What is the procedure for registering the recognition of parents and children at the Commune People's Committee applicable from April 10, 2023?

Based on Subsection 3, Section B, Part II Administrative Procedures promulgated together with Decision 528/QD-BTP in 2023 the procedure is as follows:

Step 1: Submit Application

The applicant requests to register the recognition of parents and children at the One-Stop Department of the competent Commune People's Committee; pays the fee if applicable; and pays the fee for the issuance of copies of the Registration Extract if requested.

Step 2: Receive Application

- The officer receiving the application at the One-Stop Department is responsible for checking the accuracy, completeness, consistency, and validity of the application.

(1) If the application is complete and valid, the officer will receive the application, give an Appointment Note, and return the results to the applicant (if the applicant chooses to submit the application in person) or immediately send the Appointment Note via email or text message to the applicant (if the applicant chooses to submit the application online), and simultaneously transfer the application to the civil status officer for processing.

(2) If the application is incomplete or invalid, notify the applicant to supplement and complete the application, specifying the types of documents and information needed for the applicant to provide. After supplementation, repeat step (1);

(3) If the applicant cannot supplement or complete the application, report to the Head of the One-Stop Department for a notice of refusal to process the recognition request.

Step 3: Verify Application

- The civil status officer verifies the application (consistency and validity of the information in the application, documents submitted, presented, or attached by the applicant).

+ If the application needs supplementation, completion, or is not eligible for processing, refuse and send a notice of the application status to the One-Stop Department to inform the applicant – repeat step (2) or (3);

+ If further inspection, clarification, or other reasons prevent timely results, the civil status officer issues an Apology Note and reschedules the result return, clearly stating the reason for the delay and the rescheduled time, and sends it to the One-Stop Department for the applicant.

+ If the recognition is appropriate, uncontested, and the application is complete, valid, and conformable, the civil status officer records it in the Register, updates the information in the shared electronic software, and officially stores it.

Step 4: Return Result

- The civil status officer prints the Registration Extract, presents it to the Commune People's Committee leader for signature, and transfers it to the One-Stop Department to return to the applicant.

Step 5: Verify Information

- The applicant (both parties must be present with identification) verifies the information on the Registration Extract, in the Register, signs in the Register, and receives the Registration Extract.

What documents are required to prepare for the registration procedure of recognizing parents and children at the Commune People's Committee?

Based on Subsection 3, Section B, Part II Administrative Procedures promulgated together with Decision 528/QD-BTP in 2023, the required documents for the registration procedure are:

- Registration form for recognizing parents and children according to the template.

- The applicant must submit/present the following documents:

+ Submit evidence proving the parent-child relationship, including:

++ Documents from medical authorities, examination agencies, or other competent agencies confirming the parent-child relationship.

++ If no such documents are available, a written statement from the recognizing parties and at least two witnesses about the parent-child relationship.

+ Present passport, Identity Card, Citizen Identification Card, or other documents with photos and personal information issued by competent authorities, valid to prove the applicant's identification.

+ Documents proving residence information if the registration authority cannot retrieve the citizen's residence information.

If residence information has been extracted from the National Population Database by these methods, the applicant does not need to present it.

Note:

+ The recipient is responsible for verifying and cross-referencing with the information in the declaration form, capturing, or recording the information for the file and returning it to the presenter, without requesting submission of copies or photocopies of those documents.

+ The applicant can submit authenticated copies, original record-issued copies, or photocopies with the originals for comparison. If the applicant submits photocopies with originals, the recipient checks, compares, and certifies them, without requesting submission of copies.

+ The recipient is responsible for receiving complete and correct civil status registration dossiers according to the law, without requesting additional documents not stipulated by civil status law.
