Procedures for Issuing International Travel Service Business Licenses
Pursuant to the provisions of Article 33 Tourism Law 2017, the procedures for issuing international travel service business licenses are as follows:
(1) Enterprises applying for the International Travel Service Business License must submit one set of documents to the Vietnam National Administration of Tourism.
Documents required for the application for the International Travel Service Business License include:
- An application form for the International Travel Service Business License as prescribed by the Minister of Culture, Sports, and Tourism;- A certified copy of the Business Registration Certificate or Investment Registration Certificate issued by the competent state agency;- Certificate of deposit for international travel service business;- A certified copy of the diploma or certificate of the person in charge of travel service business as specified at point c, clause 2, Article 31 of the Tourism Law 2017;- A certified copy of the appointment decision or labor contract between the travel service business enterprise and the person in charge of travel service business.
(2) Within 10 days from the date of receiving a valid dossier, the Vietnam National Administration of Tourism shall appraise and issue the International Travel Service Business License to the enterprise and notify the specialized tourism agency at the provincial level where the enterprise is headquartered.
In case of refusal, a written notice must be provided clearly stating the reasons.
Procedures for issuing international travel service business license and domestic travel service business license
Procedures for Issuing Domestic Travel Service Business Licenses
Pursuant to the provisions of Article 32 Tourism Law 2017, the procedures for issuing domestic travel service business licenses are as follows:
(1) Enterprises applying for a Domestic Travel Service Business License must submit one set of documents to the specialized tourism agency at the provincial level where the enterprise is headquartered.
Documents required for the application for the Domestic Travel Service Business License include:
- An application form for the Domestic Travel Service Business License as prescribed by the Minister of Culture, Sports, and Tourism;- A certified copy of the Business Registration Certificate;- Certificate of deposit for domestic travel service business;- A certified copy of the appointment decision or labor contract between the travel service business enterprise and the person in charge of travel service business;- A certified copy of the diploma or certificate of the person in charge of travel service business as specified at point c, clause 1, Article 31 of the Tourism Law 2017.
(2) Within 10 days from the date of receiving a valid dossier, the specialized tourism agency at the provincial level shall appraise and issue the Domestic Travel Service Business License to the enterprise.
In case of refusal, a written notice must be provided clearly stating the reasons.
Rights and Obligations of Enterprises Engaged in Domestic Travel Services
Pursuant to the provisions of Article 37 Tourism Law 2017, the rights and obligations of enterprises engaged in domestic travel services are as follows:
- Develop, advertise, sell, and organize the implementation of travel services and travel programs for tourists within the scope of business specified in the license;- Ensure to maintain the conditions for providing travel services as prescribed in clause 1, Article 31 of the Tourism Law 2017 and publicly display the enterprise name, travel service business license number at the headquarters, branch offices, transaction offices, on travel contracts, advertising publications, and in electronic transactions;- Notify changes of the person in charge of travel service business and submit dossiers about the replacement person to the competent state agency issuing the license within 15 days from the date of change;- Provide information about travel programs, services, and destinations to tourists;- Purchase insurance for tourists during the travel program, except when tourists already have insurance for the entire travel program;- Use tour guides to guide tourists in accordance with travel contracts and be responsible for the activities of tour guides during the time they guide tourists under the contracts;- Comply with, disseminate, and guide tourists to comply with laws and regulations of tourist destinations; behave civilly, respect the cultural identity, customs, and practices of Vietnam and tourist destinations; cooperate with competent state agencies to promptly handle violations of the law by tourists during the travel program;- Implement policies on reporting, statistics, accounting, and record keeping as prescribed by law;- Apply measures to ensure the safety of lives, health, and property of tourists; promptly notify competent state agencies about accidents or risks occurring to tourists and take measures to mitigate the consequences;- Manage tourists according to the agreed travel programs with tourists.
Conditions for Operating Travel Services
Pursuant to the provisions of Article 31 Tourism Law 2017, the conditions for operating travel services are as follows:
Conditions for operating domestic travel services include:
- Being an enterprise established according to the provisions of the law on enterprises;- Depositing for domestic travel service business at a bank;- The person in charge of travel service business must have graduated from a secondary school or higher in the field of travel; if graduated from a secondary school or higher in another field, a certificate of professional training in domestic travel management is required.
Conditions for operating international travel services include:
- Being an enterprise established according to the provisions of the law on enterprises;- Depositing for international travel service business at a bank;- The person in charge of travel service business must have graduated from a college or higher in the field of travel; if graduated from a college or higher in another field, a certificate of professional training in international travel management is required.
