What are the purposes of entry and exit control for Vietnamese citizens at the border gate?

Pursuant to Article 3 of Circular 74/2020/TT-BCA with the following provisions:

Purposes and principles of entry and exit control
1. Comply with the Constitution, laws of Vietnam and relevant international treaties to which the Socialist Republic of Vietnam is a signatory.
2. Ensure publicity, transparency, and create favorable conditions for Vietnamese citizens to exit and enter in accordance with law.
3. Ensure all exit and entry activities must be controlled in accordance with the provisions of law. It is strictly forbidden to take advantage of the entry and exit control to commit illegal acts.
4. The entry and exit control aims to prevent, detect and stop cases of ineligibility for exit and entry; promptly detect and handle violations of the law on exit and entry of Vietnamese citizens at border gates.
5. If an international treaty to which Vietnam is a contracting party contains provisions other than those specified in this Circular, the provisions of the international treaty shall apply.

Accordingly, the entry and exit control aims to prevent, detect and prevent cases of ineligibility for exit and entry; promptly detect and handle violations of laws on exit and entry by Vietnamese citizens at border gates.

According to the provisions of Article 4 of Circular 74/2020/TT-BCA, the scope and area of entry and exit control are determined as follows:

(1) The scope and area of entry and exit control at the air border gate are calculated from the area where passengers queue for exit procedures to the aircraft door and from the aircraft door to the entry and exit control platform.

(2) The scope and area of entry and exit control at the land border gate includes the scope of the land border gate area determined according to the provisions of Decree 112/2014/ND-CP.

(3) The scope and area of entry and exit control at the port border gate include:

- The scope of seaports, ports, wharves, and offshore oil and gas ports announced by the Ministry of Transport or the Vietnam Maritime Administration to be open according to the authority prescribed by law for Vietnamese and foreign ships arrival, departure to load and unload goods, pick up and drop off passengers and perform other activities;

+ The scope of inland waterway ports, inland waterway ports and fishing ports is within seaport waters.

- The scope of inland waterway ports and inland waterway wharfs is announced to be open by the Ministry of Transport or the Vietnam Inland Waterways Administration or the Department of Transport of provinces and centrally run cities according to the authority prescribed by law. allowing Vietnamese and foreign ships to enter, exit, and transfer ports to load and unload goods, pick up and drop off passengers, and perform other activities;

What is the responsibility of the entry and exit control unit in entry and exit control for Vietnamese citizens?

In Article 5 of Circular 74/2020/TT-BCA, there are provisions as follows:

1. Duties of the entry and exit control unit:
a) Check to determine the validity and legality of entry and exit documents and exit and entry conditions;
b) Determine the consistency between people leaving or entering the country and their entry and exit documents;
c) Enter information of people leaving or entering the country into the entry and exit control system and supplement necessary information;
d) Check and compare personal information in entry and exit documents with information in the National Database on exit and entry of Vietnamese citizens through direct or indirect connection via specialized networks. use;
d) Verify entry and exit documents;
e) Temporarily suspend exit for Vietnamese citizens when there is a document from a competent agency or person according to the provisions of law.
2. Entry and exit control at land border gates implements other regulations in Article 5, Article 6, Clause 1, Article 8, Article 22 of Decree No. 112/2014/ND-CP dated November 21 2014 of the Government regulations on land border gate management.
3. Entry and exit control at port border gates implements other regulations in Article 12, Article 13, Article 14, Article 15, Article 16, Article 17 of Decree No. 77/2017/ND-CP dated March 3 7 of 2017 of the Government regulating the management and protection of security and order at port border gates.
4. In cases where people traveling on national defense or security vehicles enter or exit Vietnamese territory to perform national defense or security tasks; Vietnamese citizens using automatic entry and exit control gates shall comply with relevant legal regulations.

Thus, the duties of the entry and exit control unit include:

- Check to determine the validity and legality of entry and exit documents and exit and entry conditions;

- Determine the consistency between people leaving or entering the country and their entry and exit documents;

- Enter information of people leaving or entering the country into the entry and exit control system and supplement necessary information;
