What is human trafficking?

Pursuant to Clause 1, Article 2 of Resolution 02/2019/NQ-HDTP, “human trafficking” means that any person who uses violence, threatens to use violence, deceives or employs other tricks commits any of the following acts:

- Transferring human people for receipt of money, property or other financial interests;

- Receiving human people for transfer of money, property or other financial interests;

- Transferring human people for sexual slavery, coercive labor, taking body parts or for other inhuman purposes;

- Receiving human people for sexual slavery, coercive labor, taking body parts or for other inhuman purposes;

- Recruiting, transporting, harboring other people for the commission of any of the acts specified in Point a and Point c of Clause 1, Article 2 of Resolution 02/2019/NQ-HDTP.

What are the penalties imposed upon offense of human trafficking in Vietnam?

The act of human trafficking may be subject to criminal liability for the offense of human trafficking as stipulated in Article 150 of the 2015 Criminal Code (amended by Clause 27 of Article 1 of the Law on amendments to Criminal Code 2017) with the following penalties:

* Bracket 1:

- Any person who uses violence, threatens to use violence, deceives or employs other tricks to commit any of the following acts shall face a penalty of 05 - 10 years' imprisonment:

+ Transferring or receiving human people for transfer for money, property, or other financial interests;

+ Transferring or receiving human people for sexual slavery, coercive labor, taking body parts, or for other inhuman purposes;

+ Recruiting, transporting, harboring other people for the commission of any of the acts of transferring or receiving human people for transfer for money, property, or other financial interests; or for sexual slavery, coercive labor, taking body parts, or for other inhuman purposes.

* Bracket 2:

- This offence committed in any of the following circumstances carries a penalty of 08 - 15 years' imprisonment:

+ The offence is committed by an organized group;

+ The offence is committed by despicable motives;

+ The offence results in damage to physical or mental health of the victim and the victim’s WPI is assessed at 31% - 60%, except in the circumstances specified in Point b Clause 3 of this Article;

+ The victim is taken out of Vietnam’s territory;

+ The offence is committed against 02 - 05 people;

+ The offence has been committed more than once

* Bracket 3:

- This offence committed in any of the following circumstances carries a penalty of 12 - 20 years' imprisonment:

+ The offence is committed in a professional manner;

+ The victim's body part has been taken;

+ The offence results in damage to physical or mental health of the victim and the victim’s WPI is assessed at ≥ 61%;

+ The offence results in the death or suicide of the victim;

+ The offence is committed against ≥ 06 people;

+ Dangerous recidivism

* Additional sentences:

- The offender may also be liable to a fine of from VND 20,000,000 to VND 100,000,000 , be put under mandatory supervision, prohibited from residence for 01 - 05 years or have all or part of his/her property confiscated.

Strictly implement the CPV's regulations on the "exemplary role", uphold public ethics and social responsibility, tighten discipline and regulations in directing and enforcing security, order, and social safety at units and provinces.

Recognize that crime prevention and anti-human trafficking is an important, regular, and long-term task; it must be carried out everywhere, at all times, in all areas and sectors, with a focus on proactive prevention from the grassroots level, making the grassroots the focal point for crime prevention and anti-human trafficking measures

Combine proactive prevention with active detection, struggle, and strict and timely handling without prohibited areas or exceptions for criminal activities.

- Focus on enhancing the effectiveness of crime prevention work, consolidate and maintain the movement of "the whole people protecting national security", detect and resolve social conflicts, reconcile internal conflicts within the healthcare workforce, effectively manage individuals at risk of committing crimes or violating laws within the unit.

Leverage the role of mass media agencies, continue to strengthen information dissemination through diverse and comprehensive forms, objectively reflect the comprehensive work of crime prevention and anti-human trafficking.

- Monitor and address the recommendations and complaints of healthcare workers, patients, and their families at healthcare facilities, contributing to preventing and minimizing factors that lead to crimes.

- Properly implement the work of capturing, analyzing, evaluating, and forecasting situations, promptly provide appropriate solutions to meet immediate and long-term requirements, ensuring security and order in accordance with the practical work of crime prevention and anti-human trafficking in the unit.

- Continue to promote administrative procedure reform..

Implement the provisions of the law on receiving, resolving denunciations, reports on crimes, and initiating investigations; have effective measures to protect whistleblowers who report criminal acts, especially corruption.

Proactively prevent, detect, and strictly handle acts of corruption, negative acts, cover-ups, collusion, and complicity in crimes and violations of laws, and prevent situations where crimes are covered up.

- Mobilize officials, public employees and employees to raise revolutionary vigilance and participate in the "movement of the people participating in crime prevention" within the unit and the community; participate in timely detection and denunciation of various types of crimes, educate and rehabilitate offenders in the community, participate in urging offenders to surrender and capture wanted criminals; organize the dissemination and implementation of laws on offcials and public employees, Law on anti-corruption 2018, Law on handling administrative violations 2012, and related documents related to crime prevention work, drug prevention and control, and prevention of human trafficking for officials, public employees and employees, contributing to limiting legal violations among official and public employees, and timely preventing potential cases of violation leading to crimes.
