Procedures for Issuing Train Operator Licenses for Drivers on Operational Railway Lines
Pursuant to Article 30 of Circular 15/2023/TT-BGTVT, the regulations are as follows:
Procedures for issuing train operator licenses for drivers on operational railway lines
1. Application dossier for the examination for train operator license
a) The original paper document or electronic version of the application submitted by the railway business enterprise (hereinafter referred to as the enterprise) requesting the examination and issuance of train operator licenses, according to the form stipulated in Appendix IV issued together with this Circular;
b) Individual's dossier:
The original or electronic version of the application for the examination for the train operator license as per the form stipulated in Appendix V issued together with this Circular;
The original, electronic version, certified copy, or certified electronic copy of the health certification for train operators as stipulated by the Minister of Health;
Certified copies or certified electronic copies of diplomas or certificates specialized in rail transport vehicle operation appropriate to the type of vehicle under examination;
03 color photos sized 3x4cm, taken or electronic versions taken within 06 months from the date of submission of the dossier.
2. Forms of dossier submission
The enterprise submits 01 set of dossiers to the agency granting the train operator license through one of the following methods:
a) Directly at the one-stop service section;
b) Through the online public service portal or the national online public service portal;
c) Through the postal system or other appropriate methods.
3. The agency granting the train operator license receives and inspects the dossier
a) In case the dossier does not comply with the regulations, within 01 working day from the date of receipt via the one-stop service section or through the online public service portal; 02 working days from the date of receipt by other methods, the licensing authority is responsible for notifying and guiding the enterprise to complete the dossier as per regulations;
b) In case the dossier is complete and compliant with the regulations, the licensing authority proceeds with the procedures as stipulated in clause 4 of this Article.
4. Organizing the examination for the issuance of the train operator license
a) Within 02 working days from the date of receiving a complete and compliant dossier, the licensing authority issues a decision to organize the examination, establishes an examination council, and notifies the enterprise in writing. The decision to organize the examination must clearly state the form of theoretical examination (written or multiple-choice), the list of candidates eligible for the examination, the type of train operator license enrolled for examination, and the type of vehicle under examination for each candidate;
b) Within a maximum of 03 months from the date of the establishment decision, the examination council cooperates with enterprises to organize the examination according to the content and procedure stipulated in this Circular, and reports the results to the licensing authority. If the examination cannot be completed within the specified time, the council must report to the licensing authority, stating the reason, and propose an extension or conclusion of the examination. The extension period is once and must not exceed 01 month;
c) Within 03 working days from the date of the examination result report, the licensing authority issues a train operator license to those who meet the requirements. For those who are not issued a license, the licensing authority notifies the enterprise in writing, stating the reason.
Thus, procedures for issuing train operator licenses for drivers on operational railway lines are carried out according to the above regulations.

Under which circumstances will the train operator license be revoked according to the latest regulations of the Ministry of Transport?
Pursuant to Article 34 of Circular 15/2023/TT-BGTVT, the regulations state:
Revocation of train operator licenses
1. Train operator licenses will be revoked in the following cases:
a) Issued to individuals who do not meet the conditions stipulated in Article 28 of this Circular;
b) Fraudulent actions in the dossier application process for issuance or re-issuance as stipulated in Articles 30, 31, 32, 33 of this Circular.
2. The licensing agency is responsible for issuing a decision to revoke the train operator license; the enterprise directly managing the train operator is responsible for revoking the license and sending it to the licensing agency.
Thus, train operator licenses will be revoked in the following circumstances:
- Issued to individuals who do not meet the conditions stipulated;- Fraudulent actions in the dossier application process for issuance or re-issuance of the train operator license.
In which cases will a train operator license be reissued?
According to Article 33 of Circular 15/2023/TT-BGTVT, the regulations state:
Procedures for reissuing train operator licenses
1. Train operator licenses will be reissued in the following cases:
a) Expiry;
b) Damaged or lost.
Thus, train operator licenses will be reissued in the following cases:
- Expiry;- Damaged or lost.
Circular 15/2023/TT-BGTVT takes effect from September 01, 2023.
