I am living in Hanoi and have been divorced from my husband for 3 years. My son followed her husband to Australia and studied there for a while. Currently, he wishes to return to Vietnam to study and live with me. May I ask how is the procedure for receiving Vietnamese from abroad to study in Hanoi? Thank you very much!

What is the way to receive the Vietnamese student returning home to study in Hanoi?

On May 11, 2022, Hanoi people's committee issued Decision No. 1543/QD-UBND announcing the list of administrative procedures and administrative procedures in which secondary education is repealed within the state management function of Hanoi Department of Education and Training

In Section 2, Part A and Section 2, Part B, Chapter I, the Annex to the Decision No. 1543/QD-UBND prescribes on announcement of procedures for receiving Vietnamese students coming back home as follows:

- Admission of pupils of senior secondary schools in Vietnam who return home:

+ The decision-making authority: Hanoi Department of Education and Training.

+ Implementation location: The One-stop Shop of the Hanoi Department of Education and Training shall be located at the address No. 23A Quang Trung, Hoan Kiem District, Hanoi.

+ The application shall be submitted directly or by post or online through the public service portal.

- Admitting Vietnamese middle school pupils who return home:

+ The handling competence: The People's Committees of districts

+ Implementing location: One-stop Shop of the People's Committees of districts

+ The application shall be submitted directly or by post or online through the public service portal.

Accordingly, the decision-making authority over admission of students from Vietnam's upper secondary school to the Department of Education and Training of Hanoi City. The district-level People's Committees shall be competent to admit junior secondary pupils who return to Vietnam.

What are the conditions for students from Vietnam to study abroad to study in the country?

In accordance with Article 8 of the Decision No. 51/2002/QD-BGDDT (amended by Clause 1 Article 1 of the Circular No. 50/2021/TT-BGDDT) on requirements for qualifications:

"Article 8. Article 6.- Diploma conditions

1. Lower secondary school.

Pupils entering junior secondary schools must have study result records or written certifications of the previous classes' study results, together with the schools' certifications of their transfer to the above classes.

2. Senior secondary education

Pupils who are enrolled in senior secondary schools must have diplomas or certificates of junior secondary education graduation equivalent to Vietnam's junior secondary education graduation diplomas.

3. Students who have studied in Vietnam, after studying abroad, must have diplomas of educational levels graduated in Vietnam upon returning home."

Accordingly, for study in Vietnam, Vietnamese pupils returning home must satisfy the conditions on diplomas suitable to each grade of study in Vietnam.

Pursuant to Article 9 of the Decision No. 51/2002/QD-BGDDT (amended by Clause 2 Article 1 of the Circular No. 50/2021/TT-BGDDT) on requirements for ages and curricula pertaining to Vietnamese students returning from overseas:

"Article 9. Article 9.- Conditions on ages and curricula
1. Vietnamese pupils returning home for study may be 3 years older than the age group prescribed for each educational level.
2. Study program:
a/ A program of study abroad must have contents equivalent to those of Vietnam's education programs with study subjects being natural sciences. For study subjects belonging to the group of social sciences and humanities, pupils must be complemented with knowledge suitable to Vietnam's educational programs.
b/ For pupils who have not yet studied in the curricula of a grade abroad and wish to continue their study at equivalent grades at junior or or senior secondary schools in Vietnam, they must be tested by the schools which they received in order to study according to the curricula set for such grade.
c) Students who wish to study specialized upper secondary schools (ethnic boarding schools, specialized schools, gifted schools) shall comply with the regulations of such specialized schools."

Therefore, Vietnamese students returning from foreign countries will be extended 3 years of age compared with age prescribed for each educational level. Regarding the overseas study program, there must be contents equivalent to those of natural subjects in Vietnam. Pupils must take additional knowledge of the social sciences subject in order to suit the Vietnamese educational program.

What are the records for students of Vietnam from abroad to study in Vietnam?

In accordance with Article 10 of the Regulation promulgated together with the Decision No. 51/2002/QD-BGDDT (amended by Clause 3 Article 1 and Clause 1 Article 2 of the Circular No. 50/2021/TT-BGDDT), regulations on student profiles shall be implemented as follows:

"Article 10. The study result register.
1. The study application shall be signed by the father, mother or guardian.
2. The study dossier includes:
a) The study result register or the confirmation of the school about the previous classes (authenticated Vietnamese translation).
b) The certificate of graduation of the classes or levels of lower education in foreign country (the original and the Vietnamese translation).
c) The diploma of lower educational level in Vietnam before going abroad (if any).
d) The copy of birth certificate, including the pupils born abroad."

Accordingly, the sub-parents should prepare a complete dossier including the above components for submission to the competent authority.

Under Article 11 of the Regulation promulgated together with Decision No. 51/2002/QD-BGDDT, the procedures for admission of Vietnamese students back to the country are as follows:

"Article 11. Article 11.- Admittance procedures
1. The provincial/municipal Education and Training Services (for the senior secondary education level) or the district-level Education and Training Sections (for the junior secondary education level) shall receive and check the dossiers and introduce the pupils to schools.
2. For pupils mentioned at Point b, Clause 2, Article 9 of this Regulation, schools shall organize tests of their qualifications. For study subjects not included in Vietnam's educational program, requesting pupils to finish their study subjects and take the post-course exam."
