How many groups of energy-using equipment are banned from import, manufacturing, and sale in Vietnam?

On May 24, 2023, the Prime Minister issued Decision No. 14/2023/QD-TTg promulgating the lists of low-efficiency equipment subject to elimination and low-efficiency generating sets banned from development and application roadmaps.

Thus, the decision stipulates the following two groups of lists:

- List and roadmap of low-efficiency energy-using vehicles;

- List and roadmap of equipment that must be eliminated.

In which, low-efficiency energy-using vehicles means that they are banned from import, manufacturing, and sale domestically.

Pursuant to Clause 1, Article 3 of Decision No. 14/2023/QD-TTg as follows:

Lists of low-efficiency equipment subject to elimination and low-efficiency generating sets banned from development and application roadmaps
1. The list of low-efficiency equipment subject to elimination (with application roadmaps) in Appendix I enclosed hereof includes:
a) Home appliances: Compact fluorescent lamps, electronic ballasts for fluorescent lamps, electromagnetic ballasts for fluorescent lamps, linear tubular fluorescent lamps, storage water heaters, infrared hobs, induction hubs, LED lamps, non-ducted air conditioners, clothes washing machines for household use, television sets, electric cookers, electric fans, refrigerators, refrigerator-freezers, and freezers.
b) Office and commercial equipment: Computer monitors, copiers, printers, notebook computers, desktop computers, and commercial refrigerated cabinets.
c) Industrial equipment: Three-phase asynchronous squirrel cage electrical motors, distribution transformers, LED road and street lighting luminaires, and industrial boilers.

Thus, for the list of energy-using equipment that is banned from import, manufacturing, and sale, there are 03 groups as follows:

- Group of household appliances;

- Group of office and commercial equipment;

- Group of industrial equipment.

What are the responsibilities for organizing the implementation of the List of equipment banned from import, manufacturing, and sale in Vietnam by agencies and organizations?

Organizational responsibilities of agencies and organizations in the implementation of the List of equipment banned from import, manufacturing, and sale in Vietnam are specified in Article 4 of Decision No. 14/2023/QD-TTg as follows:

Implementation
1. The Ministry of Science and Technology of Vietnam shall:
a) Take charge and cooperate with ministries, ministerial agencies, governmental agencies, and People’s Committees of provinces and centrally affiliated cities in implementing measures to phase out low-efficiency equipment subject to elimination and low-efficiency generating sets banned from development prescribed in this Decision.
b) Take charge and cooperate with relevant ministries and central authorities in developing national standards on energy efficiency and minimum energy efficiency of equipment.
c) Take charge and cooperate with ministries, based on socio-economic development situation and state management requirements during the implementation, in managing sectors and fields and presenting decisions on amendments to or replacements for lists of low-efficiency equipment subject to elimination and low-efficiency generating sets banned from development to the Prime Minister of Vietnam
2. The Ministry of Industry and Trade of Vietnam shall:
a) Take charge and cooperate with the Ministry of Science and Technology in inspecting compliance with regulations on the elimination of low-efficiency equipment and low-efficiency generating sets banned from development prescribed hereof.
b) Take charge and cooperate with relevant ministries and central authorities in guiding and inspecting the import and export of goods in compliance with regulations on the elimination of low-efficiency equipment subject to elimination and low-efficiency generating sets banned from development prescribed hereof.
c) Cooperate with the Ministry of Science and Technology of Vietnam in developing and reviewing national standards on energy efficiency and minimum energy efficiency of equipment.
3. Ministries and central and local authorities shall, based on their functions, tasks, and entitlements, take charge of the elimination of low-efficiency equipment and low-efficiency generating sets banned from development.

Thus, in implementing the List of equipment that is banned from import, manufacturing, and sale in Vietnam, the agencies and organizations have the above responsibilities.

Decision No. 14/2023/QD-TTg takes effect from July 15, 2023.
