Requirements of the Government of Vietnam on the disbursement of public investment capital according to Resolution 31/ND-CP?

Resolution 31/ND-CP of 2023 clearly states, the Government of Vietnam basically agrees with Report 1438/BC-BKHDT dated March 2, 2023, of the Ministry of Planning and Investment on the situation of allocation and disbursement of public investment capital in the first two months of 2023 and solutions to accelerate the disbursement of public investment capital.

Based on the resolution of the National Assembly, the Prime Minister of the Government of Vietnam assigned the plans for investment capital from the central budget in 2023 to ministries, institutions, and localities. As of March 1, 2023, the ministries, central agencies, and localities have allocated and assigned detailed plans reaching 85.2% of the plan assigned by the Prime Minister of the Government of Vietnam.

Estimated payment by February 28, 2023, reached 6.97% of the plan assigned by the Prime Minister of the Government of Vietnam, about VND 4.6 trillion higher than the same period (an increase of about 10%). There are 12 localities with disbursement rates reaching over 15% of the plan assigned by the Prime Minister of the Government of Vietnam; 51/51 ministries, central agencies, and 22/63 localities have disbursement rates below the national average, of which 43 ministries and central agencies have not disbursed any funds (0%).

In section III of Resolution 31/ND-CP of 2023, the Government of Vietnam requires ministries, central agencies, and localities to:

- Urgently allocate in detail the 2023 state budget investment capital plan assigned by the Prime Minister of the Government of Vietnam in a focused and non-dispersed manner; allocate sufficient capital according to the implementation progress, especially for national important projects and key infrastructure development projects with great impact and leverage for socio-economic development. Flexibly balance capital between the Economic Recovery and Development Program and the Medium-term Public Investment Plan for 2021-2025 according to regulations, ensuring full disbursement of the Program's capital in 2023.

- The Ministry of Planning and Investment should absorb and complete the Directive of the Prime Minister of the Government of Vietnam on key tasks and solutions to accelerate the allocation and disbursement of public investment capital, the three national target programs for 2023, the Economic Recovery and Development Program; submit to the Prime Minister of the Government of Vietnam before March 10, 2023. The Prime Minister of the Government of Vietnam’s Task Forces on urging and inspecting the disbursement of public investment capital should urgently build and implement operational plans, ensuring feasibility and effectiveness.

- Monthly, the Ministry of Planning and Investment should host and coordinate with the Ministry of Finance to publicly disclose in the monthly Government of Vietnam meetings and on mass media the disbursement rates of the 2023 state budget investment capital of ministries, central agencies, and localities.

Formation of 5 Task Forces to inspect, resolve difficulties, and accelerate the disbursement of public investment capital according to Resolution 31?

On March 14, 2023, the Prime Minister issued Decision 235/QD-TTg to establish 05 Task Forces to inspect, urge, resolve difficulties, and accelerate the disbursement of public investment capital in 2023 at ministries, central agencies, and localities.

To be specific, as follows:

(1) Task Force No. 1

Task Force No. 1, led by Deputy Prime Minister of the Government of Vietnam Le Minh Khai, will inspect ministries, agencies; and the following localities:

- Ministries, agencies: Office of the National Assembly, Office of the Government of Vietnam, Ministry of Planning and Investment, Ministry of Finance, Government Inspectorate, State Bank of Vietnam, State Audit Office, Vietnam General Confederation of Labor,...

- Localities: Ho Chi Minh City, Long An, Tien Giang, Ben Tre, Tra Vinh, Vinh Long, Can Tho City, Hau Giang, Soc Trang, An Giang, Dong Thap, Kien Giang, Bac Lieu, Ca Mau.

(2) Task Force No. 2

Task Force No. 2, led by Deputy Prime Minister of the Government of Vietnam Tran Hong Ha, will inspect ministries, agencies; and the following localities:

- Ministries, agencies: Ministry of Industry and Trade, Ministry of Transport, Ministry of Construction, Ministry of Information and Communications, Ministry of Science and Technology, Ministry of Education and Training, Ministry of Health, Ministry of Culture, Sports and Tourism, Ministry of Labor, Invalids and Social Affairs,...

