Pursuant to Clause 3, Article 38 of the Law on Residence 2020 provides as follows:

Article 38. Implementation clauses
...
3. Starting from the date on which this Law comes into force, issued household registration books and temporary residence registers may continue to be used and are equivalent to written confirmations of residence per this Law until December 31, 2022 inclusive.
In case where information in a household registration book or temporary residence register differs from information in the residence database, the latter shall be used.
When a citizen carries out a residence registration procedure that changes information in their household registration book or temporary residence register, the registration authority shall revoke the issued household registration book or temporary residence register, update information in the residence database in compliance with regulations of this Law and not issue a new household registration book or temporary residence register or reissue the old household registration book or temporary residence register to the citizen.

Accordingly, in order to comply with the above provisions of the Law on Residence, the removal of household registration books and temporary residence books will be carried out from January 1, 2023.

Thus, from January 1, 2023, when registering permanent and temporary residence, data information will be updated by competent agencies on the database of residence.

In addition, after making residence registration, citizens can exploit and use residence information in the national database on population by one of the methods specified in Article 14 of Decree 104/2022/ND-CP as follows:

- Look up and exploit personal information through the functions of the information system dealing with administrative procedures at the ministerial and provincial levels that have been connected to the national database on population or through the National Public Service Portal;

- Look up personal information through the citizen's electronic identification account displayed in the VNeID application;

- Use a reader device that has been connected online to the National Database on Population, including a QRCode reader or a chip reader on a chip-mounted citizen identification card;

- Other methods of exploitation as prescribed by specialized laws.

In 2023, can people register for permanent residence and residence online in Vietnam?

Pursuant to the provisions of Article 3 of Circular 55/2021/TT-BCA, there are as follows:

Article 3. Receipt of applications for residence registration and announcement of results thereof
1. Applications for residence registration shall be directly received at offices of residence registration authorities (hereinafter referred to as “registration authorities”) or via the national public service portal, public service portal of the Ministry of Public Security or public service portal for residence management.
2. Applicants submitting their applications directly may submit certified copies or copies issued from the master registers (hereinafter referred to as “copies”) or photocopies together with their authentic copies for comparison. In case an applicant submits a photocopy together with its authentic copy, the application recipient shall inspect and compare the photocopy with its authentic copy and countersign and shall not request the applicant to submit a copy of such document.
3. Applicants submitting their applications via the national public service portal, public service portal of the Ministry of Public Security or public service portal for residence management shall declare information and attach scans or photocopies of necessary documents according to regulations. Citizens shall present the authentic copies of provided documents at the request of residence registration personnel.
4. Announcement of results of permanent residence registration, temporary residence registration, temporary residence extension, residence information declaration, residence information revision, household division and temporary absence declaration shall be carried out in writing or via emails, text messages, websites of registration authorities, electronic applications, national public service portal, public service portal of the Minister of Public Security or public service portal for residence management.
5. Registration authorities have the right to reject applications for residence registration and residence information verification and not refund paid charges if it is found that the documents provided by the applicants have been edited or forged.

Accordingly, the registration of temporary and permanent residence can be done online through the National Public Service Portal, the Public Service Portal of the Ministry of Public Security, the Residence Management Public Service Portal.

Is the residence registration fee uniform nationwide from 2023 in Vietnam?

Pursuant to Article 5 of Circular 75/2022/TT-BTC, there are regulations on the level of residence registration fee collection as prescribed in the Schedule of residence registration fees issued together with this Circular.

Accordingly, based on the Schedule of residence registration fees issued together with Circular 75/2022 / TT-BTC, the level of residence registration fees (permanent residence registration, temporary residence registration, temporary residence extension, separation of households) is adjusted from February 05, 2023, specifically as follows:

Thus, the permanent residence registration fee is 20,000 VND/time for citizens applying directly and 10,000 VND/time for citizens applying online.

For temporary residence registration, temporary residence extension for individuals and households, the fee is 15,000 VND/time for citizens applying directly and 7,000 VND/time for citizens applying online, respectively.

In case of temporary residence registration or temporary residence extension according to the list, the fee is 10,000 VND/person/time when applying directly and 5,000 VND/person/time when applying online.

In addition, the fee when citizens separate households is 10,000 VND / time when applying directly and 5,000 VND / time when applying online.
