Regulations on the Use of Electronic Identification Accounts to Replace Citizen ID Cards When Applying for a Certificate of High-Tech Application Activities from August 1, 2023

On July 26, 2023, the Ministry of Science and Technology issued Circular 15/2023/TT-BKHCN amending and supplementing several articles of Circular 32/2011/TT-BKHCN and Circular 03/2015/TT-BKHCN.

Clause 2, Article 1 of Circular 15/2023/TT-BKHCN has supplemented Clause 4, Article 9 of Circular 32/2011/TT-BKHCN as follows:

Vietnamese citizens may use a level 2 electronic identification account to replace copies of the following documents when carrying out procedures to apply for a Certificate of High-Tech Application Activities:

- Identity Card;- Citizen ID Card;- Passport.

Thus, from August 1, 2023, Vietnamese citizens may use a level 2 electronic identification account to perform procedures to apply for a Certificate of High-Tech Application Activities.

How are the procedures for applying for a Certificate of High-Tech Application Activities for individuals currently regulated?

The dossier and procedures for applying for a Certificate of High-Tech Application Activities for individuals are regulated in Article 2 of Decision 55/2010/QD-TTg.

The dossier for applying for an individual's activity certificate includes:

- Application form for the individual's activity certificate as per the Ministry of Science and Technology's prescribed form, accompanied by 02 photos sized 4x6 cm;- Photocopy of the valid Identity Card or Passport;- Statement of the high-tech application project, proposal, or research and development proposal (high-tech per the prioritized high-tech list for development investment);- Written confirmation from the Department of Science and Technology for the contents presented in the high-tech application project, proposal, or research and technology development proposal where the individual engages in high-tech application, research, and high-tech development.

Within 15 working days from the receipt of the confirmation request from an organization or individual engaging in high-tech application, research, and development, the Ministry, Ministry-level agency, government agency, or the Department of Science and Technology of the province or centrally-run city is responsible for inspecting and providing written confirmation for the contents presented in the high-tech application project, proposal, or research and technology development proposal. In case of refusal to confirm, the reason must be notified in writing to the requesting organization or individual.

In the case of an incomplete dossier, the Ministry of Science and Technology must issue an official document requesting the completion of the dossier, sent directly or by post to the organization or individual requesting the activity certificate. Within 10 working days from the date of receipt of the request of the Ministry of Science and Technology, the requesting organization or individual is responsible for completing and resubmitting the dossier to the Ministry of Science and Technology.

Within 15 working days from the date of receipt of the complete dossier submitted by the organization or individual requesting the activity certificate, the Ministry of Science and Technology shall appraise and issue the activity certificate and send it to the organization or individual requesting the activity certificate. In case of refusal to issue the certificate, the reason must be notified in writing to the requesting organization or individual.

The form of the activity certificate and the confirmation document stipulated in Point d, Clause 1 and Point d, Clause 2, Article 2 of Decision 55/2010/QD-TTg is issued by the Ministry of Science and Technology.

However, from August 1, 2023, Vietnamese citizens may use a level 2 electronic identification account to perform procedures for applying for a Certificate of High-Tech Application Activities.
