Submission to the Government of Vietnam for the 2024 Lunar New Year and National Day holiday plans for officials and public employees?

On October 27, 2023, the Ministry of Labor, Invalids and Social Affairs submitted to the Government of Vietnam a proposal for the 2024 Lunar New Year and National Day holiday plans for officials, public employees, and workers in administrative agencies, careers, political organizations, socio-political organizations, and enterprises.

For officials and public employees

*2024 Lunar New Year Holiday Schedule

Proposal 1:

For officials and public employees, the Ministry of Labor, Invalids and Social Affairs proposes, and most ministries and agencies agree, to a 5-day holiday according to regulations, with a break of 2 days before the Lunar New Year and 3 days after.

Officials and public employees would have the 2024 Lunar New Year holiday from Thursday, February 8, 2024, to Wednesday, February 14, 2024 (from the 29th day of the twelfth lunar month of the Year of the Cat to the 5th day of the first lunar month of the Year of the Dragon).

With the proposal by the Ministry of Labor, Invalids and Social Affairs, supported by most ministries and agencies, officials and public employees will have a 7-day holiday period (including 5 Lunar New Year holidays and 2 compensatory weekend holidays as per Clause 3, Article 111 of the Labor Code).

Besides the proposal by the Ministry of Labor, Invalids, and Social Affairs, there is a second option for the Government of Vietnam to consider.

Proposal 2: is to have a 5-day holiday according to regulations, including 1 day before the Lunar New Year and 4 days after.

Officials and public employees would have the 2024 Lunar New Year holiday from Friday, February 9, 2024, to Thursday, February 15, 2024 (from the 30th day of the twelfth lunar month of the Year of the Cat to the 6th day of the first lunar month of the Year of the Dragon). With this option, the Lunar New Year holiday for officials and public employees will also be 7 days.

Proposal recommendation: The Ministry of Labor, Invalids and Social Affairs recommends Proposal 1 for the Lunar New Year holiday. Reason: Both proposals have the same number of holidays, but Proposal 1 ensures a balanced holiday period before and after the Lunar New Year (this proposal has been unanimously agreed upon by all related ministries and agencies).

*2024 National Day Holiday Schedule

- Proposal 1: A 2-day holiday according to regulations, including September 2 of the solar calendar and 1 consecutive day after September 2.

Officials and public employees will have a holiday from Saturday, August 31, 2024, to Tuesday, September 3, 2024. Therefore, with this proposal, the 2024 National Day holiday for officials and public employees will be 4 days (including 2 National Day holidays and 2 weekend holidays).

- Proposal 2: A 2-day holiday according to regulations, including September 2 of the solar calendar and 1 consecutive day before September 2.

Officials and public employees will have 4 consecutive days off from Saturday, August 31, 2024, to Tuesday, September 3, 2024. Therefore, with this proposal, the 2024 National Day holiday for officials and public employees will be 4 days (including 2 National Day holidays, 1 weekend holiday, and 1 compensatory weekend holiday according to Clause 3, Article 111 of the Labor Code).

Proposal recommendation: The Ministry of Labor, Invalids and Social Affairs recommends Proposal 1 for the 2024 National Day holiday. Reason: Both proposals have a continuous 4-day holiday from Saturday, August 31, 2024, to Tuesday, September 3, 2024, but Proposal 1 has the advantage of reducing administrative procedures and not requiring the arrangement of compensatory weekend holidays according to Clause 3, Article 111 of the Labor Code (this proposal has been unanimously agreed upon by all related ministries and agencies).

For workers in the enterprise sector

Based on actual conditions and the holiday schedule for officials and public employees, employers will arrange the Lunar New Year and National Day holidays for workers as follows (encouraging employers to apply the same Lunar New Year holiday schedule for workers as for officials and public employees):

- For the 2024 Lunar New Year holiday:

+ Choose either 1 day before the Lunar New Year and 4 days after, or 2 days before the Lunar New Year and 3 days after, or 3 days before the Lunar New Year and 2 days after.

+ Notify the Lunar New Year holiday plan to workers at least 30 days before implementation.

- For the 2024 National Day holiday:

Employers decide to give workers 2 days off (September 2 of the solar calendar and 1 consecutive day before or after).

- If a weekly holiday coincides with the Lunar New Year or National Day holiday, the employer will arrange compensatory weekly holidays for workers on the next working day according to Clause 3, Article 111 of the Labor Code.

How much do workers get paid for working on holidays and Tet?

According to Article 98 of the 2019 Labor Code which defines overtime and night work pay:

Overtime and night work pay

1. Workers working overtime are paid based on the wage rate or the paid wages for the current job as follows:

a) On regular days, at least 150%;

b) On weekends, at least 200%;

c) On public holidays, Tet, paid leave days, at least 300% excluding the wages for public holidays, Tet, paid leave days for workers who receive daily wages.

2. Workers working at night are paid an additional wage of at least 30% based on the wage rate or the paid wages for the current job of an ordinary working day.

3. Workers working overtime at night are paid an additional wage of 20% based on the wage rate or the paid wages for the current job during the daytime of an ordinary working day or a weekend or public holidays, Tet.

4. The Government of Vietnam will provide detailed regulations for this Article.

Therefore, according to the above regulations, workers who work during Tet in 2024 will receive the following pay:- At least 300% excluding the wages for public holidays, Tet, paid leave days for workers who receive daily wages.- Workers working at night are paid an additional wage of at least 30% based on the wage rate or the paid wages for the current job of an ordinary working day and an additional wage of 20% based on the wage rate or the paid wages for the current job during the daytime of public holidays, Tet.
