How is the Notary Salary Calculated Before the Wage Reform on July 1, 2024?
Pursuant to Article 34 of the Law on Notary 2014 which stipulates the forms of practice for notaries. Specifically:
Forms of Practice for Notaries
1. Forms of practice for notaries include:
a) Notaries of the Notary Public Offices;
b) Partner notaries of Notary Offices;
c) Notaries working under labor contract policies at Notary Offices.
2. The recruitment, management, and use of notaries specified in point a, clause 1 of this Article shall be implemented in accordance with the provisions of the law on public employees.
The signing and execution of labor contracts with notaries specified in point c, clause 1 of this Article shall be implemented according to the provisions of this Law and the labor law.
Accordingly, the current salary of notaries based on their practice location is as follows:
- Notaries of the Notary Public Offices: As public employees, they will receive a salary based on the public employee's salary regulations, specifically:
Pursuant to Article 3 of Circular 10/2023/TT-BNV, the formula for calculating the salary of officials and public employees subject to statutory pay rate application is as follows:
Salary = Statutory pay rate x Current salary coefficient
Currently, the statutory pay rate is 1,800,000 VND/month (Based on the provisions of clause 2, Article 3 of Decree 24/2023/ND-CP)
- Notaries working under labor contract policies
According to Decree 38/2022/ND-CP, which stipulates regional minimum wages as follows:

1. The monthly minimum wage and hourly minimum wage for laborers working under labor contracts per region are stipulated as follows:

Thus, notaries will be paid the agreed-upon salaries in the labor contract, however, they should not be lower than the regional minimum wages listed above.

How is the Notary Salary Calculated After the Wage Reform on July 1, 2024?
- Notaries of the Notary Public Offices (public employees):
According to the spirit of Resolution 27-NQ/TW 2018 on constructing a new salary scale for officials and public employees and armed forces (public sector), statutory pay rates and current salary coefficients will be abolished, and a basic salary amount will be established in the new wage scale.
Specifically, constructing one professional salary scale, job titles for public employees will be universally applied to officials and public employees not holding leadership positions. The basic salary for notaries who are public employees after the wage reform will be based on this new wage scale.
As per Resolution 27-NQ/TW 2018, the salary structure for public employees post-wage reform includes:
- Basic Salary (about 70% of the total salary fund);
- Allowances (about 30% of the total salary fund);
- Additional bonuses (bonus fund being approximately 10% of the total annual salary fund, excluding allowances).
Thus, notary salary for public employees post-wage reform from July 01, 2024, will be calculated as follows:
Notary Salary (public employee) = Basic Salary + Allowances (if any) + Bonuses (if any).
- Notaries working under labor contract policies
Recently, a draft Decree specifying the minimum wage for laborers working under labor contracts was released, indicating a 6% increase in minimum wage compared to the current rate, effective from July 01, 2024.
Accordingly, it is expected that notaries will be paid according to the agreed salaries stated in the labor contracts, but not lower than the following regional minimum wages:
When the regional minimum wages for 2024 are raised by 6% on July 01, 2024, the new rates will be as follows:

Principles for Constructing a New Salary Grade for Official Ranks and Public Employee Positions according to Resolution 27
According to the spirit of Resolution 27-NQ/TW 2018, when implementing the salary reform, each official rank and public employee position will have multiple salary grades based on the following principles:
- Equal pay for jobs with the same complexity level;
- Jobs with higher-than-normal labor conditions and professional incentives will be applied through professional allowance policies;
- Reorganize the group of official ranks and the number of grades within the official ranks and public employee positions, encouraging officials and public employees to improve their professional and occupational skills.
The appointment to an official rank or public employee position must be linked with the job position and the structure of official ranks and public employee positions managed by the agencies, organizations, and units managing officials and public employees.
