According to the provisions of Clause 1, Article 87 Decree 96/2023/ND-CP, the conditions for implementing telemedicine are specified as follows:

- Must be performed by practicing professionals of a medical examination and treatment facility, belonging to one of the following organizational forms:

(1) Hospitals including the following forms:

- General hospitals;

- Traditional medicine hospitals;

- Odonto-Stomatology hospitals;

- Specialized hospitals.

(2) Clinics including the following forms:

- General clinics;

- Specialized clinics;

- Multi-specialty clinics;

- Medical doctor clinics;

- Traditional medicine clinics;

- Odonto-stomatology clinics;

- Nutrition clinics;

- General medical practitioner clinics.

(3) Health stations.

(4) Maternity homes.

(5) Traditional medicine diagnosis and treatment rooms.

(6) Paraclinical service facilities including the following forms:

- Testing facilities;

- Diagnostic imaging facilities;

- Testing and diagnostic imaging facilities.

(7) Family medicine facilities.

(8) Dental prosthetic technology facilities.

(9) Rehabilitation technology facilities.

(10) Clinical psychology facilities.

(11) Nursing service facilities.

(12) Maternity service facilities.

(13) Palliative care facilities.

(14) Outpatient emergency facilities.

(15) Optical facilities that perform the measurement and examination of refractive errors.

(16) Dialysis facilities.

- Must have a professional scope appropriate to the content of telemedicine of the facility;

- Must have sufficient practicing professionals according to the scope of telemedicine of the facility;

- Must have appropriate technical infrastructure, information technology equipment, specialized equipment, and information technology software to ensure the safe, secure transmission, display, processing, and storage of data. Ensuring the storage time and data backup meets the legal regulations.

What does the dossier for declaring sufficient conditions for implementing telemedicine include?

According to the provisions of Clause 2, Article 87 Decree 96/2023/ND-CP, the dossier for declaring sufficient conditions for implementing telemedicine includes:

(1) A written request to implement telemedicine, clearly stating the start time of telemedicine;

(2) A valid copy of the medical examination and treatment operation license of the facility (not applicable to the case where the operation license has been connected, shared on the Information System for managing medical examination and treatment activities or the national health database);

(3) A list of registered practitioners along with the practicing license numbers of the facility, if the operation license has been connected, shared on the Information System for managing medical examination and treatment activities or the national health database. If the operation license has not been connected, shared on the Information System for managing medical examination and treatment activities or the national health database, then a valid copy of the practicing license of each practicing person participating in telemedicine must be submitted;

(4) A list of services performing telemedicine;

(5) Evidence documents proving compliance with the conditions stated in (4)

What is the latest procedure for declaring sufficient conditions for implementing telemedicine in 2024?

According to the provisions of Clause 3, Article 87 Decree 96/2023/ND-CP, the latest procedure for declaring sufficient conditions for implementing telemedicine in 2024 is specified as follows:

Step 1: The medical examination and treatment facility must send 01 set of dossiers for declaring sufficient conditions for implementing telemedicine to:

- The Ministry of Health for facilities under its management authority;

- The health department specialized unit under the Provincial People's Committee for facilities within the locality (including private medical examination and treatment facilities), excluding those under the Ministry of Health, the Ministry of Defense, or the Ministry of Public Security.

Step 2: Upon receiving the dossier declaring the facility's sufficient conditions for implementing telemedicine, the receiving authority shall issue a dossier receipt according to Form 02 Annex I issued together with Decree 96/2023/ND-CP

Step 3: Within 10 days from the date recorded on the dossier receipt, the receiving authority is responsible for publishing the information of the facility's sufficient conditions for implementing telemedicine on the electronic portal or website of the authority and on the Information System for managing medical examination and treatment activities.

If the requirements are not met, the receiving authority must issue a written document to the medical examination and treatment facility, clearly stating the reasons.

The published information must include at least: the name, address of the facility performing telemedicine, and the list of services performing telemedicine of the facility.

If after 10 days from the date recorded on the dossier receipt, the receiving authority doesn't issue a written notice to the medical examination and treatment facility about whether it meets the conditions for implementing telemedicine or fails to publish the information, the medical examination and treatment facility is authorized to commence telemedicine.

Note: During the operation, if there are changes regarding the declared information in Clause 2, Article 87 Decree 96/2023/ND-CP, the medical examination and treatment facility is responsible for re-performing the declaration procedure.
