Scope of Pharmaceutical Practice for Individuals with Certificates and Diplomas in Traditional Medicine and Pharmacy

Pursuant to Article 5 of Circular 47/2018/TT-BYT, the scope of pharmaceutical practice for individuals with certificates and diplomas in traditional medicine and pharmacy is stipulated as follows:

- Individuals with a certificate as a traditional medicine practitioner, as stipulated in Clause 1, Article 2 of Circular 47/2018/TT-BYT, are responsible for the professional matters of wholesale and retail traditional medicine, traditional medicinal herbs and are responsible for the professional matters or quality assurance of household businesses and cooperatives producing traditional medicinal herbs.

- Individuals with a certificate as a traditional pharmacy practitioner, as stipulated in Clause 2, Article 2 of Circular 47/2018/TT-BYT, are responsible for the professional matters of wholesale and retail traditional medicinal herbs and traditional medicinal substances.

- Individuals with other certificates and diplomas in traditional medicine and pharmacy, as stipulated in Clauses 3, 4, and 5, Article 2 of Circular 47/2018/TT-BYT, are responsible for the professional matters of traditional medicine according to the scope of practice granted by the Department of Health.

Types of Certificates and Diplomas Related to Traditional Medicine and Pharmacy

Pursuant to Article 2 of Circular 47/2018/TT-BYT, the types of certificates and diplomas related to traditional medicine and pharmacy include:

- Certificate as a traditional medicine practitioner issued by the Ministry of Health or the Department of Health.

- Certificate as a traditional pharmacy practitioner issued by the Ministry of Health or the Department of Health.

- Certificates of sufficient professional qualifications in traditional medicine issued by the Department of Health before the effective date of Circular 13/1999/TT-BYT on July 06, 1999, of the Ministry of Health guiding the implementation of the ordinance on practicing private medicine and pharmacy in the field of traditional medicine.

- Certificates of sufficient conditions for practicing traditional medicine issued by the Department of Health from July 21, 1999, to before January 21, 2004.

- Certificates and diplomas related to traditional medicine issued by training institutions before the effective date of the 2016 Pharmacy Law and have been licensed by the Department of Health to practice traditional medicine according to Circular 02/2007/TT-BYT dated January 24, 2007, of the Minister of Health, guiding in detail the implementation of some provisions on conditions for trading drugs according to the provisions of the 2016 Pharmacy Law andhttps://thuvienphapluat.vn/van-ban/The-thao-Y-te/Nghi-dinh-79-2006-ND-CP-huong-dan-Luat-Duoc-13445.aspxDecree 79/2006/ND-CP dated August 09, 2006, of the Government of Vietnam detailing a number of articles of the 2016 Pharmacy Law.

Practice Duration for Individuals with Certificates as Traditional Medicine Practitioners

Based on Clause 2, Article 3 of Circular 47/2018/TT-BYT stipulates as follows:

Practice Organization

1. Practice Requirements

a) Individuals with a certificate as a traditional medicine practitioner must practice before being granted a practice certificate as stipulated in Clauses 2 and 3 of this Article;

b) Individuals with certificates stipulated in Clauses 2, 3, 4, and 5 of Article 2 of this Circular, who have been granted a traditional medicine practice license by the Department of Health, are not required to practice when applying for a traditional medicine practice certificate.

2. Practice duration for individuals with certificates as traditional medicine practitioners is as follows:

a) The practice duration for individuals responsible for the professional matters of wholesale and retail traditional medicine establishments is 1 year;

b) The practice duration for individuals responsible for the professional matters of wholesale and retail traditional medicinal herb establishments is 6 months;

c) The practice duration for individuals responsible for the professional matters of pharmaceutical quality assurance in household businesses and cooperatives producing traditional medicinal herbs is 1 year.

3. Practice content and practice establishments for individuals with certificates as traditional medicine practitioners:

a) Individuals responsible for the professional matters of wholesale traditional medicinal herb establishments and traditional medicine establishments, and individuals responsible for the professional matters or quality assurance of household businesses and cooperatives producing traditional medicinal herbs must practice according to the provisions of Articles 19 and 20 of Decree No. 54/2017/ND-CP dated May 8, 2017, of the Government of Vietnam detailing a number of articles and measures for implementing the Pharmacy Law;

b) Individuals responsible for the professional matters of retail traditional medicinal herb establishments must practice traditional medicine-related professional content at the pharmaceutical department of medical examination, treatment, and traditional medicine establishments or pharmaceutical business establishments.

Thus, according to the above regulations, the practice duration for individuals with certificates as traditional medicine practitioners is as follows:

- The practice duration for individuals responsible for the professional matters of wholesale and retail traditional medicine establishments is 1 year.

- The practice duration for individuals responsible for the professional matters of wholesale and retail traditional medicinal herb establishments is 6 months.

- The practice duration for individuals responsible for the professional matters or quality assurance of household businesses and cooperatives producing traditional medicinal herbs is 1 year.
