What are the membership fees of the Vietnam Bar Federation and the Bar Association from January 1, 2023?
Under Clause 1, Article 2 of Resolution 05/NQ-HDLSTQ of 2022, the following regulations are as follows:
Membership fees
1. Lawyers must pay membership fees of the Vietnam Bar Federation and membership fees of the Bar Associations in accordance with the provisions of the Charter of the Vietnam Bar Federation.
The membership fee of the Vietnam Bar Federation is 100,000 VND/person/month (one hundred thousand VND/person/month).
The membership fee of the Bar Association is 150,000 VND/person/month (one hundred and fifty thousand VND/person/month).
Resolution 05/NQ-HDLSTQ of 2022 has regulated the membership fees of the Vietnam Bar Federation and the Bar Association as follows:
- The membership fee of the Vietnam Bar Federation is 100,000 VND/person/month (one hundred thousand VND/person/month).
- The membership fee of the Bar Association is 150,000 VND/person/month (one hundred fifty thousand VND/person/month).
Thus, from January 1, 2023, lawyers will have to pay two fixed types of membership fees as regulated above, equivalent to 3,000,000 VND/year.

Under Article 3 of Resolution 05/NQ-HDLSTQ of 2022, the following regulations are as follows:
Fee framework for lawyer apprenticeship
1. When registering for a lawyer apprenticeship, the apprentice lawyer shall pay a fee to the Bar Association. The highest fee for lawyer apprenticeship is not more than 5,000,000 VND/person (five million VND/person).
2. The Bar Conference of the Bar Association shall, based on the above-mentioned fee framework for lawyer apprenticeship, decide on specific fees of the Bar Association.
Under Article 4 of Resolution 05/NQ-HDLSTQ of 2022, the following regulations are as follows:
Fee framework for joining the Bar Association
1. A person entitled to join the Bar Association shall pay the fee for joining the Bar Association. The highest fee for joining the Bar Association is not more than 10,000,000 VND/person (ten million VND/person).
2. The Bar Conference of the Bar Association shall, based on the above-mentioned fee framework, decide on fees for joining the Bar Association to suit the specific and actual conditions of the Bar Association.
Resolution 05/NQ-HDLSTQ of 2022 maintains the fee framework for lawyer apprenticeship and the fee framework for joining the Bar Association of Vietnam, with the following fees:
- The highest lawyer apprenticeship fee is not more than five million VND per person (5,000,000 VND/person).
- The highest fee for joining the Bar Association is not more than ten million VND per person (10,000,000 VND/person).

Membership fees must be paid no later than the last day of the fee payment period (June 30 and December 31 of the calendar year).

Under Clause 5, Article 7 of the Charter of the Vietnam Bar Federation issued together with Decision No. 856/QD-TTg of 2022, the following regulations are as follows:
National Lawyers Council

5. The National Lawyers Council has the following duties and powers:
a) Enact the Code of Ethics and Professional Conduct for Vietnamese Lawyers;
b) Decide on policies and measures to implement the resolutions and decisions of the National Congress of Lawyers delegates;
c) Approve work reports, financial reports, and annual activity programs of the Federation;
d) Guide the election of delegates to the Congress, prepare documents, nomination and candidacy processes, make the list of candidates, and other detailed matters related to the election of the National Lawyers Council, the Federation's Standing Committee, the President, Vice Presidents of the Vietnam Bar Federation; guide the election or approval of the Secretary-General; introduce lawyers into the list of candidates for election to the National Lawyers Council, the Standing Committee of the Federation, President, Vice Presidents, Secretary-General of the Vietnam Bar Federation in the new term;
dd) Decide the number of members of the Federation's Standing Committee, Vice Presidents; elect members of the Federation's Standing Committee, Vice Presidents; elect or approve the Secretary-General of the Federation; dismiss, remove members of the Federation's Standing Committee, President, Vice Presidents, Secretary-General, members of the National Lawyers Council;
e) Decide to convene the National Congress of Lawyers delegates;
g) Regulate the fee framework for lawyer apprenticeship, the fee framework for joining the Bar Association, and membership fees;
h) Other duties and powers according to this Charter or as assigned by the National Congress of Lawyers delegates.
The National Lawyers Council has the power to regulate the fee framework for lawyer apprenticeship, the fee framework for joining the Bar Association, and membership fees.
