Application Dossier for Recognition of Organizations Qualified to Perform Pesticide Trials as per Current Regulations

According to Article 21 Circular 21/2015/TT-BNNPTNT (amended by point b clause 3 Article 2 Circular 18/2021/TT-BNNPTNT), the dossier, order, and procedures for the recognition of organizations qualified to perform pesticide trials are stipulated as follows:

1. Submission of Dossier

a) The organization shall submit the dossier directly, by post or online to the Plant Protection Department;

b) Number of dossiers: 01 set;

c) Check the validity of the dossier immediately upon receipt if submitted directly or within 02 working days for dossiers sent by post. If the dossier is valid, the Plant Protection Department accepts it; if not, the organization is requested to supplement and complete the dossier.

2. Dossier

a) An application form for recognition of an organization qualified to perform pesticide trials according to the form prescribed in Appendix IX issued with this Circular;

b) A certified copy or a photocopy (bringing the original for comparison) of the establishment decision or the decision specifying functions, tasks, or the business registration certificate for pesticide trial activities;

c) A certified copy or a photocopy (bringing the original for comparison) of the graduation diploma (from university and above) in the field of plant protection, cultivation, agronomy, biology, chemistry, and the training certificate for pesticide trial of the head of the trial conducting organization and participants;

d) An explanatory report ensuring conditions for pesticide trials of the organization qualified to perform trials and the collaborating unit, according to the form prescribed in Appendix X issued with this Circular;

3. Appraisal and evaluation of the dossier for recognition and publication of organizations qualified to perform pesticide trials

a) The Plant Protection Department accepts and appraises the dossier for recognition of the organization qualified to perform pesticide trials. Upon obtaining the appraisal results, the Plant Protection Department will complete the dossier for recognition of the organization qualified to perform pesticide trials. The time frame is within 15 working days;

c) Within 03 working days, the Plant Protection Department issues a decision recognizing the organization qualified to perform pesticide trials;

d) If the organization does not meet the conditions for recognition as qualified to perform pesticide trials, the Plant Protection Department will notify the organization or individual in writing, stating the reasons.

Thus, this is the dossier, order, and procedure for the recognition of organizations qualified to perform pesticide trials according to current regulations.

Amended and Supplemented Dossier for Recognition of Organizations Qualified to Perform Pesticide Trials Effective from September 20, 2022

Based on clause 1 Article 1 Circular 11/2022/TT-BNNPTNT, the following is stipulated:

Amendment and Supplementation of Certain Provisions of Circular No. 21/2015/TT-BNNPTNT dated June 8, 2015, of the Minister of Agriculture and Rural Development on Management of Pesticides (hereinafter abbreviated as Circular No. 21/2015/TT-BNNPTNT)

1. Amending and supplementing point b clause 2 Article 21 as follows:

"b) A certified copy or a photocopy (bringing the original for comparison) of the establishment decision or the decision on functions and tasks in the field of pesticide trials;".

Thus, the dossier, order, and procedure for the recognition of organizations qualified to perform pesticide trials in Circular 11/2022/TT-BNNPTNT are amended and supplemented as above.
