Decision 1191/QD-BXD 2023: What are the regulations on the examination fee for issuing Construction practice certificates in Vietnam?
On November 28, 2023, the Ministry of Construction issued Decision 1191/QD-BXD 2023 on Examination Fee for Issuing Construction Practice Certificates.
In Article 2 of the Regulations issued together with Decision 1191/QD-BXD 2023, regulations on examination fee are as follows:
Examination fee for issuing construction practice certificates
1. The examination fee is a fixed amount that an examinee must pay when taking an examination for a construction practice certificate, to compensate for the cost of holding the examination.
2. The examinee shall pay the examination fee once before taking the examination. The examination fee is not refundable in any case.
3. The examination fee is collected and used to pay for the following activities of the issuing authorities, including:
a) Travel, accommodation, and accommodation costs for individuals who hold the examination;
b) Examination costs, including: costs for renting halls, computer rooms, tea break and other costs directly related to the organization of exams;
c) Office supplies, photocopying, and printing costs for the organization of the examination;
d) The cost of managing and operating the software system;
e) The cost of developing, updating, and supplementing the question bank for the examination for construction practice certificates;
Accordingly, the examination fee is a fixed amount that an examinee must pay when taking an examination for a construction practice certificate, to compensate for the cost of holding the examination.
The examination fee is collected and used to pay for the following activities of the issuing authorities, including:

How much is the examination fee for issuing construction practice certificates in Vietnam?
Accordingly, in Article 3 of the Regulations promulgated together with Decision 1191/QD-BXD 2023, the amount of examination fee for issuing construction practice certificates is as follows:
- The examination fee is calculated per examination of an examinee as follows: VND 350,000/examination.
- In addition to the examination fee mentioned in Clause 1 of this Article, socio-professional organizations recognized as eligible for granting practice certificates may set their own fee rates to serve the assessment of applications for construction practice certificates of examinees but not exceeding the fee amount in accordance with the regulations of the Ministry of Finance and publicly listed according to the regulations..
Which entities have the power to issue the Construction practice certificates in Vietnam?
In Article 64 of Decree 15/2021/ND-CP supplemented by Clause 19, Article 12 of Decree 35/2023/ND-CP, it is stipulated as follows:
The power to issue and revoke the construction practicing certificate
1. Power to issue the practicing certificate:
a) Construction authorities affiliated to the Ministry of Construction shall issue Rank-I practicing certificates;
b) Departments of Construction shall issue Rank-II and Rank-III practicing certificates;
c) Socio-professional organizations specified in Article 81 of this Decree shall issue Rank-II and Rank-III practicing certificates to their members.
2. Power to revoke the practicing certificate:
a) Authorities that have the power to issue practicing certificates are the ones that have the power to revoke the practicing certificates that they issued;
b) If the practicing certificate is issued against the law but the competent authority that issued the practicing certificate fails to revoke it, the Ministry of Construction shall directly revoke that practicing certificate.
3. The agency having authority to issue practicing certificates as prescribed in Clause 1 of this Article shall adjust and re-issue practicing certificates that were previously issued, except for the case specified in Clause 11 Article 110 of this Decree
Thus, based on the above regulations, the power to issue the practicing certificate:
- Construction authorities affiliated to the Ministry of Construction shall issue Rank-I practicing certificates;
- Departments of Construction shall issue Rank-II and Rank-III practicing certificates;
- Socio-professional organizations specified in Article 81 of this Decree shall issue Rank-II and Rank-III practicing certificates to their members.
