New Circular 41/2023/TT-BQP on statutory pay rate and military rank allowances?

The Ministry of National Defense has just issued Circular 41/2023/TT-BQP, guiding the implementation of the statutory pay rate for those currently receiving salaries or military rank allowances from the state budget in agencies and units under the Ministry of National Defense.

To be specific, Article 2 of Circular 41/2023/TT-BQP specifies as follows:

Applicability

1. Officers, professional soldiers, non-commissioned officers, enlisted soldiers, defense workers, public employees, and defense officials.

2. Cryptography personnel who are not soldiers, People's Public Security; other personnel in cryptography organizations; cryptography cadets receiving living allowances (hereinafter referred to as cryptography cadets).

3. Persons working under policies of labor contracts with salaries classified according to Decree No. 204/2004/ND-CP dated December 14, 2004, of the Government of Vietnam on salary policies for officials and public employees and armed forces (hereinafter referred to as Decree No. 204/2004/ND-CP).

The individuals guided for implementation of the statutory pay rate include those currently receiving salaries or military rank allowances from the state budget in agencies and units under the Ministry of National Defense. They include:

- Officers, professional soldiers, non-commissioned officers, enlisted soldiers, defense workers, public employees, and defense officials.

- Cryptography personnel who are not soldiers, People's Public Security; other personnel in cryptography organizations; cryptography cadets receiving living allowances.

- Persons working under policies of labor contracts with salaries classified according to Decree No. 204/2004/ND-CP.

Additionally, based on the provisions of Article 5 of Circular 41/2023/TT-BQP, it is regulated as follows:

Effective date

1. This Circular shall take effect from August 12, 2023; Circular No. 79/2019/TT-BQP dated June 11, 2019, of the Minister of National Defense guiding the implementation of the statutory pay rate for those receiving salaries or military rank allowances from the state budget in agencies and units under the Ministry of National Defense shall be null and void from the date this Circular takes effect.

2. Policies stipulated in this Circular shall be implemented from July 01, 2023.

3. In case the legal documents referenced in this Circular are amended, supplemented, or replaced, the implementation shall follow the amended, supplemented, or replaced documents accordingly.

What bases are used to calculate the statutory pay rate?

According to Decree 24/2023/ND-CP, the statutory pay rate is used as the basis to: Calculate salary levels in salary tables, allowances, and implement other policies according to the law for the specified subjects; calculate operational expenses and living allowances as prescribed by law; calculate deductions and policies enjoyed according to the statutory pay rate.

In addition, specific financial and income mechanisms will continue to be implemented for agencies and units currently applying specific financial and income mechanisms at the central level, as stipulated by competent authorities, until comprehensive wage policy reforms are enacted in accordance with Resolution 27-NQ/TW dated May 21, 2018, of the Seventh Central Committee Meeting of the 12th Term.

Monthly salaries and increased incomes calculated according to the statutory pay rate of 1,800,000 VND/month from July 01, 2023, according to specific mechanisms, ensure that they do not exceed the average salaries and increased incomes of 2022 (excluding salary increases and additional incomes due to salary step adjustments when raising steps or ranks).

The Government of Vietnam shall submit to the National Assembly for consideration the adjustment of the statutory pay rate in line with the state budget's capacity, consumer price index, and economic growth rate of the country.
