Official Holiday Schedule for April 30 and May 1, 2024: Officially a 5-Day Break?
The Office of the Government of Vietnam has just issued Document No. 2450/VPCP-KGVX to the Ministry of Labor, War Invalids and Social Affairs regarding the proposal to swap working days for the Victory Day on April 30 and International Workers' Day on May 1, 2024.
Considering the proposal from the Ministry of Labor, War Invalids and Social Affairs in Document No. 15111/LDTBXH-CATLD dated April 11, 2024, on the proposal to swap working days for the holiday period of Victory Day on April 30 and International Workers' Day on May 1, 2024, Prime Minister Pham Minh Chinh agrees with the proposal mentioned in the above document of the Ministry of Labor, War Invalids and Social Affairs on swapping working days for the holiday period of Victory Day on April 30 and International Workers' Day on May 1, 2024.
Prime Minister Pham Minh Chinh requires agencies and units implementing the above holiday schedule to reasonably arrange working departments to ensure continuous work, thus ensuring good service for organizations and the public. Special attention should be given to assigning officials on duty to handle unexpected or urgent matters that may arise.
Prime Minister Pham Minh Chinh authorizes the Minister of the Ministry of Labor, War Invalids and Social Affairs to inform agencies, units, businesses, and workers about the swap and holidays on Victory Day on April 30 and International Workers' Day on May 1.

Note: The above official holiday schedule for April 30 and May 1, 2024, applies to fixed weekly days off on Saturdays and Sundays.
Specifically:
(1) For officials, public employees, and workers of state administrative agencies and public service providers
- Swap the working day from Monday (April 29, 2024) to Saturday (May 4, 2024).
During the holiday period of Victory Day on April 30 and International Workers' Day on May 1, 2024, officials and public employees will have 5 continuous days off from Saturday, April 27, 2024, to the end of Wednesday, May 1, 2024 (making up on Saturday, May 4, 2024).
Note: Agencies and units not following the fixed weekly off schedule on Saturdays and Sundays should arrange holidays based on their specific programs and plans, in accordance with the law.
(2) For workers in enterprises
Employers at enterprises are encouraged to apply the holiday period for Victory Day on April 30 and International Workers' Day on May 1, 2024, for workers as prescribed for officials and public employees while ensuring full implementation of policies for the workers, as per the law, encouraging more beneficial agreements for workers.

How are Workers Paid for Working on April 30 and May 1, 2024?
Based on the provisions of Article 98 of the Labor Code 2019 regarding overtime pay and night work pay:
Overtime, night work pay
1. Workers who work overtime are paid based on the unit price of the wage or the actual wage of the job performed as follows:
a) On normal days, at least 150%;
b) On weekly days off, at least 200%;
c) On holidays, Tet, paid days off, at least 300%, not including the wages for holidays, Tet, or paid days off for workers receiving daily wages.
2. Workers working at night are additionally paid at least 30% of the wage calculated according to the unit price of the wage or the actual wage of the normal working day.
3. Workers who work overtime at night not only receive pay according to clauses 1 and 2 of this Article but also an additional 20% of the wage calculated according to the unit price of the wage or the actual wage of the day work of the normal working day or weekly days off or holidays, Tet.
4. The Government of Vietnam details this Article.
In case workers work on holidays, Tet, they receive at least 300% of the wage, not counting the holiday wage for workers receiving a daily wage.
Additionally, workers working at night are paid at least 30% of the wage of the normal working day and 20% of the holiday or Tet wage.
Thus, workers working on April 30 and May 1, 2024, receive pay calculated as follows:
- Daytime work: Receive at least 400% of the wage.
- Night work: Receive at least 490% of the wage.
Fireworks Display Locations for April 30, 2024
Based on Article 11 of Decree 137/2020/ND-CP regulating firework displays:
Firework explosions can be organized in the following cases
1. Lunar New Year
a) Centrally-run cities and Thua Thien Hue Province can display high and low-altitude fireworks for no more than 15 minutes; other provinces can display low-altitude fireworks for no more than 15 minutes;
b) Display time is at Lunar New Year's Eve.
2. Hung Kings' Commemoration Day
a) Phu Tho Province can display low-altitude fireworks for no more than 15 minutes, at Hung Temple;
b) Display time is at 9 PM on March 9 of the lunar calendar.
3. National Day
a) Centrally-run cities and Thua Thien Hue Province can display high and low-altitude fireworks for no more than 15 minutes; other provinces can display low-altitude fireworks for no more than 15 minutes;
b) Display time is at 9 PM on September 2.
4. Victory of Dien Bien Phu
a) Dien Bien Province can display low-altitude fireworks for no more than 15 minutes, in Dien Bien Phu City;
b) Display time is at 9 PM on May 7.
5. Victory Day (April 30 of the Gregorian calendar)
a) Hanoi and Ho Chi Minh City can display high and low-altitude fireworks for no more than 15 minutes;
b) Display time is at 9 PM on April 30.
6. Provincial, central-run city liberation and establishment anniversaries
a) Centrally-run cities and Thua Thien Hue Province can display high and low-altitude fireworks for no more than 15 minutes; other provinces can display low-altitude fireworks for no more than 15 minutes;
b) Display time is at 9 PM on the liberation or establishment anniversary.
7. National and international cultural, tourism, and sports events.
8. Other cases decided by the Prime Minister of the Government of Vietnam.
According to the above regulations, on Victory Day April 30, Hanoi and Ho Chi Minh City are authorized to organize high and low-altitude firework displays, not exceeding 15 minutes.
