Decision 168/QD-BNV: What is the announcement on administrative procedures for the recruitment, utilization, and management of officials in Vietnam?
On March 12, 2024, the Ministry of Home Affairs issued Decision 168/QD-BNV 2024 to announce administrative procedures stipulated in Government Decree 85/2023/ND-CP dated December 7, 2023, amending and supplementing some provisions of Government Decree 115/2020/ND-CP dated September 25, 2020, regarding the recruitment, utilization, and management of officials.
Decision 168/QD-BNV 2024 announces the following administrative procedures for recruitment, utilization, and management of officials:
- Recruitment procedure for officials;
- Examination procedure for officials;
- Acceptance procedure for officials without managerial positions.
Therefore, Decision 168/QD-BNV 2024 announces three administrative procedures for recruitment, utilization, and management of officials, which will be implemented from March 12, 2024.

Pursuant to Decision 168/QD-BNV 2024, the agencies responsible for implementing the administrative procedures for recruitment, utilization, and management of officials are as follows:
- For the recruitment procedure for officials:
+ For public service providers that ensure regular and investment expenditures and public service providers that ensure regular expenditures, the head of the public service providers is responsible for the recruitment of officials.
+ For public service providers that partially ensure regular expenditures and public service providers that are ensured by the state for regular expenditures, the competent authority managing the public service providers is responsible for the recruitment of officials or may delegate this responsibility to the head of the public service providers.
- For the examination procedure for officials:
+ For public service providers that ensure regular and investment expenditures and public service providers that ensure regular expenditures, the head of the public service providers is responsible for the recruitment of officials.
+ For public service providers that partially ensure regular expenditures and public service providers that are ensured by the state for regular expenditures, the competent authority managing the public service providers is responsible for the recruitment of officials or may delegate this responsibility to the head of the public service providers.
- For the acceptance procedure for officials: The head of the competent authority responsible for recruiting officials is responsible for the acceptance of officials.
What are the classification of officials in Vietnam?
Pursuant to Article 3 of Decree 115/2020/ND-CP, officials are classified as follows:
- Classification based on duties and responsibilities:
+ Managing officials are individuals appointed to hold managerial positions for a specific period, responsible for directing, organizing, and carrying out one or more tasks within the public service providers, and are entitled to managerial allowances.
+ Non-managerial officials are individuals who only perform specialized professional tasks according to their professional titles within the public service providers.
- Classification based on educational qualifications:
+ Officials with a doctoral degree.
+ Officials with a master's degree.
+ Officials with a bachelor's degree.
+ Officials with a college diploma.
+ Officials with a vocational diploma
What are the grounds for recruitment of officials in Vietnam?
Pursuant to Article 4 of Decree 115/2020/ND-CP, amended and supplemented by Clause 1 of Article 1 of Decree 85/2023/ND-CP, the grounds for recruitment of officials are as follows:
- The recruitment of officials must be based on the job requirements, positions, professional title standards, and salary fund of the public service providers.
- The head of the public service providers, as stipulated in Clause 1 of Article 7 of Decree 115/2020/ND-CP, or the competent authority managing the public service providers, as stipulated in Clause 2 of Article 7 of Decree 115/2020/ND-CP, or the head of the delegated authority, are responsible for developing the recruitment plan and making decisions within their authority or reporting to the authority managing officials for approval before each recruitment cycle.
The content of the recruitment plan includes:
+ The number of assigned workers and the number of unused workers in the public service providers.
+ The number of positions to be recruited for each job position, specifying the positions where applicants can register 02 preferences.
+ Positions where applicants can register 02 preferences must have the same standards and conditions, be examined by the same Council, and apply a written examination format (round 2) with a common test paper.
+ The number of positions to be recruited for ethnic minorities (if any), specifying the targets and the ethnic structure to be recruited.
+ Registration requirements for each job position.
+ Form and content of the recruitment or examination.
+ Other relevant contents (if any).
The public service providers, as stipulated in Clause 1 of Article 7 of Decree 115/2020/ND-CP, develop and decide on the recruitment plan according to the provisions in this clause without having to report to the competent authority managing the public service providers for approval
