What is the direction of the Party on land management and use?

According to subsection 1, Section II, Resolution 18-NQ/TW in 2022, the 5th time of the 13th Central Executive Committee as follows:

- Land is owned by the entire people and is managed uniformly by the State as the representative of the owner. The State exercises the rights of the owner through the decision on master plans and plans on land use; recover land, allocate land, lease land, recognize land use rights, permit change of use purpose and stipulate land use term; decide on land prices; policy decisions to regulate the value added from land that is not created by land users. The State recovers land to use for defense and security purposes; socio-economic development for the national and public interests in accordance with the law, ensuring fairness, publicity and transparency, and upholding accountability. Land management and use must ensure the common interests of the entire people; People are given favorable conditions to access and use land fairly, openly, effectively and sustainably.

The State uniformly manages land according to the national territory, both in terms of area, quality, economic, cultural, social, national defense, security and environmental values; reasonable assignment of state agencies at the central level, and at the same time, have appropriate and effective decentralization and decentralization for localities and strengthen inspection, supervision, control and handling of violations.

- Land use right is a special type of property and goods, but it is not the right to ownership, right to use land or property attached to land protected by law. Land users have the rights and obligations to use land in accordance with law. The State does not recognize the reclaiming of land that has been allocated by the State to others for use in the course of implementing policies and laws on land; do not adjust agricultural land allocated to households and individuals; promptly adopt appropriate policies so that agricultural land can be exploited and used with the highest efficiency.

- Institutions and policies on land must be completed synchronously and in line with the institution of development of a socialist-oriented market economy. To adopt policies suitable to each object and type of land use in order to arouse potentials and maximize the value of land resources; resolutely overcome corruption, negativity, complaints about land, speculation and wasteful land use.

- Improve the effectiveness and efficiency of state management of land. Modernize land management and public services. Consolidating and perfecting the organizational system | lean, effective, efficient, centralized, synchronous and unified land management apparatus. Improve the role and capacity of judicial agencies in settling complaints, denunciations and disputes over land. Land must be fully investigated, assessed, statistic, inventoryed, quantified and accounted for in the economy; be planned for effective and rational use with a long-term vision, harmonizing interests between generations, regions and regions, between socio-economic development and assurance of national defense and security; develop

education, culture, sports; environmental protection and adaptation to climate change; ensure national food security. Solve well the inadequacies and problems in land management and use left by history and new requirements of practice.

- Strengthening the leadership of the Party, bringing into play the role of the Vietnam Fatherland Front, socio-political organizations and people in formulating, implementing and monitoring the implementation of policies and laws on land

What is the overall goal of the Party on land management and use?

According to subsection 1, Section III, Resolution 18-NQ/TW in 2022, the 5th time of the 13th Central Executive Committee as follows:

- Perfecting institutions and policies on land management and use synchronously and in line with the institutions for developing a socialist-oriented market economy.

- Land resources are managed, exploited and used in the most economical, sustainable and efficient manner, meeting the requirements of accelerating industrialization, modernization, equity and social stability, ensuring defence security; environmental protection, adaptation to climate change; creating a driving force for our country to become a high-income developed country. The real estate market, including the land use rights market, has become a rational, fair and efficient land allocation channel.

What are the specific goals of the Party on land management and use?

According to subsection 2, Section III, Resolution 18-NQ/TW in 2022 stated as follows:

(1) By 2025:

By 2023, amendments to the 2013 Land Law in Vietnam in Vietnam and a number of related laws must be completed, ensuring uniformity and consistency. Completing the construction of a digital database and national information system on land in a centralized, unified, synchronous, multi-purpose and inter-connected manner. To complete the organization of the state management of land in order to ensure its efficiency, effectiveness, synchronization and consistency; eliminating intermediaries, promoting appropriate decentralization and decentralization, accompanied by a mechanism for checking, monitoring and controlling power. To basically solve the shortcomings and problems related to the management and use of land originating from state-owned agricultural and forestry farms; land for national defense and security in combination with production and economic construction; land of production facilities and non-business units that have been relocated from the centers of large urban centers; encroaching land; religious land; cemetery land; land combined with multiple uses; residential land, production land for ethnic minorities.

(2) By 2030:

The legal system on land has basically been completed synchronously and consistently, in line with the institution of developing a socialist-oriented market economy. Overcome the state of wasteful land use, fallow land, pollution, degradation and the problems and problems in land management and use left by history.

Thus, the Party directs by 2023 to complete the amendment of the 2013 Land Law in Vietnam and a number of related laws, ensuring uniformity and consistency.
