Based on point a, clause 4, Article 4 of the Law on military service 2015, amended by point a, clause 1, Article 49 of the Law on Militia and Self-defense Forces 2019, the regulations are as follows:

Military service

4. Citizens falling under the following categories are recognized as having completed military service during peacetime:

a) Permanent militia and self-defense forces members serving for at least 24 months are recognized as having completed military service during peacetime. This recognition is decided by the Commander of the district-level Military Command based on the recommendation of the Chairman of the commune-level People's Committee or the village head where there is no commune-level administrative unit, the head of agencies, and organizations;

b) Completion of at least 36 months of continuous service in the commune police force;

c) officials and public employees, university graduates and above, who have been trained and commissioned as reserve officers;

d) Young people who have graduated from university, college, or intermediate level and voluntarily served in the economic-defense corps for at least 24 months according to a Scheme decided by the Prime Minister of Vietnam;

dd) Citizens serving on the fisheries inspection vessels for at least 24 months.

Thus, based on the above regulations, if a citizen has served as a permanent militia and self-defense forces member for at least 24 months, they are recognized as having completed military service during peacetime and do not have to perform military service anymore.

*Note: The authority to recognize the completion of military service belongs to the Commander of the district-level Military Command based on the recommendation of the Chairman of the commune-level People's Committee or the village head where there is no commune-level administrative unit, the head of agencies, and organizations.

When does the pre-enlistment medical check-up take place in Vietnam in 2024?

Based on the regulations in Article 40 of the Law on military service 2015, the schedule for the 2023 military service medical examination is as follows:

Medical examination for citizens enlisted for military service and police service

1. The Chairman of the district-level People's Committee decides to establish the Health Examination Council at the proposal of the district-level health department.

2. The Commander of the district-level Military Command issues the call for medical examination for citizens eligible for military enlistment; the Head of the district-level police issues the call for medical examination for citizens eligible for police service. The call for the medical examination must be delivered to the citizens at least 15 days before the examination date.

3. The district-level Health Examination Council organizes the medical examination for citizens eligible for military enlistment and police service enlistment; if necessary, it can decide on clinical tests, including tests for drugs and HIV; ensuring accuracy and bearing responsibility for the results of the military service medical examination.

4. The medical examination period is from November 1 to December 31 annually. The time for the second examination for citizens enlisted for military service and police service as stipulated in Article 33 of this Law is decided by the Prime Minister of Vietnam.

5. The classification results of the health examination must be publicly posted at the office of the commune-level People’s Committee, agencies, and organizations within 20 days.

Thus, based on the above regulations, the military service medical examination period will run from November 1 to December 31 annually.

The medical examination period for the 2024 enlistment is from November 01, 2023, to December 31, 2023.

Citizens need to pay attention to receiving their military service medical examination notice and perform the medical examination according to the time stated on the notice.

Who has to perform military service in Vietnam in 2024?

Based on clauses 1 and 2 of Article 4 of the Law on military service 2015, the regulations on military service are as follows:

Moreover, based on the regulations in Article 6 of the Law on military service 2015, the implementation of military service by citizens is regulated as follows:

Obligation to serve on active duty

1. Male citizens of eligible age have an obligation to serve on active duty in the People's Army.

2. Female citizens of eligible age during peacetime, if volunteering and the army has a demand, may serve on active duty.

Thus, based on the aforementioned regulations, male citizens must perform military service within the prescribed age range. In other words, this is a compulsory duty for male citizens.

For female citizens, the Law on military service 2015 expands the regulations, allowing eligible-aged female citizens, if volunteering and the army has a demand, to enlist. This provision does not make it compulsory for female citizens within the eligible age to enlist. Female citizens in peactime may enlist voluntarily and are accepted by the state.

- The current age range for enlistment is regulated in clause 1, Article 4 of Circular 148/2018/TT-BQP as follows:

+ Citizens aged 18 to 25 years.

+ Male citizens who have been trained at college or university level and had their enlistment deferred during their study period will be eligible for enlistment up to 27 years old.
