Supplements to regulations on members to the provincial terrorism prevention and control steering committees in Vietnam from October 5, 2023?

On August 18, 2023, the Government of Vietnam issued Decree 62/2023/ND-CP amending and supplementing several articles of Decree 07/2014/ND-CP.

In Clause 1, Article 1 of Decree 62/2023/ND-CP, the following amendments are made to Article 5 of Decree 07/2014/ND-CP:

Provincial, Municipal Anti-Terrorism Steering Committee
1. The Provincial, Municipal Anti-Terrorism Steering Committee is an advisory body assisting the Provincial People's Committee, the Chairman of the Provincial People's Committee, and the City's People's Committee in organizing and directing anti-terrorism activities.

The Provincial Public Security, Municipal Public Security is the standing advisory body of the Provincial, Municipal Anti-Terrorism Steering Committee, and has an advisory unit called the Standing Office of the Provincial, Municipal Anti-Terrorism Steering Committee.

2. The composition of the Provincial, Municipal Anti-Terrorism Steering Committee includes:

a) Chairman of the Provincial People's Committee, Head of the Committee;

b) Director of the Provincial Public Security, Municipal Public Security, Standing Deputy Head;

c) Commander of Hanoi Capital Command (for Hanoi Anti-Terrorism Steering Committee), Commander of Ho Chi Minh City Command (for Ho Chi Minh City Anti-Terrorism Steering Committee), Commander of the Provincial Military Command (for other provincial terrorism prevention and control steering committees); Deputy Head;

d) Deputy Director of the Provincial Public Security, Municipal Public Security in charge of security, Standing Member;

dd) Commander of the Border Guard Command (if any), Member;

e) Director of the Department of Foreign Affairs (if any), Member;

g) Director of the Department of Transport, Member;

h) Director of the Department of Information and Communications, Member;

i) Director of the Department of Health, Member;

k) Director of the Department of Finance, Member;

l) Director of the Department of Industry and Trade, Member;

m) Director of the Department of Agriculture and Rural Development, Member;

n) Director of the Department of Science and Technology, Member;

o) Director of the State Bank of Vietnam Branch in the Province, Municipality, Member;

p) Head of the Airport Authority representative (if any), Member;

q) Director of the Airport (if any), Member;

r) Chief of Air Traffic Control Station (if any), Member;

s) Chairman of the District People's Committee where there are airports, civil aviation facilities, equipment, Member;

t) Other members as proposed by the Head of the Steering Committee.

The composition of the provincial terrorism prevention and control steering committees in Article 5, Decree 07/2014/ND-CP, includes:

- Chairman of the Provincial People's Committee, Municipality, Head of the Committee;

- Director of the Provincial Public Security, Municipal Public Security, Deputy Head of the Committee;

- Director of the Department of Foreign Affairs (if any), Member;

- Director of the Department of Transport, Member;

- Director of the Department of Information and Communications, Member;

- Director of the Department of Health, Member;

- Director of the Department of Finance, Member;

- Deputy Director of the Provincial Public Security, Municipal Public Security in charge of security, Standing Member;

- Commander of Hanoi Capital Command (for Hanoi Anti-Terrorism Steering Committee), Commander of Ho Chi Minh City Command (for Ho Chi Minh City Anti-Terrorism Steering Committee), Commander of the Provincial Military Command (for other provincial terrorism prevention and control steering committees), Member.

Accordingly, Clause 1, Article 1 of Decree 62/2023/ND-CP has added the following positions to the composition of the provincial terrorism prevention and control steering committees:

- Commander of the Border Guard Command (if any)

- Director of the Department of Industry and Trade- Director of the Department of Agriculture and Rural Development

- Director of the Department of Science and Technology

- Director of the State Bank of Vietnam Branch in the Province, Municipality

- Head of the Airport Authority representative (if any)- Director of the Airport (if any)

- Chief of Air Traffic Control Station (if any)

- Chairman of the District People's Committee where there are airports, civil aviation facilities, equipment

Additionally, the positions of Commander of Hanoi Capital Command (for Hanoi Anti-Terrorism Steering Committee), Commander of Ho Chi Minh City Command (for Ho Chi Minh City Anti-Terrorism Steering Committee), Commander of the Provincial Military Command (for other provincial terrorism prevention and control steering committees) have been changed from members to deputy heads.

What are the tasks and powers of the provincial terrorism prevention and control steering committees in Vietnam?

According to Article 10 of Decree 07/2014/ND-CP amended by Clause 3, Article 1 of Decree 62/2023/ND-CP, the tasks and powers of the provincial terrorism prevention and control steering committees are as follows:

- Implement the tasks and powers stipulated in Clause 2, Article 13 of the Anti-Terrorism Law 2013

- Advise the People's Committee, the Chairman of the Provincial People's Committee, and the City's People's Committee on directing the handling of terrorism cases occurring in the locality, except for terrorism cases under the advisory and directive responsibility of the National Anti-Terrorism Steering Committee, the Ministry of Public Security Anti-Terrorism Steering Committee, and the Ministry of National Defense Anti-Terrorism Steering Committee.

- Advise and assist the People's Committee, the Chairman of the Provincial People's Committee, and the City's People's Committee in organizing and directing activities to prevent the proliferation of weapons of mass destruction as stipulated in Decree 81/2019/ND-CP dated November 11, 2019, of the Government of Vietnam on preventing the proliferation of weapons of mass destruction.

- Assist the People's Committee, the Chairman of the Provincial People's Committee, and the City's People's Committee in performing the command tasks, responding to unlawful interference in civil aviation activities where there are airports, and civil aviation facilities and equipment as prescribed in Decree 92/2015/ND-CP dated October 13, 2015, of the Government of Vietnam on aviation security.

- Perform other tasks and powers assigned by the People's Committee, the Chairman of the Provincial People's Committee, and the City's People's Committee.

What are the operating policies of the Anti-Terrorism Steering Committee in Vietnam?

According to Article 11 of Decree 07/2014/ND-CP, supplemented by Clause 4, Article 1 of Decree 62/2023/ND-CP, the operating policies of the Anti-Terrorism Steering Committees are as follows:

- The Anti-Terrorism Steering Committee operates on the principle of centralized unity; decides on issues within its authority through regular or extraordinary meetings or through written opinions. The Head of the Steering Committee concludes and is responsible for his decisions. The Anti-Terrorism Steering Committee is responsible for issuing and implementing its operating regulations.

- Members of the Anti-Terrorism Steering Committees at all levels work concurrently according to the operating regulations of the Steering Committee and use the seal of the office where they work. In the absence or authorization of the Head of the Steering Committee, the Deputy Head performs the duties and powers of the Head and is responsible before the law for their decisions.

- The Minister of Public Security is authorized to establish and prescribe the functions, tasks, and organizational structures of the Standing Office of the National Anti-Terrorism Steering Committee, and the Standing Office of the provincial terrorism prevention and control steering committees; the Minister and the Head of equivalent agencies prescribe the functions, tasks, and organization of the advisory units assisting the Anti-Terrorism Steering Committee of their Ministries and sectors.

* Note: Decree 62/2023/ND-CP takes effect from October 5, 2023.
