To annul Category -A1, -B1, -B2 Driving licenses from July 1, 2024 as proposed by the Ministry of Public Security of Vietnam?

According to the Draft Law on Ensuring Road Traffic Order and Safety, the Ministry of Public Security of Vietnam has proposed a new classification for driving licenses as follows:

- Category A2 issued to drivers of two-wheeled motorbikes with cylinder capacity from 50 cm3 to 175 cm3 or with engines with equivalent rated capacity;

- Category A issued to drivers of two-wheeled motorbikes with a cylinder capacity of 175 cm3 or more or engines with equivalent rated capacity and vehicles specified for category A2 driving license;

- Category A3 issued to drivers of three-wheeled motorbikes and vehicles specified for category A2 driving license;

- Category B issued to drivers of passenger cars with up to 9 seats (including the driver's seat); trucks (including specialized trucks), tractors with a designed transport category volume not exceeding 3,500 kg; Types of cars specified for category B driving license are attached to trailers with the total design weight of the trailer not exceeding 750 kg; Vehicle types specified for Driving license category B2;

- Category C1 issued to drivers of trucks (including specialized trucks and specialized cars) and tractors with a designed transport weight of over 3,500 to 7,500 kg; Trucks specified for category C1 driving license are attached to trailers with the total design weight of the trailer not exceeding 750 kg; Types of vehicles specified for Driving license category B;

- Category C issued to drivers of trucks (including specialized trucks and specialized cars) and tractors with a designed transport weight of over 7,500 kg; Trucks specified for category C driving license with trailers attached with the total design weight of the trailer not exceeding 750kg; Types of vehicles prescribed for Driving license categories B, C1;

- Category D2 issued to drivers of passenger cars (including buses) from 10 to 30 seats; Passenger cars specified for category D2 driving license are attached to trailers with the total design weight of the trailer not exceeding 750kg; Types of vehicles prescribed for category B, C1, C driving licenses;

- Category D issued to drivers of passenger cars (including buses) with more than 30 seats; sleeper passenger cars; Passenger cars specified for category D driving license are attached to trailers with the total design weight of the trailer not exceeding 750kg; Types of vehicles prescribed for category B, C1, C, D2 driving license;

- Category BE issued to drivers to drive the types of cars specified for category B driving license when towing trailers with the total design weight of the trailer over 750 kg;

- Category C1E issued to drivers to drive the types of cars specified for category C1 driving license when towing trailers with the total design weight of the trailer over 750 kg;

- Category CE issued to drivers to drive the types of cars specified for category C driving license when towing trailers with the total design weight of the trailer over 750 kg; tractor-trailer cars pulling semi-trailers;

- Category D2E issued to drivers to drive the types of cars specified for category D2 driving license when towing trailers with the total design weight of the trailer over 750 kg;

- Category DE is issued to drivers to drive vehicles specified for category D driving license when towing trailers with the total design weight of the trailer over 750 kg.

Thus, compared to the current regulations in the Law on Road Traffic 2008, the new proposal will no longer have driving licenses for categories A1, B1, B2.

It is expected that if the Law on Ensuring Road Traffic Order and Safety is passed, it will take effect from July 1, 2024.

What is the proposed validity of the driving licenses?

According to the Draft Law on Ensuring Road Traffic Order and Safety, driving license terms for categories are as follows:

- Category A2, A, A3 driving licenses: indefinity;

- Category B driving license is valid for 10 years from the date of issue;

- Categories C1, C, D2, D, BE, C1E, CE, D2E, DE driving licenses are valid for 5 years from the date of issue.

Vietnam: Shall children under 10 years old be allowed to sit in the front passenger seat of a car according to the new Draft Law?

This is one of the new proposals of the Ministry of Public Security of Vietnam recorded in the Draft Law on Ensuring Road Traffic Order and Safety.

Accordingly, in Article 9 of the Draft, there is a provision for General Rules when participating in road traffic as follows:

General rules
1. Traffic participants must drive to the right in their direction of travel, stay in the correct lane and designated road section, and obey road signs.
2. Drivers and passengers in cars must wear seat belts in places equipped with seat belts when participating in traffic on the road.
3. Children under 10 years old or under 1.35 meters in height transported in a car must not sit in the front passenger seat when participating in road traffic; Children under 4 years old must be transported in seats designed for children (except for passenger transport cars as prescribed by road law). The driver is responsible for checking and instructing children to wear seat belts.
4. Where there are road markings or other signs for pedestrians, vehicle drivers must observe, slow down or stop to let pedestrians or wheelchairs of people with disabilities cross the road. Where there are no pedestrian crossings, vehicle drivers must observe and, if they see pedestrians or disabled people's wheelchairs crossing the street or there is a crosswalk signal, they must slow down or stop. Give way to pedestrians and wheelchairs of disabled people crossing the street.

It can be seen that the Draft has proposed 4 general principles when participating in traffic mentioned above. Among them, the content that stands out is:

...Children under 10 years old or under 1.35 meters in height transported in a car must not sit in the same category of driver's seat when participating in road traffic

Accordingly, when the Draft is passed, children under 10 years old will not be allowed to sit in the front seat of a car - the same category as the driver's seat.
