What are the principles for ensuring road traffic order and safety in Vietnam?

Pursuant to Article 3 of the Law on Road Traffic Order and Safety 2024, the principles for ensuring road traffic order and safety in Vietnam are as follows:

- Comply with the Constitution, the laws of Vietnam, and international treaties to which the Socialist Republic of Vietnam is a member.

- Ensure that road traffic is orderly, safe, and smooth, contributing to the economic-social development, ensuring national defense and security, and protecting the environment;

- Prevent violations of road traffic order and safety laws, road traffic accidents, and traffic congestion;

- Protect the lives, health, and properties of individuals, as well as the properties of agencies and organizations.

- Ensuring road traffic order and safety is the responsibility of agencies, organizations, and individuals.

- Road traffic participants must comply with the provisions of the law on road traffic order and safety and other relevant legal provisions, taking responsibility for ensuring their own safety and the safety of others.

- All acts violating the law on road traffic order and safety must be promptly detected, prevented, and strictly handled according to the provisions of the law.

- Activities to ensure road traffic order and safety must be public, transparent, and convenient for the people.

- The work to ensure road traffic order and safety is implemented uniformly based on assignment, decentralization, appropriate functions and tasks, and close coordination among relevant agencies, organizations, and individuals.

Will act of operating vehicles while there is a concentration of alcohol in the operator’s blood or breath continue to be strictly prohibited in Vietnam from January 1, 2025?

According to Clause 2, Article 9 of the Law on Road Traffic Order and Safety 2024:

Prohibited Acts

1. Operating a motor vehicle participating in road traffic without a driver's license as prescribed by law; operating a specialized motorcycle participating in road traffic without a driver's license or a certificate of legal knowledge on road traffic, or a driving certificate for specialized motorcycles.

2. Operating a vehicle participating in road traffic with blood or breath alcohol content.

Thus, from January 1, 2025, there continues to be an absolute prohibition on alcohol content when operating a vehicle in road traffic with blood or breath alcohol content.

The regulation on the absolute prohibition of alcohol content is as stipulated in Clause 8, Article 8 of the Law on Road Traffic 2008, amended by Clause 1, Article 35 of the Law on Prevention and Control of Harmful Effects of Alcohol 2019.

What are conditions for operators of vehicles participating in road traffic in Vietnam?

According to Article 56 of the Law on Road Traffic Order and Safety 2024, the conditions for operators of vehicles participating in road traffic in Vietnam are as follows:

(1) Drivers participating in road traffic must:

+ Be of sufficient age and health as prescribed by law;

+ Have a valid driver's license with points and appropriate for the type of vehicle being operated, issued by a competent authority, except for motorcycle riders specified in (4).

When participating in road traffic, drivers must carry the following documents:

(i) Vehicle registration certificate or a certified copy of the vehicle registration certificate with an original confirmation document from a credit institution, foreign bank branch in case the vehicle is mortgaged at a credit institution, foreign bank branch;

(ii) A driver's license appropriate for the type of vehicle being operated;

(iii) A certificate of technical safety and environmental protection for motor vehicles as prescribed by law;

(iv) Compulsory civil liability insurance certificate for motor vehicle owners.

(2) Operators of specialized motorcycles participating in road traffic must:

+ Be of sufficient age and health as prescribed by law;

+ Have a suitable specialized motorcycle operating certificate for the specialized motorcycle being operated;

+ Have a valid driver's license with points or a certificate of legal knowledge on road traffic.

When participating in road traffic, operators of specialized motorcycles must carry the following documents:

(i) Vehicle registration certificate or a certified copy of the vehicle registration certificate with an original receipt valid from a credit institution, foreign bank branch in case the vehicle is mortgaged at a credit institution, foreign bank branch;

(ii) Operating certificate for the specialized motorcycle;

(iii) Driver's license or certificate of legal knowledge on road traffic;

(iv) Certificate of technical safety and environmental protection for specialized motorcycles as prescribed by law;

(v) Compulsory civil liability insurance certificate as prescribed by law.

(3) In cases where the documents specified in (1) and (2) have been integrated into the electronic identity account, the presentation and inspection can be done through the electronic identity account.

(4) Motorcycle riders participating in road traffic must understand road traffic rules, have the skills to operate the vehicle; meet age and health requirements as prescribed in (1i) and Clause 2, Article 59 of the Law on Road Traffic Order and Safety 2024.

(5) Learners operating a car, and those being tested for a driving license, when participating in road traffic must practice on training cars, and test cars on training routes, and testing routes, with a driving instructor or examiner supervising.

Driving instructors or examiners must carry the documents specified in (1).

The Law on Road Traffic Order and Safety 2024 takes effect in Vietnam from January 01, 2025, Clause 3, Article 10 of the Law on Road Traffic Order and Safety 2024 takes effect in Vietnam from January 01, 2026.
