According to Article 21 of the Law on Implementation of Grassroots-level Democracy 2022:

2. The public decisions regarding the content stipulated in Clauses 1, 2, and 6 of Article 15 of this Law shall be effective within the village or residential group from the date it is approved by the residential community through voting.

For the public decisions regarding the content stipulated in Clauses 1 and 2 of Article 15 of this Law having a range of implementation within the commune-level area, the effective date shall be decided by the commune-level People's Committee According to the synthesis of the community's voting results.

The public decisions regarding the content stipulated in Clauses 3 and 4 of Article 15 of this Law shall be effective from the date the commune-level People's Committee issues a recognition decision.

The public decisions regarding the content stipulated in Clause 5 of Article 15 of this Law shall be effective from the date the commune-level Vietnam Fatherland Front Committee issues a recognition decision.

No later than 05 working days from the date of receiving the decision from the residential community, the commune-level People's Committee or the commune-level Vietnam Fatherland Front Committee must issue a recognition decision; if not recognized, they must reply in writing and state the reasons.

What are the responsibilities for conduct of public consultation, and implementation of public decisions in Vietnam?

According to Article 23 of the Law on Implementation of Grassroots-level Democracy 2022, the responsibilities for organizing for the people to discuss, decide, and implement the public decisions in Vietnam are stipulated as follows:

- The commune-level People's Committee has plans to organize for the people to discuss and decide on contents with a range of implementation within the commune-level area; the commune-level People's Committee, the Chairman of the commune-level People's Committee are responsible for organizing the implementation of the public decisions within the commune-level area; monitoring and checking the implementation of the public decisions in the village or residential group.

The commune-level People's Committee consolidates, and reports to the same level People's Council on the organization for the people to discuss and decide contents within the commune-level area at the nearest regular meeting, while also sending it to the same level Vietnam Fatherland Front Committee for supervision.

- The village head, the head of the residential group is responsible for publicly announcing the results of the voting or the results of the consolidated public opinion in the village or residential group; organizing the implementation of the public decisions within the village or residential group; reporting the results of the community's decision implementation to the people in the village or residential group and to the commune-level People's Committee.

- The commune-level Vietnam Fatherland Front Committee is responsible for guiding and supervising the organization for the people to discuss, decide, and implement the contents discussed and decided by the people.

- the Government of Vietnam specifies the organization of residential community meetings; the distribution of public opinion ballot papers; online voting at the village or residential group; the procedures for election, dismissal of village heads, and heads of residential groups; the construction and implementation of community conventions and agreements.

With whom must the People’s Inspectorate periodically report its activities?

According to Article 39 of the Law on Implementation of Grassroots-level Democracy 2022, it is stipulated as follows:

Activities of People’s Inspectorates in communes, wards or towns

1. The People’s Inspectorate at the commune, ward, commune-level town is directly directed and guided by the commune-level Vietnam Fatherland Front Committee.

2. According to the action program and the guidance and direction of the commune-level Vietnam Fatherland Front Committee, the People’s Inspectorate constructs its operational orientation and content for each quarter, 06 months, and annually.

3. The People’s Inspectorate is responsible for periodically reporting or reporting upon request on its activities to the commune-level Vietnam Fatherland Front Committee. The People’s Inspectorate is invited to attend meetings of the People's Council, the People's Committee, and the commune-level Vietnam Fatherland Front Committee that have content related to the inspection and supervision tasks of the People’s Inspectorate.
