On what grounds are formulation of relic planning made?

Pursuant to Clause 1, Article 9 of Decree No. 166/2018/ND-CP of Vietnam, the grounds for the formulation of the relic planning are prescribed as follows:

"Article 9. Contents of relic planning

1. Grounds for formulation of relic planning include:

a) Legal documents related to the planning;

b) Relevant contents stated in the approved strategy for socio-economic development, national defense and security of the locality where the relic is located;

c) The task of planning the relic has been approved;

d) Regulations and standards on preservation, restoration and restoration of relics;

dd) Opinions of relevant organizations and individuals; community where the relic is located."

Pursuant to Article 10 of Decree 166/2018/ND-CP of Vietnam stipulating the composition of a specific relic planning dossiers as follows:

"Article 10. Relic planning dossiers

The relic planning dossier includes:

1. A report on appraisal or approval of the relic planning, made according to Form No. 02 in the Appendix issued with this Decree.

2. General explanatory report.

3. Map:

a) Map of the location of the relic and its relationship with other relics in the planning study area, scale 1:5,000 - 1:15,000;

b) Current status map of land use, architecture, landscape, technical infrastructure and approved regional construction planning map, scale 1:2,000;

c) Map identifying the protected area and planting relic boundary markers; the area needing clearance of relic violations, the ratio 1:2,000;

d) The master plan map of the site; plan for preservation, renovation and restoration of relics and promotion of the value of relics, ratio 1:2,000;

dd) Orientation map of spatial organization, architecture, landscape, construction of new works and technical infrastructure, scale 1:2,000.

4. The draft decision approving the relic planning includes the main contents specified in Article 9 of this Decree."

According to the above regulations, the relic planning dossier includes the following types of maps:

- Map of the location of the relic and its relationship with other relics in the planning study area

- Current status map of land use, architecture, landscape, technical infrastructure and approved regional construction planning map

- Map to identify protected areas and mark relics; the area that needs to be cleared for violation of relics

- Master plan map; planning plan for preservation, renovation and restoration of relics and promotion of the value of relics

- Orientation map of space organization, architecture, landscape, construction of new works and technical infrastructure

The scale of the above maps is specifically adjusted in accordance with the law.

What are the procedures for appraisal and approval for the task of formulation of relic planning in Vietnam?

Pursuant to Clause 1, Article 12 of Decree No. 166/2018/ND-CP of Vietnam, the procedures for appraisal of planning and relic planning tasks are prescribed as follows:

"Article 12. Procedures for appraisal and approval of planning and relic planning tasks

1. Procedures for appraisal of planning and relic planning tasks:

a) For the task of planning and planning relics being world cultural and natural heritage, special national relic, national relic, the President of the People's Committee of the province or the Head of the Ministry, The branch assigned to directly manage the relic shall send 01 set of documents directly or by post as prescribed in Articles 8 or 10 of this Decree, to the Minister of Culture, Sports and Tourism for appraisal.

Within 30 working days after receiving a valid dossier, the Minister of Culture, Sports and Tourism shall have to organize the appraisal.

In case the complete and valid dossier is not received, within 15 working days from the date of receiving the dossier, the Minister of Culture, Sports and Tourism shall make a written request to supplement and complete the dossier;

b) For the task of planning and planning a relic being a relic at the provincial level, the head of the ministry or branch assigned to directly manage the relic shall send 01 set of documents directly or by post as prescribed in Article 2 of this Decree. 8 or Article 9 of this Decree to the President of the People's Committee of the province where the relic is located for agreement.

Within 30 working days from the date of receipt of a valid dossier, the chairperson of the provincial-level People's Committee is responsible for making an agreement.

In case the complete and valid dossier is not received, within 15 working days from the date of receipt of the dossier, the President of the provincial People's Committee shall make a written request to supplement and complete the dossier.

Thus, for relic planning, the planning basis as well as the composition of the relic planning dossier are specified.

At the same time, the appraisal and approval for planning and relic planning tasks are also carried out specifically according to the procedures and order mentioned above.
