What are the regulations on advertisements on billboards and banners in Vietnam?

Pursuant to the provisions of Article 27 of the 2012 Law on Advertising in Vietnam, advertisements on billboards and banners must comply with the following regulations:

- The positions of billboards and banners must comply with law provisions on cultural and historical relic protection area, safe traffic corridor, dykes and national electric network; must not block out the traffic lights and public road signs; must not cross the roads and must comply with the local advertising planning and the technical regulations promulgated by competent agencies.

- The advertisements on the billboards and banners must specify the names and address of their maker.

- The advertisements on billboards and banners being political and social policy propagation must comply with the following provisions:

+ The symbols, logos and brand names of the advertisers must be put at the bottom of the billboards and vertical banners, or on the right of the horizontal banners;

+ The area for displaying the symbols, logos and brand names of the advertisers must not exceed 20% of the billboard and banner area.

- The time limit for putting up a banner is 15 days.

What are the regulations on the dossier on billboard, banner advertisement notification in Vietnam?

Pursuant to the provisions of Article 29 of the 2012 Law on Advertising in Vietnam, the dossier on billboard, banner advertisement notification is as follows:

- The written notification of billboard, banner advertisements must specify the contents, time and place of advertisements, the quantity of billboards, banners.

- The copy of the Certificate of business registration of the advertising service provider or the Certificate of business registration of the advertiser in case of self-advertising.

- The copies of documents proving the conformity and qualifications of products, goods and services as prescribed by law, or papers proving the eligibility for advertising as prescribed in Article 20 of this Law.

- The copies of the event documents from the organizer for advertisements of social policies and events.

- The color design marquette of the advertisements with the signature of the advertising service provider or the advertiser in case of self-advertising. For advertisers and advertising service providers being organizations, the seal of the organization is required.

- Documents proving the ownership or the right to use the billboard; the ownership or the right to use the advertising location for banners

- The perspective drawing of the billboard location.

- The copy of the license to build advertising constructions regarding the billboards subject to construction licenses as prescribed in Clause 2 Article 31 of the 2012 Law on Advertising in Vietnam.

What are the regulations on the procedures for notifying billboard, banner advertisements in Vietnam?

Pursuant to Article 30 of the 2012 Law on Advertising in Vietnam, the procedures for notifying billboard, banner advertisements are as follows:

- Organizations and individuals demanding advertising on billboards and banners must send the dossier on advertisement notification to local competent agencies in charge of advertising management before the advertisement 15 days.

- If there is no response within 05 working days as from the day the local competent agency in charge of advertising management confirm the dossier reception, the organization or individual is entitled to perform the notified advertisements In case the local competent agency in charge of advertising management does not approve, the written response specifying the reasons must be sent.

What is the administrative penalty for violations against regulations on advertising on billboards and banners in Vietnam?

Pursuant to the provisions of Article 42 of Decree No. 38/2021/ND-CP stipulating the administrative penalty for violations against regulations on advertising on billboards, banners and screens as follows:

A fine ranging from 1,000,000 VND to 2,000,000 VND

- Hanging, erecting, placing and installing each billboard, banner or screen for outdoor advertising purposes at the locations different from the planned ones or the ones approved by competent state authorities;

- Failing to clarify name, address of the advertising maker on each billboard or banner.

A fine ranging from VND 2,000,000 to VND 5,000,000

- Advertising in excess of the prescribed space of a billboard, banner or screen at the planned position or the position approved by competent state authorities;

- Failing to, on their own initiative, remove the banner exceeding the time limit stated in the notice; failing to, on their own initiative, remove billboards or banners that are torn, broken or unaesthetic.

A fine ranging from VND 5,000,000 to VND 10,000,000

- Placing emblems, logos and trademarks of advertisers at the positions different from the prescribed ones on billboards or banners containing political or political-social propaganda;

- Representing logos or trademarks of products covering space greater than the allowable space that they may occupy on billboards or banners containing political or political-social propaganda;

- Displaying advertisements on billboards and banners that are in breach of regulations on protected perimeters of historical - cultural relics; safety corridors of roads, dykes or national power grids; obscure traffic lights; block roads or public signage;

- Making modifications to falsify advertisement contents that are already notified to competent state authorities;

- Incorrectly notifying advertisement contents displayed on billboards or banners to competent state authorities of the places where advertising activities are carried out.

A fine ranging from VND 10,000,000 to VND 15,000,000

- Using sounds on outdoor screens;

- Failing to make a notice of contents, time, and location of advertisement, quantity of billboards or banners.

Note: This is the fine level imposed upon individuals, for organizations, the fine level is doubled as prescribed in Clause 2, Article 5 of Decree No. 38/2021/ND-CP.
