Are Employees Entitled to Leave on the 2024 Tet Nguyen Tieu?

According to Article 112 of the Labor Code 2019 regarding holidays and Tet for employees as follows:

Holidays and Tet

1. Employees are entitled to leave with full pay on the following public holidays and Tet:

a) New Year's Day: 1 day (January 01, Gregorian calendar);

b) Lunar New Year: 5 days;

c) Victory Day: 1 day (April 30, Gregorian calendar);

d) International Workers' Day: 1 day (May 01, Gregorian calendar);

e) National Day: 2 days (September 02, Gregorian calendar and one adjacent day either before or after);

f) Hung Kings' Temple Festival: 1 day (March 10, Lunar calendar).

2. Foreign employees working in Vietnam, apart from the holidays mentioned in Clause 1 of this Article, are entitled to an additional day off for their traditional New Year and one day for their National Day.

However, in 2024, Tet Nguyen Tieu falls on Saturday, February 24, 2024 (15th day of the first lunar month of 2024), leading to two situations:

Case 1: Employees have a weekly leave on Saturday, they will get a leave during Tet Nguyen Tieu 2024.

Case 2: Employees have weekly leaves on Mondays, Tuesdays, Wednesdays, Thursdays, Fridays, and Sundays. They will have to work during Tet Nguyen Tieu 2024.

In addition to the above cases, employees can take a leave during Tet Nguyen Tieu 2024 if they proactively take annual leave or unpaid leave.

Are Employees Entitled to Bonuses During Tet Nguyen Tieu 2024?

According to Article 104 of the Labor Code 2019 regarding bonuses for employees as follows:

Bonus

1. A bonus is a sum of money or assets or in other forms that the employer rewards the employee based on production and business results and the completed tasks of the employee.

2. The bonus regulations are decided and publicly announced at the workplace by the employer after consulting with the employee representative organization at the workplace if such an organization exists.

Therefore, rewarding employees during Tet Nguyen Tieu 2024 is at the discretion of the enterprise based on their production and business results, and the reward regulations are decided and publicly announced at the workplace after consulting with the employee representative organization if such an organization exists.

Hence, enterprises are not obligated to reward employees during Tet Nguyen Tieu 2024.
