How must the industrial cluster development plan be formulated according to the latest regulations?

Pursuant to Article 4 of Decree 32/2024/ND-CP, the industrial cluster development plan must be formulated as follows:

(1) Formulate the industrial cluster development plan based on:

- The strategy for the development of Vietnam’s industry, the strategy for developing sectors and industrial fields at the provincial level;- Orientation for socio-economic development, regional plans, and technical and specialized plans at the provincial level;- The need for land area, geographical, transportation conditions, and resources to attract, relocate organizations and individuals to invest in production and business in industrial clusters at the provincial level;- The ability to mobilize investment capital from enterprises, the state, and other legal sources to invest in the construction of technical infrastructure of industrial clusters at the provincial level;- Environmental protection requirements, efficient and economical use of land and other local resources.

(2) The industrial cluster development plan must include the following main contents:

- Legal basis and necessity of formulating an industrial cluster development plan;- Assessment of the current state of technical infrastructure investment; investment attraction, occupancy rate, production and business activities; environmental treatment and protection measures;

Fire prevention, fighting, and rescue measures at industrial clusters; socio-economic efficiency of the planned industrial clusters;

Management of industrial clusters at the provincial level; achievements, limitations, and reasons;

- Forecast of factors affecting the development of industrial clusters during the planning period; forecast of land area demand by organizations and individuals investing in industrial clusters, land fund capability for developing industrial clusters at the district and provincial level; forecast of labor demand for working in industrial clusters during the planning period;

- Perspectives, goals, orientations for developing industrial clusters at the provincial level during the planning period;

- Formulation of a list of industrial clusters anticipated to be developed at the provincial level during the planning period, including:

+ Name, location (up to commune level);

+ Ensuring safe distance concerning the environment for neighboring residential areas, national historical sites, rivers, and lakes;

+ Only arranging adjacent industrial clusters if there is a linkage in industries, investment sectors, environmental treatment, energy, etc., among the industrial clusters), area scale, operational sectors.

+ Detailed explanation of each industrial cluster, clearly stating:

++ Current land status (based on the principle of limiting the use of land planned for rice cultivation, land in nature conservation zones, historical - cultural sites, scenic spots, etc.);

++ Operating sectors (oriented to prioritize sectors linked within the value chain of priority products, services for production of the locality or neighboring localities);

+ Explanation of the basis for adjusting and supplementing industrial clusters into the list of industrial clusters in the locality;

++ Estimated total investment level for the technical infrastructure of the industrial cluster;

- Display current status, and planning of industrial clusters projected to be developed in the province’s planning maps;

- Development solutions for industrial clusters at the provincial level during the planning period, including:

+ Mobilizing investment capital for infrastructure;

+ Mechanisms and policies to support the development of industrial clusters;

+ Environmental protection;

+ Management and implementation organization.

(3) The funding for building, the period of the industrial cluster development plan is implemented according to provincial planning regulations.

Thus, the industrial cluster development plan must be built based on strategies, orientations for socio-economic development, regional and provincial plans, conditions to attract, relocate organizations, and individuals for investment, production, the ability to mobilize capital, ensuring environmental protection, efficient use of land, resources, and must include the aforementioned essential contents.

Conditions for the establishment and expansion of an industrial cluster from May 1, 2024, according to Decree 32/2024/ND-CP?

Based on Article 8 of Decree 32/2024/ND-CP, the conditions for establishing and expanding an industrial cluster are as follows:

Conditions for establishing an industrial cluster are:

- Included in the list of industrial clusters at the provincial level approved by a competent authority; having a land fund suitable for land use planning at the district level;

- Having an enterprise, cooperative, or organization with legal status and capacity to invest in building technical infrastructure requesting to be the technical infrastructure investor of the industrial cluster;

In case the district-level area has established an industrial cluster, the average occupancy rate of the industrial clusters reaches over 50% or the total non-leased industrial land area of the industrial clusters does not exceed 100 hectares.

Conditions for expanding an industrial cluster are as follows:

- The total area of the industrial cluster after expansion does not exceed 75 hectares; having a land fund suitable for land use planning at the district level;

- Having an enterprise, cooperative, or organization with legal status and capacity to invest in building technical infrastructure requesting to be the technical infrastructure investor of the industrial cluster;

- Reaching an occupancy rate of at least 60% or the demand for leasing industrial land within the industrial cluster exceeds the current industrial land area of the industrial cluster;

- Completing the construction and putting into use essential technical infrastructure works according to approved detailed planning.

What are the preferential policies for investment projects in production and business within industrial clusters?

According to Clause 2, Article 25 of Decree 32/2024/ND-CP, the regulations are as follows:

Investment incentives for infrastructure construction projects in industrial clusters and production and business investment projects within industrial clusters

1. Industrial clusters are areas with difficult socio-economic conditions; investment in building technical infrastructure for industrial clusters is a particularly preferential investment sector.

2. The application of incentives to infrastructure construction projects in industrial clusters, and production and business investment projects within industrial clusters shall comply with the provisions of law on land, tax, credit, and other related legal provisions. In case the law stipulates different incentive levels, the highest incentive level shall be applied.

Thus, production and business investment projects within industrial clusters are subject to incentives according to laws on land, tax, credit, and other related legal regulations.
