for offshore full-time courses;

b) They are registering for recruitment of candidates for any doctoral or master degree course, or are taking doctoral degree programs, for the first time;

c) They are full-time tenured faculty members who meet enrolment requirements of training programs, are included in formal admission plans in the registration or subsequent year; if they are tenure-eligible or full-time tenured faculty members who are taking doctoral degree programs, their remaining duration of study or research must be at least 18 months until the date of participation in the recruitment process;

d) They have not yet received or been committed to receiving full-ride scholarships from the state budget or other funding sources to pay for their study or research at the registered levels until the date of being recruited as candidates for the Project’s funding.

2. Candidates eligible for the Project's funding for master degree courses must be full-time tenured faculty teaching majors in arts fields or the range of sport or physical activity disciplines at sending institutions specialized in providing cultural, arts, sport and physical education programs.

Additionally, Article 3 Circular 25/2021/TT-BGDDT stipulates that doctoral training applies to all fields, prioritizing fields identified for intensive training in the high-level manpower development strategy of Vietnam at each time up to 2030 and in the subsequent phases.

However, master’s degree training applies to fields in the arts and physical education and sports groups.

Thus, learners majoring in Law at the master's level are not eligible for study expense support from the state budget.
