What are the amendments to load capacities of road vehicles running on public roads in Vietnam under the Circular 35/2023/TT-BGTVT?
On December 13, 2023, the Minister of Transport issued Circular 35/2023/TT-BGTVT amending and supplementing some articles of Circular 46/2015/TT-BGTVT regarding the load capacity and size limits of roads; the operation of overloaded vehicles, oversized vehicles, and tracked vehicles on roads; and the transportation of oversized and overweight goods on road vehicles when participating in road traffic.
According to Circular 35/2023/TT-BGTVT, the amendments and supplements to Circular 46/2015/TT-BGTVT regarding load capacities of roads are as follows:
(1) Amendments and supplements to certain articles of Circular 46/2015/TT-BGTVT and Circular 06/2023/TT-BGTVT:
- Amendment and supplementation of Clause 1 of Article 3 and supplementation of Clauses 10, 11, and 12 to Article 3;
- Amendment and supplementation of Clauses 2 and 3 of Article 4;
- Amendment and supplementation of Clauses 2 and 3 of Article 5;
- Amendment and supplementation of Article 6 (already amended and supplemented in Clause 1 of Article 10 of Circular 06/2023/TT-BGTVT);
- Amendment and supplementation of Article 7 (already amended and supplemented in Clause 2 of Article 10 of Circular 06/2023/TT-BGTVT);
- Amendment and supplementation of Clause 3 of Article 8;
- Amendment and supplementation of Article 9;
- Amendment and supplementation of certain points and clauses of Article 11;
- Amendment and supplementation of certain points and clauses of Article 14;
- Amendment and supplementation of Clause 1, Point a of Clause 2, Clauses 3, Point a, and Point b of Clause 4 of Article 20;
- Amendment and supplementation of Clause 1, Point d of Clause 2, Clauses 3, and Clause 4 of Article 21;
- Amendment and supplementation of Article 22 (already amended and supplemented in Clause 3 of Article 10 of Circular 06/2023/TT-BGTVT).
(2) Amendments and supplements to certain phrases, appendices issued with Circular 46/2015/TT-BGTVT:
- Replace the phrase "having one of the outer dimensions" with the phrase "having at least one of the outer dimensions" in the title of Clause 1 of Article 12;
- Replace the phrase "Special-use vehicles and container-carrying vehicles" with the phrase "Container-carrying vehicles" in Clause 3 of Article 18;
- Replace Appendix 1, Appendix 2, Appendix 3, Appendix 4, Appendix 5A, Appendix 5B, Appendix 5C, and Appendix 6 issued with Circular 46/2015/TT-BGTVT with Appendix I, Appendix II, Appendix III, Appendix IV, Appendix V, Appendix VI, Appendix VII, and Appendix VIII issued with Circular 35/2023/TT-BGTVT;
- Supplement Appendix 7 to Circular 46/2015/TT-BGTVT with Appendix IX issued with Circular 35/2023/TT-BGTVT.

Vietnam: What is the total weight of a vehicle?
Based on the new regulations at Point a, Clause 1, Article 1 of Circular 35/2023/TT-BGTVT amending and supplementing Clause 1 of Article 3 of Circular 46/2015/TT-BGTVT, it stipulates that the total weight of a vehicle includes the weight of the vehicle itself plus the weight of specialized equipment used to support the transportation of oversized and overweight goods, which is installed on the vehicle according to the manufacturer's instructions (if any), plus the weight of the passengers, luggage, and cargo (including containers; devices used to stack, secure, and tie down goods) loaded on the vehicle (if any).
Currently, Clause 1 of Article 3 of Circular 46/2015/TT-BGTVT stipulates that the total weight of the vehicle includes the weight of the vehicle itself plus the weight of the passengers, luggage, and cargo loaded on the vehicle (if any).
Therefore, it can be seen that according to the new regulations, the total weight of the vehicle will include the weight of specialized equipment used to support the transportation of oversized and overweight goods, which is installed on the vehicle according to the manufacturer's instructions (if any), and the weight of devices used to stack, secure, and tie down goods) loaded on the vehicle (if any).
What are the regulations on bearing capacity of bridges in Vietnam?
Based on the new regulations at Point a, Clause 2, Article 1 of Circular 35/2023/TT-BGTVT amending and supplementing Clause 2 of Article 4 of Circular 46/2015/TT-BGTVT, it stipulates that the bearing capacity of bridges is determined based on the bridge design documents and the actual technical condition of the bridge, which are either announced by the competent authority or indicated by one of the road signs as follows:
- Road sign "Restriction on total vehicle load";
- Road sign "Restricted vehicle types crossing the bridge";
- Road sign "Restricted axle load crossing the bridge".
Currently, Clause 2 of Article 4 of Circular 46/2015/TT-BGTVT stipulates that the bearing capacity of bridges is determined based on the bridge design documents and the actual technical condition of the bridge, which are either announced by the competent authority or indicated by a road sign restricting the total weight of vehicles crossing the bridge according to the regulations on road signs.
Therefore, it can be seen that according to the new regulations, the bearing capacity of bridges is determined by the competent authority or specifically indicated by one of the road signs as follows:
- Road sign "Restriction on total vehicle load";
- Road sign "Restricted vehicle types crossing the bridge";
- Road sign "Restricted axle load crossing the bridge".
Circular 35/2023/TT-BGTVT comes into force from February 1, 2024.
