Proposal to Amend the Law on Citizen Identification According to Resolution 03/ND-CP of 2023?

Section 2 of Resolution 03/ND-CP of 2023 issued on January 6, 2023, records the following content:

The Ministry of Public Security has thoroughly prepared and takes the lead in developing the Proposal for the Law on Citizen Identification (amended) appropriately; promptly updating and institutionalizing the perspectives and policies of the Communist Party on promoting the application of information technology, administrative procedure reform; leveraging the positive results achieved, addressing the existing shortcomings to meet the requirements of state management on population, and effectively promoting digital transformation to serve socio-economic development in the coming period.

There is a basic agreement with the policies in the Proposal for developing the Law on: Policy 1, which stipulates the integration of information in the Citizen Identification card; Policy 2, which adds information stored in the National Population Database, Citizen Identification Database; Policy 3, which adds subjects eligible for the Citizen Identification card and the Identity Certification; Policy 4, which perfects the regulations on managing, operating, exploiting, and using information in the National Population Database and the Citizen Identification Database.

The Ministry of Public Security is promptly taking the lead, in cooperation with the Ministry of Justice, the Office of the Government of Vietnam, and relevant agencies to fully absorb the opinions of the Government Members, perfecting the Proposal for the law as follows:

- Review specific regulations, thoroughly assess the positive and negative impacts of proposed policies to increase persuasiveness for the proposed options, ensuring compliance with the Constitution and laws, especially regulations on integrating information in the National Population Database and the Citizen Identification Database; ensuring the privacy of personal life, individual privacy, family privacy; protecting confidential information for the armed forces and the feasibility of implementation on the necessity and roadmap for integrating personal information, collecting biometric data...

- Review and study clear, specific decentralization and delegation, ensuring the synchronization, consistency, and feasibility of the legal system.

- Coordinate with the Ministry of Justice and relevant ministries, agencies to review and thoroughly assess policy impacts, creating consensus on several contents regarding: issuing Citizen Identification cards to Vietnamese citizens under 14 years old; issuing Identity Certificates to people of Vietnamese origin who are stateless residing in Vietnam.

- Regulations on principles in the Law and authorizing the Government of Vietnam to stipulate the contents not yet stable, ensuring flexibility and practicality regarding: managing, operating, exploiting, and using information in the National Population Database, Citizen Identification Database; electronic identity accounts and the use of electronic identity accounts.

The Ministry of Public Security will complete the Proposal for developing the Law according to the provisions of the Law on the Issuance of Legal Documents, and send it to the Ministry of Justice for consolidation and inclusion in the legislative program for 2023 to submit to the National Assembly for comments at the 5th session and approval at the 6th session of the 15th National Assembly.

Proposal to Abolish the National Identity Card as of January 1, 2025?

The latest draft amendment to the Law on Citizen Identification proposes the timeframe for the validity of the national identity card. Specifically:

The national identity card, which is still valid and issued before this Law takes effect, can be used until December 31, 2024;

At the same time, the draft Law also clearly states: All legally valid documents that utilize information from the national identity card remain legally valid.

State management agencies are not allowed to stipulate procedures for correcting, changing information related to national identity cards, and Citizen Identification cards in the aforementioned documents.

Thus, according to this proposal, the valid national identity card will continue to be used until December 31, 2024, meaning the national identity card will officially be abolished as of January 1, 2025.

Proposal to Issue Citizen Identification Card to Individuals Under 14 Years Old?

Regarding the individuals eligible for the Citizen Identification card, the draft amendment to the Law on Citizen Identification proposes the following amendments and supplements:

Supplementing regulations on managing and issuing Citizen Identification cards to Vietnamese citizens under 14 years old and issuing Identity Certificates to people of Vietnamese origin to ensure their legitimate rights and interests, and serving state management tasks; promoting the value and utility of the Citizen Identification card in digital government and digital society activities.

Thus, if this proposal is approved, the subjects eligible for the Citizen Identification card include:

- Individuals eligible for the Citizen Identification card are Vietnamese citizens.

- Individuals aged 14 and above must be issued a Citizen Identification card.

- Individuals under 14 years old may be issued a Citizen Identification card upon request.

Proposal to Remove Fingerprints from the Citizen Identification Card?

On this matter, the draft amendment to the Law on Citizen Identification regarding the content on the Citizen Identification card proposes the following amendments and supplements:

- Remove fingerprints;

- Amend information such as the card number, place of origin, permanent residence, the issuer's signature in the 2014 Law on Citizen Identification to personal identification number, birthplace registration, residence and the phrase "Issued by: Ministry of Public Security" to match other amended and supplemented contents in the draft Law.

After the amendment, the information printed on the Citizen Identification card is expected to include:

- National emblem of the Socialist Republic of Vietnam;

- The phrase "Socialist Republic of Vietnam, Independence - Freedom - Happiness";

- The phrase "Citizen Identification";

- Facial image;

- Personal Identification number;

- Full name;

- Date of birth;

- Gender;

- Birthplace registration;

- Nationality;

- Residence;

- Date of issue and expiration date;

- The phrase "Issued by: Ministry of Public Security".
