What are the regulations on state support for vocational training for employees of small and medium-sized enterprises in Vietnam?

Pursuant to Article 10 of Circular 52/2023/TT-BTC, the regulations are as follows:

Vocational training for employees of small and medium-sized enterprises (SMEs)
Employees of SMEs who meet the conditions specified in Clause 4 of Article 14 of Decree 80/2021/ND-CP when participating in basic-level vocational training courses or training programs lasting up to 3 months are eligible for financial support from the state budget for vocational training costs. Each person is entitled to support once, with the amount determined by the vocational training institution, but not exceeding the maximum limit specified in Point d of Clause 1 of Article 7 of Circular 152/2016/TT-BTC dated October 17, 2016, by the Ministry of Finance on the management and use of funds for supporting basic-level vocational training and training programs of less than 3 months.

Accordingly, employees of small and medium-sized enterprises, when participating in basic-level vocational training courses or training programs lasting up to 3 months, are eligible for financial support from the state budget for vocational training costs. Each person is entitled to support once, with the amount determined by the vocational training institution, but not exceeding VND 2,000,000 per person per course.

To be eligible for support, the employees of small and medium-sized enterprises must meet the following conditions:

- Have worked in the SME for a minimum of 6 consecutive months before participating in the training course.

What are the regulations on state support for training through the E-Learning online training system for employees of small and medium-sized enterprises in Vietnam?

Based on Article 9 of Circular 52/2023/TT-BTC, the regulations are as follows:

Vocational training through the E-Learning online training system
1. The training content for business startup and enterprise management through the E-Learning online training system is determined in accordance with Point a of Clause 2 of Article 14 of Decree 80/2021/ND-CP and the regulations in Part I, Clause 1 of Part II, Clause 1 and Clause 2 of Part III of Appendix 3.2 attached to Circular 06/2022/TT-BKHDT.
2. Funding:
a) Construction, rental, purchase of the E-Learning online training system; maintenance, software upgrades, addition of new features, system maintenance and operation; server rental, purchase, and network connection; digitization and data entry, creation of electronic information: implemented according to the regulations in Decree 73/2019/ND-CP dated September 5, 2019, by the Government on the management of investment in the application of information technology using state budget sources (hereinafter referred to as Decree 73/2019/ND-CP) and relevant legal regulations; economic and technical norms in the field of information and communication.
b) Construction of online lectures, electronic learning materials: implemented according to the regulations in Circular 76/2018/TT-BTC dated August 17, 2018, by the Ministry of Finance on the content and funding for the construction of training programs, compilation of course materials for university education, vocational education, and related current documents.
c) Organization of communication and promotion activities for online training: costs determined in accordance with the principles stipulated in Clause 3 of Article 4 of this Circular.

Therefore, the support for small and medium-sized enterprises in vocational training through the E-Learning online training system is carried out according to the regulations mentioned above.

What are the regulations on criteria for identification of SMEs in Vietnam?

Pursuant to Article 5 of Decree 80/2021/ND-CP stipulating criteria for identification of SMEs as follows:

- Any micro-enterprise in the field of agriculture, forestry, aquaculture; industry and construction that has an average annual number of employees who participate in social insurance not exceeding 10 people, total revenue in the year not exceeding 3 billion VND or total capital of the year not exceeding 3 billion VND.

Any micro-enterprise in the field of commerce and services that that has an average annual number of employees who participate in social insurance not exceeding 10 people, total revenue in the year not exceeding 10 billion VND or total capital of the year not exceeding 3 billion VND.

- Any small enterprise in the field of agriculture, forestry, aquaculture; industry and construction that has an average annual number of employees who participate in social insurance not exceeding 100 people, total revenue in the year not exceeding 50 billion VND or total capital of the year not exceeding 20 billion VND, except micro-enterprises mentioned in Clause 1 of Article 5 of Decree 80/2021/ND-CP.

Any small enterprises in the field of commerce and service that has an average annual number of employees who participate in social insurance not exceeding 50 people, total revenue in the year not exceeding 100 billion VND or total capital of the year not exceeding 30 billion VND, except micro-enterprises mentioned in Clause 1 of Article 5 of Decree 80/2021/ND-CP.

- Any medium enterprise in the field of agriculture, forestry, aquaculture; industry and construction that has an average annual number of employees who participate in social insurance not exceeding 200 people, total revenue in the year not exceeding 200 billion VND or total capital of the year not exceeding 100 billion VND, except micro-enterprises and small enterprises mentioned in Clause 1 and Clause 2 of Article 5 of Decree 80/2021/ND-CP.

Any medium enterprises in the field of commerce and service that has an average annual number of employees who participate in social insurance not exceeding 100 people, total revenue in the year not exceeding 300 billion VND or total capital of the year not exceeding 100 billion VND, except micro-enterprises and small enterprises mentioned in Clause 1 and Clause 2 of Article 5 of Decree 80/2021/ND-CP.