- Localities: Hanoi City, Thanh Hoa, Nghe An, Ha Tinh, Quang Binh, Quang Tri, Thua Thien Hue, Da Nang City, Quang Nam, Quang Ngai, Binh Dinh, Phu Yen, Khanh Hoa.

(3) Task Force No. 3

Deputy Prime Minister of the Government of Vietnam Tran Luu Quang leads Task Force No. 3, which will inspect ministries, agencies; and the following localities:

- Ministries, agencies: Central Office of the Communist Party, Supreme People's Court, Supreme People's Procuracy, Ho Chi Minh National Academy of Politics, Ministry of National Defense, Ministry of Public Security, Ministry of Foreign Affairs, Ministry of Justice, Ministry of Agriculture and Rural Development, Ministry of Home Affairs,...

- Localities: Hai Phong City, Ha Giang, Tuyen Quang, Cao Bang, Lang Son, Lao Cai, Thai Nguyen, Bac Kan, Bac Giang, Hoa Binh, Son La, Lai Chau, Dien Bien.

(4) Task Force No. 4

Task Force No. 4, led by the Minister of Planning and Investment, will inspect the following localities: Yen Bai, Phu Tho, Quang Ninh, Hai Duong, Hung Yen, Vinh Phuc, Bac Ninh, Ha Nam, Nam Dinh, Ninh Binh, Thai Binh.

(5) Task Force No. 5

The Minister of Finance leads Task Force No. 5, which will inspect the following localities: Ninh Thuan, Binh Thuan, Dak Lak, Dak Nong, Gia Lai, Kon Tum, Lam Dong, Dong Nai, Binh Duong, Binh Phuoc, Tay Ninh, Ba Ria Vung Tau.

In which, the composition of the Task Forces of the Government of Vietnam leaders includes leaders of Ministries, agencies: Planning and Investment, Finance, Justice, Construction, Transport, Agriculture and Rural Development, Natural Resources and Environment, Industry and Trade, State Bank of Vietnam, and some related agencies.

The specific composition of each Task Force is decided by the Task Force leader.

Tasks and powers of the Government of Vietnam as specified?

According to Article 96 of the 2013 Constitution, the tasks and powers of the Government of Vietnam are specified as follows:

- Organize the implementation of the Constitution, laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly, orders, and decisions of the President;

- Propose and develop policies for submission to the National Assembly, the Standing Committee of the National Assembly for their decision or decide within their authority to perform the tasks and powers specified in this Article; submit draft laws, the state budget, and other projects to the National Assembly; submit draft ordinances to the Standing Committee of the National Assembly;

- Take unified management of economic, cultural, social, educational, medical, scientific, technological, environmental, information, communication, foreign affairs, national defense, national security, public order, and social safety; implement mobilization or partial mobilization orders, proclaiming of a state of emergency and other necessary measures to protect the Fatherland, ensure the lives and property of the people;

- Submit to the National Assembly for decision the establishment, abolition of ministries, ministerial-level agencies; establishment, dissolution, merger, division, adjustment of provincial and city administrative boundaries affiliated to the central government, and special administrative-economic units; submit to the Standing Committee of the National Assembly for decision the establishment, dissolution, merger, division, adjustment of administrative boundaries below the provincial and city levels under the central government;

- Take unified management of the national administration; manage officials and public employees and civil service in state agencies; organize inspection, examination, complaint and denunciation resolution, and anti-bureaucracy and corruption in the state apparatus; lead the work of ministries, ministerial-level agencies, agencies affiliated with the Government of Vietnam, and people's committees at all levels; guide and inspect the implementation of documents of higher-level state agencies by people's councils; facilitate people's councils in performing the tasks and powers prescribed by law;

- Protect the rights and interests of the State and society, human rights, and citizens' rights; maintain public order and social safety;

- Organize negotiations and sign international treaties on behalf of the State by authorization from the President; decide on signing, joining, approving, or ceasing the effect of international treaties on behalf of the Government of Vietnam, except international treaties requiring approval by the National Assembly as stipulated in Clause 14, Article 70; protect the interests of the State, legitimate interests of Vietnamese organizations and citizens abroad;

- Coordinate with the Central Committee of the Vietnam Fatherland Front and central bodies of political-social organizations in performing their tasks and exercising their powers.
