Can excellent graduates apply for state positions through selection?
Will outstanding graduates apply for state official positions through competitive exams or review exams? What are the recruitment principles?
Based on the provisions stipulated in Article 37 of the Law on Officers and Public Officials 2008, as amended by Clause 5, Article 1 of the Law on Officers, Public Officials and the Amended Law on Public Employees 2019.
Currently, the recruitment of state officials is carried out through the following methods:
- Competitive exams;
- Review exams;
- Direct acceptance decided by the head of the agency managing officials for certain cases if they meet the standards and conditions of the job position.
According to Decree 138/2020/ND-CP, which provides regulations on the recruitment, use, and management of officials, issued by the Government of Vietnam. Article 10 of Decree 138/2020/ND-CP stipulates the criteria for the selection of officials as follows:
Criteria for the selection of officials
1. The recruitment of officials through review exams is decided by the authoritative agency, and separate reviews are conducted for each of the following groups:
a) Individuals committed to voluntarily working for more than 5 years in areas with particularly difficult socio-economic conditions;
b) Individuals studying under the policies of the assignment plan according to the provisions of the Education Law, returning to work at the locality where they were sent to study after graduation;
c) Outstanding graduates, talented young scientists.
2. Recruitment for the group stipulated in point c, clause 1 of this Article shall be carried out according to the regulations of the Government of Vietnam concerning policies on attracting and creating a pool of officials from outstanding graduates and young scientists.
Accordingly, as per the cited regulations above, outstanding graduates will apply for official positions through the review exam method.

At the same time, based on Article 38 of the Law on Officers and Public Officials 2008 as follows:
Principles of recruiting officials
1. Ensure transparency, objectivity, and compliance with the law.
2. Ensure competition.
3. Select the right individuals who meet the job and position requirements.
4. Prioritize recruiting talented individuals, individuals with contributions to the country, and ethnic minorities.
Thus, the recruitment of officials for outstanding graduates must adhere to the four recruitment principles mentioned above. Talented individuals are among the prioritized groups for recruitment.

How many rounds of review exams for officials are there according to current regulations?
Based on the content and form of the review exams for officials as stipulated in Article 11 of Decree 138/2020/ND-CP as follows:
Content and form of the review exams for officials
The review exams for officials are conducted in 2 rounds as follows:
1. Round 1
Checking the conditions of the application form for the recruitment exam according to the job position requirements. If the candidate meets the requirements, they will proceed to round 2.
2. Round 2
a) Interview to check the knowledge and skills of the candidate required for the job position;
b) Interview duration: 30 minutes (the candidate has no more than 15 minutes to prepare before the interview);
c) Scoring scale: 100 points.
Thus, the review exams for state officials are currently conducted in two rounds:
- Round 1: Checking the conditions of the application
- Round 2: Interview
Is it possible to retain the results of the review exam for officials in case of not being selected?
Based on the provisions of Article 12 of Decree 138/2020/ND-CP regarding the identification of successful candidates in the review exam for officials as follows:
Identifying successful candidates in the review exam for officials
1. A candidate is considered successful in the review exam for officials if they meet the following conditions:
a) Scoring 50 points or more in round 2;
b) The total score from round 2 plus any priority points stipulated in Article 5 of this Decree (if any), from highest to lowest within the scope of the recruitment quota for each job position.
2. In cases where two or more candidates have the same total score in the last quota of the job position, the candidate with the higher score in round 2 will be selected. If still undetermined, the head of the authoritative recruiting agency will decide the successful candidate.
3. Candidates who are not successful in the review exam for officials are not allowed to retain the results for subsequent review exams.
Thus, based on Clause 3, Article 12 of Decree 138/2020/ND-CP cited above, if a candidate is not successful in the review exam for officials, they are not allowed to retain the results for subsequent review exams.
