Pursuant to Clause 1, Article 20 of Circular 10/2022/TT-BKHDT stipulates as follows:
“Article 20. Submission of EOI, E-HSDST, E-HSDKTHDA, application for registration of project implementation
1. Process of submitting E-HSQT, E-HSDST, E-HSDKTHDA, project implementation registration documents on the System
a) For PPP projects, investment projects using land:
Investors enter information required by E-KSQT, E-HSMST, ESBNLKN on the System in webform format, attach files to form a set of E-HSQT, E-HSDST, E-Proposals and submit on the System
For the content related to the profile of the legal status, capacity and corresponding experience, investors' feedback on the contents of E-KSQT, EHSMST, E-YCSBNLKN, investors declare on the webform and need to attach the 8c4n version of documents and documents proving legal status, capacity, and experience. In case there is a difference with the information declared between the webform and the information in the scanned documents. Documents proving legal status, capacity and experience attached, investors are required to clarify. The evaluation is based on the EHSQT, E-HSDST, E-Proposal E-HSDKTHDA and the investor's clarifying documents, including certification of information and standard documents.

At the end of the time limit for submission of E-HSQT, E-HSDST, E-Proposal, project implementation registration dossier, the bid solicitor, the project preparation unit or the agency or unit in charge of receiving the proposal dossier Producing PPP projects, the Department of Planning and Investment, the Economic Zone Management Board, for investment projects using land, the unit assigned by the competent authority to evaluate the project must organize bidding. in accordance with specialized laws and regulations on socialization of accessing the System and conducting E-HSQT assessment (in case the E-KSQT is made according to the provisions of Point b, Clause 1, Article 4 of this Circular), E-Proposal, project implementation registration documents submitted by investors.”
Accordingly, the submission of E-HSQT, E-HSDST, E-HSDKTHDA, application for PPP project implementation on the National Procurement Network shall comply with the above regulations.

“Article 21. Clarification, amendment, replacement, withdrawal of E-HSQT, E-HSDST, E-HSDKTHDA, application for registration of project implementation
1. Clarifying E-HSQT, E-HSDST, E-HSDKTHDA, application for registration of project implementation:
a) Investors are responsible for:
- Clarification of E-HSQT, E-HSDET, E-HSDKTHDA, application for registration of pre-printing at the request of the bid solicitor, the project preparation unit or the agency or unit in charge of receiving the proposal. When exporting a PPP project, the Department of Planning and Investment, the Economic Zone Authority, for investment projects using land, and the unit assigned by a competent authority for the project must organize bidding according to regulations. regulations on specialized laws, laws on socialization;
- Self-clarify and supplement documents proving legal status, capacity and experience when investors discover that the E-HSQT, E-HSDST, E-HSDKTHDA, project implementation registration documents lack information. , documents on their eligibility, capacity, experience but have not yet submitted to the department.
b) Clarification of E-HSQT, E-HSDST for PPP projects, E-HSDKTHDA for investment projects using land is done on the System. All requests for clarifications and clarifications from investors are made on the System. For projects, bidding must be organized in accordance with specialized laws and laws on tank society, in case detailed instructions are specified in Clause 3, Article 16 of Decree No. 25/2020 ND-CP. (amended at point b, clause 7, Article 108 of Decree No. 31/202/ND-CP) has been issued, the clarification is done on the System.”
Accordingly, the responsibility for clarifying the E-HSQT, E-HSDST, E-HSDKTHDA, and the application for registration of implementation of a PPP project shall comply with the above provisions. In particular, the investor must be responsible for clarifying the application for registration of PPP project implementation at the request of the bid solicitor.
Can investors in Vietnam withdraw their application for project implementation?
Pursuant to Clause 2, Article 21 of Circular 10/2022/TT-BKHDT stipulates as follows:
“Article 21. Clarification, amendment, replacement, withdrawal of E-HSQT, E-HSDST, E-HSDKTHDA, application for registration of project implementation
…
2. Amendment, replacement, withdrawal of E-HSQT, E-HSDST, E-HSDKTHDA, application for registration of project implementation:
a) After submitting, the investor can amend, replace or withdraw the E-HSQT, EHSDST, E-Proposal E-Bill, and the project implementation registration dossier for the project subject to bidding in accordance with the provisions of law. specialized law, the law on socialization in case the detailed instructions are specified in Clause 3, Article 16 of Decree No. 25/2020/ND-CP (amended at Point b, Clause 1, Article 108 of Decree No. No. 31/202L/ND-CP) was issued.
b) After the deadline for submission of E-HSQT, E-HSDST, E-HSDKTHDA, application for registration of project implementation, the investor may not withdraw the submitted application.”
Accordingly, after submitting the application for project implementation registration, the investor will still be able to withdraw or amend or replace the dossier according to the above provisions.
However, in case the time limit for submitting the application for registration of project implementation has expired, the investor will not be able to withdraw the submitted application for registration of project implementation.
Circular 10/2022/TT-BKHDT takes effect from August 1, 2022.
