Rights and Obligations of Citizens in Implementing Democracy at the Grassroots Level
Based on the provisions of Article 5 and Article 6 of the Law on Implementing Democracy at the Grassroots Level 2022, the rights and obligations of citizens in implementing democracy at the grassroots level are stipulated as follows:
Rights of Citizens in Implementing Democracy at the Grassroots Level
- To have information publicly disclosed and to request for complete, accurate, and prompt information in accordance with the law.
- To propose initiatives, provide opinions, discuss, and decide on the contents of implementing democracy at the grassroots level in accordance with this Law and other relevant legal provisions.
- To inspect, supervise, make recommendations, reflect, lodge complaints, denounce, and initiate lawsuits against decisions or acts violating legal provisions on implementing democracy at the grassroots level in accordance with the law.
- To have their rights and lawful interests recognized, respected, protected, and guaranteed in the implementation of democracy at the grassroots level in accordance with the law.
Obligations of Citizens in Implementing Democracy at the Grassroots Level
- To comply with legal provisions on implementing democracy at the grassroots level.
- To participate in giving opinions on matters subject to consultation at the grassroots level as stipulated by this Law and other relevant legal provisions.
- To abide by decisions made by the residential community, local authorities, agencies, units, and employing organizations.
- To promptly make recommendations, reflect, and denounce to competent authorities upon detecting acts violating legal provisions on implementing democracy at the grassroots level.
- To respect and ensure public order, social safety, the interests of the State, and the lawful rights and interests of organizations and individuals.

Prohibited Acts in Implementing Democracy at the Grassroots Level
Based on the provisions of Article 9 of the Law on Implementing Democracy at the Grassroots Level 2022, the prohibited acts in implementing democracy at the grassroots level include:
- Causing difficulties, annoyance, or obstruction, threatening citizens in implementing democracy at the grassroots level.
- Covering up, obstructing, retaliating or neglecting responsibility to resolve recommendations, complaints, denouncement; disclosing information about the complainant, the informant related to violations in implementing democracy at the grassroots level.
- Exploiting the implementation of democracy at the grassroots level to commit acts infringing upon national security, public order, social safety, infringing the interests of the State, and the lawful rights and interests of organizations and individuals.
- Exploiting the implementation of democracy at the grassroots level to distort, slander, create conflicts, incite violence, discriminate among regions, genders, religions, ethnicities, causing harm to individuals, agencies, units, and organizations.
- Forging documents, committing fraud or using other means to falsify the results of decisions, participation, and opinions of the citizens.
How are Officials and Public Employees Threatening Citizens in Implementing Democracy at the Grassroots Level Handled?
Based on the provisions of Article 10 of the Law on Implementing Democracy at the Grassroots Level 2022 as follows:
Handling Violations of Law on Implementing Democracy at the Grassroots Level
1. Individuals committing acts violating the laws on implementing democracy at the grassroots level, depending on the nature and level of violation, will be subject to administrative penalties, administrative handling measures, or criminal prosecution; if causing damage, they must compensate in accordance with the law.
2. Organizations violating provisions of this Law and other relevant legal provisions on implementing democracy at the grassroots level, depending on the nature and level of violation, will be subject to administrative penalties; if causing damage, they must compensate in accordance with the law.
3. Officials and public employees exploiting their positions and powers to violate provisions of this Law, infringing on the interests of the State, or the lawful rights and interests of organizations and individuals, depending on the nature and level of violation, will be subject to disciplinary action or criminal prosecution; if causing damage, they must compensate or reimburse according to the law.
4. Administrative penalties and disciplinary actions against violations of the law on implementing democracy at the grassroots level will be conducted following the Government of Vietnam's regulations.
According to the above regulations, officials and public employees threatening citizens in implementing democracy at the grassroots level by infringing on the interests of the State, lawful rights, and interests of organizations and individuals will, depending on the nature and level of violation, be subject to disciplinary action or criminal prosecution; if causing damage, they must compensate or reimburse according to the law.
