What are the regulations on counseling for small and medium-sized enterprises engaged in sustainable business in Vietnam according to Circular 13/2023/TT-BKHDT?

According to the regulations in Clause 2 of Article 13 of Circular 13/2023/TT-BKHDT, counseling for small and medium-sized enterprises engaged in sustainable business is as follows:

(1) Advisory services for technology search, selection, decoding, and transfer; intellectual property ownership, exploitation, and development; digital transformation solutions; assistance in building and implementing basic standards; establishment and implementation of regulated quality management systems; advisory services for improving new products, new services, new business models, and new technologies; assistance in successful registration of product and service accounts on international e-commerce platforms; advisory services for information search, communication, and promotion of sustainable business products and services:

SMEs engaged in sustainable business choose the appropriate support content based on their needs and are supported according to the corresponding provisions in Articles 11, 22, and 25 of Decree 80/2021/ND-CP.

(2) Advisory services for financial access, investment capital raising; personnel, production, sales, market, internal management, strategy development, transitioning to sustainable production and business models, and other activities related to the production and business operations of enterprises: support is provided based on the prescribed criteria for SMEs led by women, SMEs employing a significant number of female workers, and social enterprises as stipulated in Clause 2 of Article 13 of Decree 80/2021/ND-CP.

What is the content of counseling for SMEs in Vietnam according to Decree 80/2021/ND-CP?

According to the regulations in Clause 2 of Article 13 of Decree 80/2021/ND-CP, the content of counseling for SMEs is as follows:

SMEs will receive counseling about personnel, finance, manufacturing, sale, market, internal administration and other contents relevant to their business operation (except counseling about administrative procedures and legal advice according to relevant laws) as follows:

(1) 100% of the value of the advisory contract but not exceeding 50 million VND/year/enterprise for micro-enterprises, not exceeding 70 million VND/year/enterprise for women-owned micro-enterprises, micro-enterprises with high female employment and micro-enterprises that are social enterprises;

(2) Reimbursement of up to 50% of the value of the advisory contract but not exceeding 100 million VND/year/enterprise for small enterprises, not exceeding 150 million VND/year/enterprise for women-owned small enterprises, small enterprises with high female employment and small enterprises that are social enterprises;

(3) Reimbursement of up to 30% of the value of the advisory contract but not exceeding 150 million VND/year/enterprise for medium enterprises, not exceeding 200 million VND/year/enterprise for women-owned medium enterprises, medium enterprises with high female employment and medium enterprises that are social enterprises.

What are the criteria for identification of SMEs in Vietnam?

Pursuant to the provisions of Article 5 of Decree 80/2021/ND-CP, there are the following criteria to determine SMEs:

- Any micro-enterprise in the field of agriculture, forestry, aquaculture; industry and construction that has an average annual number of employees who participate in social insurance not exceeding 10 people, total revenue in the year not exceeding 3 billion VND or total capital of the year not exceeding 3 billion VND.

Any micro-enterprise in the field of commerce and services that that has an average annual number of employees who participate in social insurance not exceeding 10 people, total revenue in the year not exceeding 10 billion VND or total capital of the year not exceeding 3 billion VND.

- Any small enterprise in the field of agriculture, forestry, aquaculture; industry and construction that has an average annual number of employees who participate in social insurance not exceeding 100 people, total revenue in the year not exceeding 50 billion VND or total capital of the year not exceeding 20 billion VND, except micro-enterprises mentioned in Clause 1 of Article 5 of Decree 80/2021/ND-CP.

Any small enterprises in the field of commerce and service that has an average annual number of employees who participate in social insurance not exceeding 50 people, total revenue in the year not exceeding 100 billion VND or total capital of the year not exceeding 30 billion VND, except micro-enterprises mentioned in Clause 1 of Article 5 of Decree 80/2021/ND-CP.

- Any medium enterprise in the field of agriculture, forestry, aquaculture; industry and construction that has an average annual number of employees who participate in social insurance not exceeding 200 people, total revenue in the year not exceeding 200 billion VND or total capital of the year not exceeding 100 billion VND, except micro-enterprises and small enterprises mentioned in Clause 1 and Clause 2 of Article 5 of Decree 80/2021/ND-CP.

Any medium enterprises in the field of commerce and service that has an average annual number of employees who participate in social insurance not exceeding 100 people, total revenue in the year not exceeding 300 billion VND or total capital of the year not exceeding 100 billion VND, except micro-enterprises and small enterprises mentioned in Clause 1 and Clause 2 of Article 5 of Decree 80/2021/ND-CP.

Circular 13/2023/TT-BKHDT comes into force from January 27, 2024
