What are the main measures to proactively prevent and reduce labor accidents in the last 6 months of 2022?

In Part III of Announcement 3969/TB-LDTBXH in 2022 on some main solutions to be implemented in the last 6 months of 2022 as follows:

To proactively prevent and reduce labor accidents in the coming time, the Ministry of Labor, Invalids and Social Affairs requests the ministries, central authorities, local authorities, businesses, organizations, employers, and employees to actively implement the following main contents:

- Firstly: The ministries and central authorities direct businesses under their management to proactively check labor safety and sanitation work; cooperate with the Ministry of Labor, Invalids and Social Affairs in inspecting and checking businesses operating in fields with high risks of labor accidents, serious incidents such as: construction, building materials production, mining, especially major construction projects close to residential areas, with high pedestrian traffic, lifting equipment, elevators, public amusement constructions using roller coasters, ferris wheels, water slides, cable cars, etc.

- Secondly: The Ministry of Health strengthens implementation and urging of statistical reporting of labor accidents at medical examination and treatment facilities as per Clause 4, Article 36 of the Law on Occupational Safety and Health and Article 25 of Decree No. 39/2016/ND-CP dated May 15, 2016 of the Government of Vietnam and sends reports to the Ministry of Labor, Invalids and Social Affairs for comprehensive aggregation.

- Thirdly: The People's Committees of provinces and centrally-managed cities direct local functional agencies to:

+ Strengthen inspections and checks on compliance with labor safety and sanitation regulations of businesses in their jurisdictions, especially fields with high risks of labor accidents, serious incidents, focusing on establishing safe work procedures and measures in businesses; report labor accidents in compliance with the Law on Occupational Safety and Health.

+ Strengthen organization of communication, dissemination of knowledge and laws on labor safety and sanitation suitable for each field and occupation, prioritizing communication and dissemination of labor safety and sanitation laws for non-contractual workers; combine labor accident prevention with COVID-19 pandemic prevention and control at workplaces.

+ Intensify investigation of labor accidents involving non-contractual workers.

+ Boost the implementation of labor accident prevention with support from the social insurance fund for labor accidents and occupational diseases and report to the Ministry of Labor, Invalids and Social Affairs.

+ Direct the People's Committees at district and commune levels in statistical reporting and documenting labor accidents involving non-contractual workers.

- Fourthly: Businesses strengthen the implementation of labor safety and sanitation work, focusing on self-inspection activities, proactively control and prevent harmful factors at the enterprise, prevent labor accidents caused by falls from height, electric shocks, falling objects, collapses; organize labor safety and sanitation training for employees.

- Fifthly: The Vietnam Chamber of Commerce and Industry, the Vietnam Cooperative Alliance advocate employers to pay attention to building internal rules, procedures, and measures to ensure labor safety and sanitation, improving working conditions at workplaces; organize dissemination of the Law on Occupational Safety and Health for its members.

- Sixthly: The Vietnam General Confederation of Labor, the Vietnam Farmers' Union, and professional associations strengthen dissemination and advocacy for employees and members to comply well with internal rules and safe working procedures; use personal protective equipment in labor to minimize labor accidents, ensure workers' safety, health, and lives.

What are the main causes of fatal labor accidents in the area with labor relations?

In Subsection 4, Section II, Part I of Announcement 3969/TB-LDTBXH in 2022, the main causes of fatal labor accidents include:

* Causes attributable to employers account for 37.85% of the total number of labor accident cases and 38.56% of the total number of deaths, specifically:

- Due to labor organization and working conditions accounting for 16.8% of the total number of labor accident cases and 15.64% of the total number of deaths.

- Employers' failure to establish safe working procedures and measures accounting for 12.09% of the total number of labor accident cases and 12.98% of the total number of deaths.

- Employers' failure to provide personal protective equipment or providing inadequate personal protective equipment accounting for 5.54% of the total number of labor accident cases and 6.67% of the total number of deaths.

- Employers' failure to train or inadequately train labor safety for employees accounting for 3.42% of the total number of labor accident cases and 3.27% of the total number of deaths.

* Causes attributable to employees account for 27.73% of the total number of labor accident cases and 27.66% of the total number of deaths, specifically:

- Employees violating safety technical regulations and standards accounting for 14.08% of the total number of labor accident cases and 14.1% of the total number of deaths.

- Employees failing to use provided personal protective equipment and safety devices accounting for 13.65% of the total number of labor accident cases and 13.56% of the total number of deaths.

* The remaining 34.42% of the total labor accident cases with 33.78% of the total number of deaths are due to other causes such as: traffic accidents, labor accidents caused by others, unavoidable objective reasons.
