What is the significance of Tet Han Thuc? What activities do Vietnamese people engage in on Tet Han Thuc?

Tet Han Thuc is a festival that takes place annually on the 3rd day of the third lunar month.

According to Han characters, “han” means cold, and “thuc” means food, so “Tet Han Thuc” translates to the festival of eating cold food. This traditional custom originates from a story in China.

Significance of Tet Han Thuc:

Tet Han Thuc for Vietnamese people mainly bears the meaning of remembering the origin, honoring the merits of the deceased.

In the traditional customs of Vietnamese people, on Tet Han Thuc, families usually have the annual activity of preparing floating rice cakes and glutinous rice cake to worship Buddha and the ancestors.

Tet Han Thuc 2024 falls on April 11 (Thursday)

Currently, due to the similarity in honoring ancestors between Tet Han Thuc and Qingming Festival (Tet Thanh Minh), some people often confuse these two festivals. However, they have completely different meanings.

On Tet Han Thuc, families prepare offerings to their ancestors and Buddha to express sincerity and gratitude, gather together to eat floating rice cakes, and pray for good luck for the family.

Qingming Festival is an occasion for descendants to visit, clean, and repair the graves of their ancestors to show respect and remembrance for the deceased.

Moreover, Tet Han Thuc takes place on the 3rd day of the third lunar month every year, whereas Qingming Festival does not have a fixed date each year but falls on one day within the third lunar month.

Are employees entitled to fully paid days off on Tet Han Thuc in Vietnam in 2024?

According to Article 112 of the Labor Code 2019, which stipulates holidays and Tet holidays during which employees are entitled to fully paid days off, as follows:

Holidays and Tet

1. Employees are entitled to fully paid days off on the following holidays and Tet:

a) New Year's Day: 01 day (January 01 of the Gregorian calendar);

b) Lunar New Year: 05 days;

c) Victory Day: 01 day (April 30 of the Gregorian calendar);

d) International Labor Day: 01 day (May 01 of the Gregorian calendar);

dd) National Day: 02 days (September 02 of the Gregorian calendar and 01 adjacent day before or after);

e) Hung Kings' Commemoration Day: 01 day (March 10 of the lunar calendar).

2. Foreign employees in Vietnam, besides the holidays specified in Clause 1 of this Article, are entitled to one traditional holiday day of their country and one National Day of their country.

3. Annually, based on actual conditions, the Prime Minister of the Government of Vietnam will decide the specific day off specified at point b and point đ Clause 1 of this Article.

Thus, Tet Han Thuc in 2024 is not one of the holidays on which employees are entitled to leave work according to the regulation. Therefore, employees will not receive paid leave on Tet Han Thuc, and those who have work schedules will still have to work as usual.

However, if Tet Han Thuc in 2024 coincides with the weekly day off of the employees, then the employees will get a day off.

Moreover, employees can also actively request leave through annual leave or unpaid leave on Tet Han Thuc.

What is the penalty for selling floating rice cakes with unauthorized additives in Vietnam?

According to Clause 6, Article 22 of Decree 115/2018/ND-CP (amended by point đ, Clause 12, Article 1 of Decree 124/2021/ND-CP) stipulates as follows:

Violations of other regulations on food safety in production, business, import, and provision of food

...

6. A fine of VND 40,000,000 to VND 50,000,000 shall be imposed for one of the following acts:

a) Importing, producing, processing, providing, or selling food that causes food poisoning affecting the health of 01 to 04 people without reaching the threshold for criminal prosecution;

b) Importing, supplying, or selling food using substances, chemicals, food additives, or food processing aids that are prohibited for use or not on the permitted list valued under VND 10,000,000 or unlawfully earning under VND 5,000,000;

c) Importing, supplying, or selling food using substances, chemicals, food additives, or food processing aids that are not permitted for use or not authorized for circulation in Vietnam valued under VND 50,000,000 or unlawfully earning under VND 20,000,000.

Thus, selling floating rice cakes with unauthorized additives inside, valued under VND 50,000,000 or unlawfully earning under VND 20,000,000, will be subject to administrative penalties ranging from VND 40,000,000 to VND 50,000,000.

Simultaneously, the right to use the Certificate of Product Declaration Registration will be revoked for 12 months to 16 months for products requiring product declaration registration that violate the regulations (according to Clause 10, Article 22 of Decree 115/2018/ND-CP).

On the other hand, remedial actions include: forcing the recall and destruction of floating rice cakes containing unauthorized additives.

Forcing the withdrawal of the self-declaration of products for products subject to self-declaration that violate the regulations.

Note: The above administrative fines are for individuals, and the fines for organizations are double. (according to Clause 2, Article 3 of Decree 115/2018/ND-CP, amended by point b Clause 2, Article 1 of Decree 124/2021/ND-CP)
