The Mobile Police of Vietnam to be under the supervision of the People?

Pursuant to Article 4 of the Law on Mobile Police 2022, the principles of operation of the Mobile Police are as follows:

“Article 4. Operational principles of Mobile Police
1. Under the absolute and direct leadership of the Communist Party of Vietnam in all aspects, the domination of the President, the unification of state management by the Government and the direct direction, command and management by the Minister of Public Security.
2. Comply with the Constitution, laws of Vietnam and international treaties to which the Socialist Republic of Vietnam is a signatory.
3. Rely on the People, promote the strength of the People and subject themselves to the People's supervision; protect the interests of the Government of Vietnam, the lawful rights and interests of agencies, organizations and individuals in accordance with law.
4. Closely combine armed measures with other working measures of the People's Public Security force in performing their assigned functions and tasks.
5. Ensure centralized and unified direction and command from central to local levels.”

As such, Mobile Police will operate based on the principles outlined above. Accordingly, the Mobile Police will operate based on the People, promote the strength of the People and be under the supervision of the People.

What is the international cooperation in training Mobile Police of Vietnam?

Pursuant to Article 7 of the Law on Mobile Police 2022 stipulates as follows:

“Article 7. International cooperation of Mobile Police
1. The international cooperation activities of the Mobile Police shall comply with Vietnamese law, international treaties to which the Socialist Republic of Vietnam is a signatory and relevant international agreements.
2. Contents of international cooperation include:
a) Exchange information and experiences in performing the tasks of the Mobile Police;
b) Train, coach, maneuver, support, transfer equipment, means, science and technology to strengthen the capacity of the Mobile Police;
c) Prevent and combat of terrorism, hostage taking, appropriation of aircraft and ships, organized crime, transnational crime; search and rescue;
d) Other cooperation within the scope of tasks and powers of the Mobile Police.”

Accordingly, the Mobile Police will carry out international cooperation according to the contents specified above.

What are the prohibited acts according to the Law on Mobile Police of Vietnam?

Pursuant to Article 8 of the Law on Mobile Police 2022 stipulates as follows:

“Article 8. Prohibited acts
1. Oppose or obstruct the operation of the Mobile Police; take revenge, threaten, infringe upon the life, health, honor and dignity of Mobile Police officers and soldiers, agencies, organizations and individuals participating in coordination, cooperation, support and assistance assist Mobile Police in performing their official duties or for official reasons.
2. Appropriate, destroy, intentionally damage, store, illegally produce, trade and use weapons, explosives, combat gears, vehicles and professional technical equipment of the Scene close mobility.
3. Bribe or force Mobile Police officers and soldiers to do contrary to their assigned tasks and powers.
4. Impersonate officers and soldiers of the Mobile Police; forge vehicles, forge, trade or illegally use costumes, badges, seals, and special work certificates of the Mobile Police.
5. Mobile Police officers and soldiers abuse their positions, powers and working positions to violate the law or infringe upon the lawful rights and interests of agencies, organizations or individuals or acts of harassment, causing difficulties to agencies, organizations and individuals.”

Thus, the acts in the cases listed under the above provisions are prohibited acts. In which, there is the act of the Mobile Police causing harassment and difficulties to agencies, organizations and individuals.

The Law on Mobile Police 2022 will take effect from January 1, 2023.
