Which Organization is Responsible for Evaluating Individuals Hired to Hold Leadership Roles in Public Science and Technology Organizations in Vietnam?

Based on the provisions of Article 10 of Circular 07/2023/TT-BKHCN, it is stipulated as follows:

Evaluation Council

1. Authority to establish the evaluation council:

The agency or unit with the authority to consider and decide on hiring, as specified in Clause 2, Article 6 of this Circular, establishes the Evaluation Council for individuals hired to hold leadership positions in public science and technology organizations.

In cases where the agency or unit with the authority to establish the Evaluation Council does not have a head or deputy head, the authorized agency or unit appointing the head or deputy head shall decide to establish the Evaluation Council.

2. Members of the Evaluation Council include 07 or 09 members, in which:

a) The Chairman of the Evaluation Council is the head or deputy head of the authorized agency or unit as stipulated in Clause 2, Article 6 of this Circular;

b) The Vice Chairman of the Evaluation Council is the head of organization and personnel tasks of the authorized agency or unit as specified in Clause 2, Article 6 of this Circular;

c) 01 Member cum Secretary of the Evaluation Council is an official or public employee of the advisory unit responsible for personnel organization tasks of the authorized agency or unit as specified in Clause 2, Article 6 of this Circular;

d) Other members include 01 representative of the leadership or the Chairman of the Management Council (if any) of the public science and technology organization that needs to hire leadership positions, and experts in the field of science and technology related to the expertise of the public science and technology organization;

dd) Individuals with relations as father, mother, brother, sister, biological or in-law of the person being evaluated; the spouse, biological or adoptive child of the person being evaluated, or those under disciplinary action or currently serving disciplinary decisions shall not be part of the Council.

3. Duties of the Evaluation Council:

a) Review and evaluate the performance results of the individual hired to hold leadership positions in public science and technology organizations based on the terms of the signed leadership position contract, implemented according to Form No. 03 in the Appendix issued with this Circular;

b) Conduct a secret ballot on the level of job requirements compliance according to the contract and adherence to the rights and responsibilities of overseas Vietnamese and foreign experts hired to hold leadership positions in public science and technology organizations, to continue hiring them for leadership roles and report the results to the head of the authorized agency or unit.

4. The Evaluation Council operates based on the principle of collective decision-making, deciding by majority; in case of a tie vote result, the decision follows the Chairman's vote.

5. The Evaluation Council only works when at least 2/3 of the members attend, including the Chairman, Vice Chairman, and dissolves itself after completing its duties.

The Evaluation Council is tasked with assessing the performance results of individuals hired to hold leadership positions in public science and technology organizations based on the contract terms for leadership positions already signed, implemented according to the evaluation form for individuals hired to hold leadership positions in public science and technology organizations.

What Are the Duties of Individuals Hired to Hold Leadership Positions in Public Science and Technology Organizations?

According to Clause 1, Article 12 of Circular 07/2023/TT-BKHCN, the responsibilities of individuals hired to hold leadership positions in public science and technology organizations are as follows:

- Enjoy the attractive policy for overseas Vietnamese and foreign experts participating in science and technology activities in Vietnam, and the benefits stipulated in the signed contract;

- Comply with the laws of Vietnam and commit not to work for political or socio-political organizations abroad or in Vietnam that orchestrates activities against the guidelines, policies of the Communist Party, laws of the State of Vietnam;

- Adhere to the terms of the signed leadership position contract with the public science and technology organization or the authorized agency;

- Abide by the regulations of the public science and technology organization they are leading and the supervision of the supervising agency.
