What is the National technical regulation QCVN 05:2023/BTNMT on air quality in Vietnam?

National technical regulation QCVN 05:2023/BTNMT compiled by the Department of Environmental Pollution Control, Department of Science and Technology, Department of Legal Affairs; The Ministry of Science and Technology appraised and issued according to Circular 01/2023/TT-BTNMT dated March 13, 2023 of the Minister of Natural Resources and Environment.

National technical regulation QCVN 05:2023/BTNMT regulates the maximum limit values of basic parameters and toxic parameters in ambient air.

National technical regulation QCVN 05:2023/BTNMT applies to monitor and evaluate ambient air quality.

National technical regulation QCVN 05:2023/BTNMT does not apply to indoor air.

National technical regulation QCVN 05:2023/BTNMT applies to state environmental management agencies and all organizations, communities, households and individuals with air quality-related activities in the territory of Vietnam.

- In addition to the above monitoring methods, accept monitoring results from automatic, continuous air quality monitoring equipment that meets the requirements for technical characteristics according to the provisions of law.

Who is responsible for responsibility for air quality management in Vietnam?

Pursuant to the provisions of Article 14 of the Law on Environmental Protection 2020, responsibility for air quality management are prescribed as follows:

- The Prime Minister shall promulgate and provide instructions on implementation of the national air quality management plan; provide instructions on implementation of emergency measures in the case of inter-provincial, regional or cross-border serious air pollution.

- The Ministry of Natural Resources and Environment shall:

+ formulate and submit to the Prime Minister the national air quality management plan and organize the implementation thereof;

+ provide guidance on formulating provincial air quality management plans and air quality assessment methods.

- People’s Committees of provinces shall:

+ formulate and organize the implementation of provincial air quality management plans;

+ assess, monitor and publish information about air quality; warn residential communities of and take measures to remediate air pollution that impacts community health;

+ organize the implementation of emergency measures if serious air pollution occurs in their provinces.

Thus, the air environment management is the responsibility of the Ministry of Natural Resources and Environment and the Provincial People's Committee directed by the Prime Minister.
