The National Assembly has voted to pass a Resolution on the 2024 state budget estimate on the morning of November 10. The Resolution stipulates that from July 1, 2024, a comprehensive salary policy reform will be implemented as per Resolution 27-NQ/TW of 2018.

According to Resolution 27-NQ/TW of 2018, the following content is unified regarding the construction of new salary scales upon implementing the 2024 salary reform:

Abolish the statutory pay rate and the current salary coefficient, construct a basic salary with specific monetary amounts in the new salary scales.

Construct and issue a system of 5 new salary scales based on job positions, titles, and leadership positions to replace the current salary scales; transition old salary to new salary while ensuring it is not lower than the current salary received, including:

Salary Scale 1:

The position-based salary scale applies to officials and public employees holding leadership positions (elected and appointed) within the political system from the central to the commune level.

Salary Scale 2:

The professional and operational salary scale based on the rank of officials and occupational titles of public employees applies to officials and public employees who do not hold leadership positions.

Salary Scale 3:

A salary scale for military officers, police officers, non-commissioned officers, and operational non-commissioned officers (based on positions, titles, and military ranks).

Salary Scale 4:

A salary scale for professional soldiers and technical police officers.

Salary Scale 5:

A salary scale for national defense workers and police workers.

(In which the wage correlation of armed forces compared to administrative officials is maintained as at present).

Pursuant to Article 7 of Decree 06/2010/ND-CP, which stipulates officials in the court system, as follows:

- Deputy Chief Justice of the Supreme People's Court; Chief Justices, Deputy Chief Justices of the courts and specialized courts; Judges of the Supreme People's Court; court clerks; staff working in the offices, departments, divisions, and specialized courts under the Supreme People's Court;

- Chief Justices, Deputy Chief Justices of provincial-level People's Courts; Chief Justices, Deputy Chief Justices of specialized courts, Appellate Judges of provincial-level People's Courts; court clerks; staff working in the offices, departments, divisions, and specialized courts under the provincial-level People's Courts;

- Chief Justices, Deputy Chief Justices of district-level People's Courts; Judges of district-level People's Courts; court clerks; staff working in the district-level People's Courts.

Thus, according to the above provisions, Judges of People's Courts at all levels are officials.

The 2 new salary scales applied to Judges are:

- The position-based salary scale applies to officials and public employees holding leadership positions (elected and appointed) within the political system from the central to the commune level.

- The professional and operational salary scale based on the rank of officials and occupational titles of public employees applies to officials and public employees who do not hold leadership positions.

What are the principles for constructing the 2 new salary scales for Judges from July 1, 2024?

Following the spirit of Resolution 27-NQ/TW of 2018 after the 2024 salary reform, the current salary scales for Judges according to the salary coefficient will no longer be applied. Instead, two new salary scales will be constructed and applied based on the following principles:

- The position-based salary scale applies to officials and public employees holding leadership positions (elected and appointed) within the political system from the central to the commune level, based on the following principles:

| Principle 1: The position salary must reflect the hierarchy within the political system; a leadership position warrants a corresponding salary for that position, if one person holds multiple positions, they receive the highest position salary; equivalent leadership positions receive equivalent salaries; the position salary of a higher-level leader must be higher than the position salary of a lower-level leader.

Principle 2: Prescribe a position salary for each type of equivalent position; do not classify ministries and central authorities, committees, and equivalents at the central level when constructing central position salary scales; do not differentiate position salaries for the same leadership role according to administrative unit classifications at the local level but implement through allowance policies.

Principle 3: The classification of equivalent leadership positions within the political system for designing the position salary scale is determined by the Politburo after reporting to the Central Committee. || --- |

- The professional and operational salary scale based on the rank of officials and occupational titles of public employees applies to officials and public employees who do not hold leadership positions, constructed according to the following principles:

| Principle 1: Equal complexity of work warrants equal salary; higher-than-normal working conditions and professional preferences are implemented through professional allowance policies; reorganize rank groups and the number of steps within the ranks of officials and occupational titles of public employees, encouraging officials and public employees to enhance their professional qualifications.

Principle 2: Appointment to the rank of officials or occupational titles of public employees must be linked to job positions and the rank structure managed by the agencies, organizations, or units managing officials and public employees. || --- |

Pursuant to Article 67 of the Law on Organization of the People's Courts 2014, the standards for Judges are specified as follows:

- Be a Vietnamese citizen, loyal to the Fatherland and the Constitution of the Socialist Republic of Vietnam, with good ethical qualities, strong political will, courage and determination to protect justice, integrity, and honesty.

- Have a bachelor’s degree in law or higher.

- Be trained in adjudication expertise.

- Have practical experience in law.

- Have good health to ensure the execution of assigned tasks.
