Regulations on Support Levels for Participants in Security and Order Protection Forces at the Grassroots Level without Health Insurance, Who Fall Ill, Have an Accident, or Get Injured While Performing Duties

On April 16, 2024, the Government of Vietnam issued Decree 40/2024/ND-CPhttps://thuvienphapluat.vn/van-ban/Bo-may-hanh-chinh/Nghi-dinh-40-2024-ND-CP-huong-dan-Luat-Luc-luong-tham-gia-bao-ve-an-ninh-trat-tu-o-co-so-594281.aspx, detailing some provisions of the Law on Participants in Security and Order Protection Forces at the Grassroots Level.

According to Article 5 of Decree 40/2024/ND-CP, the support levels for participants in security and order protection forces at the grassroots level who do not have health insurance and fall ill, have an accident, or get injured while performing duties are specified as follows:

Participants in the security and order protection forces at the grassroots level are entitled to support for medical examination and treatment costs and daily meal money during the period of inpatient treatment until their health stabilizes and they are discharged from the hospital, according to the level decided by the provincial People's Council.

Additionally, the dossier to receive support includes:

- An application for payment of medical examination, treatment costs from the supported person who falls ill, has an accident, or gets injured or their legal representative.

- A copy of the payment receipt, hospital discharge paper.

When state management agencies complete the connection and sharing of information data from the dossier components specified in this clause, the competent authority must exploit it online to resolve it without requiring the applicant to provide paper documentation.

Furthermore, the resolution procedure is as follows:

- The applicant who falls ill, has an accident, or gets injured or their legal representative prepares one dossier set as prescribed and submits it to the Commune People's Committee or District People's Committee in one of the following forms:

+ Direct submission;

+ Via postal service;

+ Hiring service of enterprises, individuals;

+ Online submission at the National Public Service Portal or the Provincial Administrative Procedures Resolution Information System;

- The Commune People's Committee or District People's Committee is responsible for receiving and checking the dossier.

If the dossier is not valid, they must immediately guide its completion. Within two working days from the date of receiving a valid dossier, the receiving agency forwards the dossier to the District Labor, Invalids, and Social Affairs Department for appraisal;

- The District Labor, Invalids, and Social Affairs Department appraises the dossier within five working days from the date of receiving a valid dossier. If the dossier does not meet the conditions for resolution, the appraisal agency must issue a written response stating the reason;

- Within two working days from the date the District Labor, Invalids, and Social Affairs Department reports that the dossier meets the conditions for resolution, the District People's Committee Chairman issues a decision to pay the medical examination and treatment cost support for those who fall ill, have an accident, or get injured;

- Within three working days from the date the District People's Committee Chairman issues a decision to pay the cost, the Commune People's Committee is responsible for paying the medical examination and treatment costs to those who fall ill, have an accident, or get injured; where no commune administrative unit is organized, the district police pays; payment methods include account transfer, postal service, or direct receipt at the paying agency.

What Are the Duties of the Security and Order Protection Forces at the Grassroots Level?

In Chapter II of the 2023 Law on Participants in Security and Order Protection Forces at the Grassroots Level, the duties of the security and order protection forces at the grassroots level are specified as follows:

- Support in grasping the situation regarding security and order.

- Support in building the nationwide movement for the protection of national security.

- Support in fire prevention, firefighting, rescue, and relief.

- Support in administrative management regarding social order.

- Support in mobilizing and educating individuals with legal violations residing at the grassroots.

- Support in patrolling to ensure security, order, and traffic safety; perform tasks of protecting security and order when mobilized.

What Are the Allowances for Participants in Security and Order Protection Forces at the Grassroots Level?

The allowances for participants in the security and order protection forces at the grassroots level are as follows:

*While on duty

- Regular monthly support money.

- Support money for voluntary social insurance and health insurance as decided by the provincial People's Council.

- Allowances and bounties when assigned for training, performing duties as assigned by competent authorities, or mobilized for mission execution (Detailed allowances are specified in Article 23 of the 2023 Law on Participants in Security and Order Protection Forces at the Grassroots Level).

*In case of illness, accident, death, or injury while performing duties (More details can be found in Article 24 of the 2023 Law on Participants in Security and Order Protection Forces at the Grassroots Level):

- If they have participated in social insurance and health insurance: Benefits follow legal regulations.

- If they haven't participated in health insurance and fall ill or have an accident: Medical examination and treatment costs will be paid.

- If they haven't participated in social insurance and have an accident, leading to a decrease in working capacity: Consideration for allowance according to the level of disability. In case of death, the dependents will receive a survivor allowance and funeral expenses.

- If injured or killed while on duty: They are entitled to benefits and policies for war invalids or recognized as martyrs and other related rights.

Decree 40/2024/ND-CP takes effect from July 1, 2024.

The 2023 Law on Participants in Security and Order Protection Forces at the Grassroots Level takes effect from July 1, 2024.
