What Information Must Be Included in the Scene Examination Record of a Traffic Accident?

According to Clause 5, Article 9, Circular 63/2020/TT-BCA, the content of the examination record must include the start and end times of the examination, the location, participants in the examination; the condition of the scene before the examination, weather conditions, lighting during the examination, and the examination process; specifically as follows:

- General description of the scene, such as:

+ Whether the accident occurred on a one-way or two-way street; the type of divider on the road.

+ The width of the road surface, shoulder.

+ The road signage system; the type of barriers, guardrails, obstacles on the road.

+ Characteristics and shape of the road segment (flat or sloping, straight or curved, visibility obstructed or unobstructed).

+ Road surface material (cement concrete, asphalt, gravel, or earth); condition of the road surface (flat, smooth, cracked, slippery).

- Recording the numbering of the positions of victims, evidence, vehicles, and traces.

- Recording the identification of standard objects (reference points), reference road edges, and the direction of examination.

- Describing the positions and characteristics of victims, evidence, vehicles, and traces at the scene in the numbered order marked at the scene.

- Specifically recording the quantity of evidence, vehicles, and traces found, collected, preserved and comparative samples.

- Recording the use of electronic devices specifically designed for modeling the scene to measure the positions and characteristics of victims, evidence, vehicles, and traces at the scene, drawing the scene, or taking photos and videos (if any).

How is the Scene Examination of a Traffic Accident Conducted?

According to Clause 4, Article 9, Circular 63/2020/TT-BCA, the scene examination of a traffic accident is conducted as follows:

When conducting a scene examination, a Scene Examination Record of a Road Traffic Accident must be created using Form No. 05/TNDB issued under Circular 63/2020/TT-BCA and a scene diagram of the road traffic accident must be drawn using Form No. 06/TNDB issued under Circular 63/2020/TT-BCA; the scene diagram must be consistent with the scene examination record.

The scene examination process is as follows:

- Observe the entire area where the traffic accident occurred to determine the positions of victims, evidence, vehicles, and traces relevant to the accident scene.

- Based on the direction of the examination and reference points at the scene, mark in natural order the positions of all victims, evidence, vehicles, and traces relevant to the traffic accident.

- Take photographs of the scene including: General scene photos, partial scene photos, video recording (if any); take photos of victims, evidence, vehicles, related traces, and include a scale ruler in the photos. The photographing of the scene must be documented in a Scene Photo Album, arranged in order, and include photo captions.

- Measure and draw the scene diagram of the traffic accident: Use uniform symbols and measurement units; fully depict the traffic organization (traffic signs, road markings, roundabouts, traffic signals, and other related signaling systems) where the accident occurred; the legend must show the drawing scale, traces, and symbols on the scene diagram.

- Collect evidence, vehicles, and traces for preservation and take comparative samples according to the law. Easily altered or deformed traces must be collected and preserved immediately such as: blood, hair, fibers, fuel, and other organic chemical traces.

What Needs to Be Done After Completing the Scene Examination of a Traffic Accident?

According to Clause 6, Article 9, Circular 63/2020/TT-BCA, after completing the scene examination of a traffic accident, the following tasks must be performed:

- Review the work done during the examination process.

- Evaluate the traces and documents collected at the scene to determine their relevance or whether additional traces need to be collected.

- Approve and sign the scene examination record and the scene diagram of the traffic accident.
