On August 25, 2023, the Ministry of Public Security issued Circular 41/2023/TT-BCA stipulating the implementation of subsidy policies for officers and soldiers of the People's Police who participated in the anti-American resistance with less than 20 years of service in the People's Police and have been discharged or demobilized to their localities.

Based on Article 2 of Circular 41/2023/TT-BCA which stipulates the subjects eligible for subsidy policies:

Subjects of application

1. This Circular applies to:

a) Officers and soldiers specified in Article 2 and Clause 1, Article 8 of Decision No. 53/2010/QD-TTg dated August 20, 2010, of the Prime Minister of the Government of Vietnam, stipulating policies for officers and soldiers who participated in the anti-American resistance with less than 20 years of service in the People's Police and have been discharged or demobilized to their localities (hereinafter referred to as Decision No. 53/2010/QD-TTg).

b) Units under the Ministry of Public Security, provincial and city police under the Central Government (hereinafter referred to as police units and localities).

c) Agencies, organizations, and individuals involved in implementing policies for officers and soldiers as stipulated in this Circular.

2. This Circular does not apply to:

a) Cases specified in Article 3 of Decision No. 53/2010/QD-TTg.

b) Officers and soldiers who have been disciplined and dismissed, discharged, demobilized, expelled, deserted, or stripped of their titles or ranks.

c) Police workers (civil servants of the police).

- Officers and soldiers of the People's Police who participated in the anti-American resistance, joined the People's Police on or before April 30, 1975, have less than 20 years of service in the People's Police, have been discharged or demobilized to their localities, and are currently not receiving a pension, disability policies, or monthly sick leave policies.

- Officers and soldiers of the People's Police who participated in the anti-American resistance, joined the People's Police on or before April 30, 1975, have less than 20 years of service in the People's Police, have been discharged or demobilized to their localities, and subsequently work in communes, wards, and commune-level towns.

- Officers and soldiers of the People's Police who have been demobilized and discharged to their localities with a period of service in the People's Army on or before April 30, 1975.

1. Officers and soldiers mentioned in Point a, Clause 1, Article 2 of this Circular who fall into one of the following cases are eligible for monthly subsidy policies:

a) Having a working period eligible for subsidy calculation from 15 years to less than 20 years;

b) Having a working period eligible for subsidy calculation from 15 years to less than 20 years, have been discharged or demobilized to their localities, and subsequently work in communes, wards, and commune-level towns receiving salary from the state budget, participating in mandatory social insurance but are not eligible or continue to pay voluntary social insurance to be eligible for a monthly pension according to social insurance laws.

Thus, People's Police participating in the anti-American resistance are eligible for monthly subsidy policies in the following cases:

- People's Police participating in the anti-American resistance with a working period eligible for subsidy calculation from 15 years to less than 20 years;

- People's Police participating in the anti-American resistance with a working period eligible for subsidy calculation from 15 years to less than 20 years, have been discharged or demobilized to their localities, and subsequently work in communes, wards, and commune-level towns receiving salary from the state budget, participating in mandatory social insurance but are not eligible or continue to pay voluntary social insurance to be eligible for a monthly pension according to social insurance laws.
